THIS IS AN ALERT TO ALL SCREEN ACTORS GUILD MEMBERS
It is imperative to your well being that you read the TV/THEATRICAL NEGOTIATING UPDATE that was recently mailed to you by Screen Actors Guild and check the box showing support for Doug Allen, Alan Rosenberg and the Negotiating Committee, giving them the authority and ability to go in and negotiate a better deal for you.
We, the membership, need to understand the full impact and ramification of demands being made by the AMPTP and, in particular, the two issues listed below.
Thousand of members will be denied health coverage, pension benefits and residuals.
Free Streaming/Move Over
Streaming network television shows on the internet. There are very important elements of streaming that should be understood.The AMPTP demands:
· 17 days free streaming for current shows
· 24 days free streaming for new shows, followed by:
· Two consecutive 6-month ‘spurts’ for a payment of 3% of Total Applicable Minimum
· Guest star $85.00
· Day Player $22.77
Why is this a problem? It will not be supplemental income, but replacement income. As free streaming depletes the value of reruns, the first and second rerun residuals will be lost.
· Guest Star “top-of-show” (approximately $6,500), loses 60% of income
1st rerun residual $3,290 – lost
2nd rerun residual $3,290 – lost
· Day Player, scale (approximately $759), loses two-thirds of income
1st rerun residual $759 – lost
2nd rerun residual $759 – lost
In aggregate this represents a potential of 100-200 million dollars.
This lost income will have a profound impact on individual members’ Pension & Health Plans.Day Player:
· Currently needs about nine days work with 1st and 2nd rerun residuals.
· Without rerun residuals, will need about 27 days work, an almost impossible number of days to reachGuest Star:
· Currently needs about two guest roles with 1st and 2nd rerun residuals
· Without rerun residuals will need over 3 guest starring roles to qualify
Thousands of members that now qualify will find themselves without health coverage, pension benefits and residuals, turning our union into an elitist union representing only those temporarily the most successful.Clips:
· Producers may use clips for promotional purposes without consent or payment
· For any other purpose, consent is required and negotiable… but cannot be negotiated at time of original employment
This preserves the principle that your work can only be used in and for the film on which you are engaged, allowing you and your heirs to retain control of your name, voice and likeness.
AS A CONDITION OF EMPLOYMENT, in order to build a new industry based on clips, the AMPTP is demanding:
· we give up consent and negotiation;
· allow them to mix and mash clips: “mashing” – putting together 2 or more clips from different sources, creating a new product. we will have no control over how clips are mixed or mashed, leaving the door open for a total perversion of our creative work.
• For a payment of:
· under 2 minutes – $25.00
· under 4 minutes – $75.00
· over 4 minutes – $22.77You need to clearly understand that you will be denied employment if you do not accept these nominal payments and give up your right of consent.
It is critical that you be informed and weigh in on these two issues and the others outlined in the TV/Theatrical Negotiating Update. Our membership, the public and members of the industry at large should understand we are fighting for the basic bread and butter issues of pension benefits, health coverage, the protection of our work and the opportunity to make a living in our chosen careers.
This should be considered supplemental to the TV/Theatrical Negotiating Update which you have just received from the Guild.Fraternally

This is a union in desperate need of qualified voting. Anyone who has ever uttered a word on TV, or appeared as an extra, is a member. I would dare say that the overwhelming majority of the membership does not work in the craft in which they are represented by SAG. With this, there is little incentive for this majority to ever acquiesce.
Of course, for qualified voting to ever pass, everyone would have to vote on it. Therein lies the impossibility.
what value do dayplayers actually add, that they deserve residuals? F that noise.
And if you’re in a position where it’s impossible to put together 27 days of work over an entire year, it might be time to look for a real job.
Do we have to go over this every time? Actors are different from assembly line workers because nobody buys a Chevy based on who installed the anti-lock brakes. But they do watch a TV show or movie based on who’s in it. Same for writers and directors. The U.S. Constitution specifially provides for the protection of intellectual property for the betterment of society. It is the communications conglomerates and rights aggregators that have corrupted the copyright system by the invention of the pervasive and retroactive “work for hire” provision. The people who signed this petition, and others who are raging like Lear against the onslaught of the storm, deserve support and victory if we are to keep the creative community, well, creative.

I would love to put this into the proper ‘voice’ for you to get my complete and acidic tone, but I’ll just use blunt words.
What’s it going to take to wake you up? You’re getting punched in the nose and kicked in the ass…and you seem to like it.
You hiss and spit at each other like kindergarten kids. That’s when you’re not cutting each other’s throats. Get your act together.
I know you thought that I was kidding about the parade idea back in July. Nope, it would have gotten you together and also you would have found out who really supported you in the world. It would have given your cause MEDIA EXPOSURE.
Probably thought that I was kidding about the SEX STRIKE. Why? You’ve got 90% of all the porn actors in the world, use them for good purpose. They would love the publicity. It’s not like the rest of the world thinks that you’re all virgins anyway.
You paying any attention to the Boeing strike? Probably not, after all, that’s outside your little fantasy land. A little history.
The union played nice with Boeing when the airplane biz took a dump after 9/11. Granted concessions, were told they would be revisited when the company got back on it’s feet. Now, seven years later, Boeing has some major orders, biz is good and they now have ‘contingency workers’. People who are doing union jobs without the benefits.
That situation reminds me of the great DVD concession. How many candles are on that birthday cake now? About 20 or so, right? Bet you can have a great party on the money you get from those DVD sales.
The actors are not going to get anything from the AMPTP until the producers/studios feel threatened by your actions.
Either shut the town down or shut the fuck up.

Otherwise, you can join the rest of the people in this country who are now wage slaves.
I had hopes that you would be the last bastion of union and guild strength in this country. Able to lead the way for those who have already lost heath care, pension and other benefits in the past years.
That with your actions, there would be hope for the rest of us to regain proper employment rights and respect for our work. You aren’t the only creative people on the planet.
Life is about pain; emotional, financial, physical,etc. Accept it, deal with it, use it.

Yes, but the middle class actor that only works 27 day play days- is not the actor people are paying to see.
I don’t care what you do- if you can’t pull together 27 days of employment, 1/12th of the year, in your choice of work- you need a different job.

You missed the point, so I’ll clarify the situation.
The destruction of the benefit/health care/pension systems for working people in America has been ongoing for over 30 years.
You might have heard of a former SAG president, by the name of Reagan? Check out what he did for working people in this country. Starting with the Air Traffic Controllers strike back in the ’80s. You like “trickle down economics”?
It’s now coming back on SAG. Call it karma.
Actors and the movies represent the ultimate lifestyle for Americans and people around the world.
It has been my dream that SAG could lead the way, by being out front with their contract, to bring hope to all other working Americans.
There has been a loss of respect, responsibility and fair compensation in workplaces across the country.
I wanted to see SAG LEAD THE WAY FOR ALL AMERICANS.
This has not happened, due to SAG NOT calling a strike vote and then members backstabbing each other.
At this point you’re fucked and you deserve it.
As for my background, very short history. In the past 15 years I’ve done the Hollywood thing, more than a couple of times, written screenplays and run a film commission. Been on feature film sets and worked as a background extra. Lived in and travelled to places you dream about. I’ve got a clue about union negotiations from being a Teamster and negotiating more than a few contracts.
In respect to the state of Tennessee. Ask yourself why so many people from Hollywood/NYC are moving here. Great place to live. Very low ratio of fakes and flakes.
We’re getting ready to build our own studios. Already got all the music elements in place, so it’s not too far a leap to start doing more feature film and TV work.

This is not just about SAG/AFTRA vs AMPTP, etc.
I’s about all of us getting fair compensation for our work.

The AMPTP have stated that their offer means something of the order of $200 million over the 3-year life of the contract. As you can see from the above alert, these “gains” could well be wiped out just by the free streaming/move over demands of the AMPTP that threaten your residuals from prime time network programs, an aggregate of $100-200 million.
If you don’t think that will happen then maybe you should ask the AMPTP to guarantee that the income and benefits will not be lost. Don’t think that will happen. People have already lost prime time residuals from programs that were instantly moved over to the cable networks where they play continually and the residuals are minimal.
Hedge fund money for blockbusters may have disappeared but the entertainment industry continues to make healthy profits and production is up not down. The DVD market alone is projected to gross 50 billion dollars this year and to continue at this rate for at least another 5 years despite the encroachment of internet delivery systems. Why should actors settle for $200 million?
Actors should not under value what they do. It is the faces on the screen that fill the seats in the auditorium and don’t say that the audience is not coming to see the Day Player. That is incredibly ignorant of what supporting players and bit parts do for the performance of the stars and the evolution of the story. If you don’t know that then you aren’t an actor or shouldn’t be one.
Some writers to this blog have said that if an actor can’t get more than 9 or 27 days of work a year then “get another Job”. This is incredibly ignorant and insensitive. Don’t you know that people are working other jobs just to stay alive and have the flex hours that allow them to get to auditions and take an acting job?
Actors underwrite the industry in Hollywood by their willingness to accept these economic conditions. Nowhere else in the world does this enormous pool of diverse and professionally trained talent exist.
Performers work on screen continues to earn billions of dollars for the mega- corporations that own and distribute the product. It is a fundamental precept of intellectual property that the originators of the work continue to benefit from its ongoing exploitation.
Membership First and SAG are fighting to preserve residuals, important protections and the livelihood of members. This will not happen by simply accepting what is being offered or what other unions have accepted.
The go-along to get-along (GAGA) groups like U4S and their predecessors and AFTRA, have always been around in some mutation or other. Looking out for yourself and damn the other guy is not a new concept. This year however their presence has been truly damaging to the negotiating process.
Merging with a union, AFTRA, that sells out actors would only strengthen the GAGA forces by adding to their numbers within the Guild. In 2005, Hollywood was out-voted under Phase One by a combination of the New York and Regional boards and the 50% AFTRA vote. That made it impossible to push for a long overdue hike in DVD residuals. You can only expect more of the same, magnified by a factor of however many issues come up, if the unions were to be merged.
We need one union for performers and that union is Screen Actors Guild. Vote Membership First to keep SAG fighting for you.
