It’s another Boston Tea Party (of the TV kind)… NBC Boston affiliate WHDH announced tonight that, come September, it will air a full hour of local news at 10 PM. That means it won’t air Jay Leno’s new 10 PM show. Not only is this a huge slap in the face to Jay by his hometown station, but also to NBC. And the network is fighting back and even threatening reprisals. Tonight, I received several strongly worded statements from NBC execs declaring war on the affiliate, including this one from John Eck, President of the NBC TV Network: “WHDH’s move is a flagrant violation of the terms of their contract with NBC. If they persist, we will strip WHDH of its NBC Affiliation. We have a number of other strong options in the Boston market, including using our existing broadcast license to launch an NBC owned and operated station.” Also playing hardball is Rick Cotton, General Counsel: “It is clear that WHDH is contractually required to air NBC programming as scheduled by the network.”
That’s not what WHDH owner, Sunbeam chief Ed Ansin, claims. He told the Boston Globe that WHDH could contractually replace Leno at 10 PM with news because, “We don’t think the Leno show is going to be effective in primetime. It will be detrimental to our 11 o’clock (newscast). It will be very adverse to our finances.” Now the question remains: will others among NBC’s long suffering affiliates think the same way and also revolt?
I’m told that, as of now, no other affiliates are threatening to dump Leno. The last time an affiliate challenged NBC, it was KRON in San Francisco — and the station is stuck now as a MyNetworkTV affiliate. NBC is even threatening to pit a strong competitor against WHDH in the Boston market if the station doesn’t start toeing the line. “I don’t think WHDH realizes that we have an O&O in Boston, [WNEU, Channel 60], the Telemundo station there. We could easily shift programming to that station. Or talk with the other independents,” an NBC Universal exec told me tonight.
Just one problem: WNEU only reaches a portion of the Boston market.
Tonight, NBC also trotted out Michael Fiorile, the NBC Affiliate Board Chairman (and Vice Chairman of the Dispatch Group) to give Jay a vote of confidence: “The NBC affiliates are very excited about the new Leno show weeknights at 10 p.m. Jay is a true star with enormous appeal. We’ve been engaged in an open dialogue with NBC about the format of the show, and we’re looking forward to working with Jay and the entire team to make it a huge success.”
But the sad truth is that the same Michael Fiorile was telling media outlets at the end of 2008 that NBC’s beleaguered affiliates had asked the network last summer to give back time, and maybe even days, to them. And to give local content a shot. Because few of theNBC affiliates get a substantial boost from NBC’s primetime offerings because of the low ratings. Even NBC Universal boss Jeff Zucker has admitted that the network-affiliate relationship is overdue for an overhaul. But don’t for a minute think the affiliates’ first-choice scenario isn’t for the network to finally deliver some primetime hits. Instead, NBC is giving up on even trying to program for high ratings.
The result is that when the new 2009-2010 schedule debuts in September, Leno’s show from Day One will be rated lower than anything on NBC’s primetime even now. But that doesn’t matter according to NBC Universal’s controversial philosophy of “managing for margins, not ratings”. Estimates are that Leno 2.0 may only cost $2M a week and result in 46 weeks of original shows, compared to the average $3 million per episode pricetag of scripted primetime dramas that air on average 22 original weekly episodes. But the 58-year-old attracts only 4.8 million viewers now on The Tonight Show – measly by primetime standards, especially in the advertiser-coveted 18-to-49 demographic. The affiliates know that expanded local news or local ballgames might hit a higher number than Leno or NBC’s weaker nights — which is no doubt why WHDH made the decision it did.

I think I love you. If only every large market would follow it would force NBC to spend some bucks and actually create programming.

Hopefully, other affliates will also refuse to carry it and the two dunces (Silverman and Zucker) can undo this ridiculous plan (or preferably, be fired).

That is a terrible article. Why won’t the local station carry Leno?
Wow. I never saw this one coming, but it’s actually pretty brilliant. Local affiliates make MOST of their money on the late news, so it figures that the time-shifting that is eroding 10 o’clock at the Network level must be DECIMATING 11 o’clock at the local level.
Just this week, KNBC forced out it’s longtime (and very expensive) main anchor, Paul Moyer. Makes sense that some renegade station GM would just say to hell with Zucker and Co., and make a decision to be first with late news in the market. (And not first like Fox, which still has a credibility issue in many local news markets.)
Look for other stations to follow suit unless NBC brings out some very big legal guns…
I do not live in the Boston area and I say good for station WHDH for standing their ground.Just because Mr.Leno and NBC decide to change the air time, does not mean that a PRIVATELY OWNED BUSINESS has to bend over. WHDH should take this opportunity to start a trend by organizing:

Putting Leno on at 10 is only something the boneheads at NBC could think up!! And why on earth would he would agree to it?? I’m a fan, but only in his niche…I wouldn’t watch it at 10, and no doubt they’ll make the show unwatchable (just like Conan is). Leno should have switched when he had the chance.
So Jay must once again resort to dirty pool to hang on long after the welcome mat has been pulled up. Bad form, sir. Leno nightly in primetime will not save NBC. It will kill it. NBC should shove in 15 minute programming in that last hour nightly to follow the trends set by Adult Swim and YouTube. Look forward, NBC. Find your new spot. Lead for a change. What are you now, CBS?
Aren’t affiliates ultimately responsible to the commission for their broadcasts and therefore can’t enter into contracts that remove their ability to control their own programming?
If NBC is going to dumb down the content to save $$s, perhaps they should expect affiliates to bail or even to originate local programming. In the olden days, you took the network because you couldn’t afford even the hardware to produce a local show.
Today you can edit HD on a laptop and acquire it with cameras that cost less than $10K for moderately good ones.
I am not surprised, NBC has messed up repeatedly by being oriented to the nutty left, and they have lost considerable following. That a local station wants to do what it considers in its best interest is what freedom is all about. Fox News runs rough shod over all their competitors because their news are balanced , not biased. If NBC pulls the affiliation of that station, I am sure they can find a better affiliation without much delay.
When Leno surprises everyone by consistently placing 2nd in the 10:00 slot, the affiliate will come crawling back.

Ansin has a very strong case that he will make more money with news at ten than with Jay on NBC. Meanwhile will they really roll NBC over to their Telemundo station at a very weak UHF slot? Their numbers in the 7th TV market will tank. IF NBC blinks Ansin can run Jay on his CW UHF station. This is gonna be fun!!!
So NBC’s reaction is to go to war with their affil and threaten to turn their Telemundo UHF station into NBC? That’s hysterical! NBC is fast becoming a UHF station programming-wise, but now they’ll be found there on the dial, too. Honey, do we still have that round wire UHF antenna from the Philco, we’re gonna need it to watch NBC.

What fucking leverage does NBC think it will have with affiliates moving forward?
It’s all well and good to see the end of the broadcast model coming, and shift your assets around, but let’s be clear — NBC has crashed because of poor leadership, not because it got caught up in a sea change. If you’re an affil, and news is your bread and buddah, of course you want to get as close to a proper lead in as possible. Hmm…do I want to start my news after Leno, or the Biggest Loser? (There’s only one answer.)
Leno at 10pm is death. Anyone with a brain knows this.

Good. Who cares? Let them do what they want to. Jay is so far seperated from real Americans that to me, he hasn’t been funny at least for the last 12 years. Kinda like Saturday Night Live. It’s not funny, no one is watching, but they keep putting it on.
I wonder if WHDH knows something very personal about NBC’s financials. Something along the lines of NBC not being able to afford any other option than staying with WHDH. Especially during this economic climate, with ad revenues practically depleted, such a case is not far from imagination. Also, the notion that NBC could even entertain the idea of feasibly launching a studio during this most uncertain of times is downright comedy. I think WHDH sees that giant TV stations are backed up onto their heels, and is trying to make a name for themselves in that quirky little town called Boston.
Good for WHDH. With Obama “campaigning” on the Leno Late Night show recently I’m delighted to know that entertainment trumps politics.

I like NBC. That is why I am surprised that they are being so stupid and wrong-headed on this. Using these kinds of tactics is no way to treat your friends.
I also like Jay Leno. He is a great host. But did they ask him about their plans at all? He is from Boston. He would know how important the news competition is from FOX. But they chose to get punitive with their own affiliate in his home town. NBC is really throwing Jay Leno under the bus on this issue. I am surprised he is allowing them to drag his name through the mud.
But they don’t have to worry. These days, losing NBC affiliation may be just about as bad as losing AIG as a sponsor.
Well, I watch the news at 10 PM. If NBC decides to force the issue, they will also force me to watch another channel. The network’s arrogance and meanness doesn’t carry well with me. NBC is history as far as I’m concerned. They can threaten the local station but they can’t threaten me.

My best guess is you’ll see a number of NBC affiliates choose to leave. If NBC doesn’t care about ratings, the locals do. And that makes it a very easy decision.
It’s funny that the stand off between NBC and their old San Francisco affiliate, KRON are mentioned. Both of them suffered, NBC lost a lot of viewers when the bought KNTV, which was a poor station in the first place and KRON has essential faded into obscurity.
Who watches the networks anyway? They’re so Shamwow. Leno was lame in 1995. Network news is only watched by senior citizens in nursing homes tied to their chairs with rope.
Yea… those threat are really serious. Hey network exec, take a look at all the newspaper bankruptcies and tell me how strong your hand is here. Network exec is another word for “future Wal-Mart greeter.”

HA! Good for Boston! And is that really a threat – to be stripped of an NBC affiliation? They’re in 4th (i.e. last) place in network television as hardly anybody watches NBC anymore.
Let’s also be honest – does anybody really think that Leno will provide a ratings bonanza? His show will be in last place every night. Local stations newscasts will suffer because of that. Why punish local affiliates just because Zucker doesn’t know what the hell he’s doing?
