A class action lawsuit was filed today in Los Angeles County Superior Court against ICM, the talent agency’s EVP Jack Gilardi, and an outside personal manager named John Rockwell described as a “Hollywood hustler and close friend of Gilardi”. It alleges sexual battery, fraud, and a conspiracy under the Racketeer Influenced And Corrupt Organization (RICO) Act to “hip-pocket” actresses for sexual exploitation. TMZ first reported on the lawsuit, and I have now had a chance to read it. ICM gave this statement to me: the “allegations are outrageous and completely false. ICM denies any and all wrongdoing and will vigorously defend this action.”
Claire Robinson, a former Miss British Columbia 2004 and 23-year-old Canadian fashion model, is the plaintiff representing the class of other “similarly situated” women. These are defined as “all female actresses who were falsely promised representation by ICM through a ‘hip-pocket’ arrangement and who were sexually battered or sexually harassed by a co-conspirator.” The practice of hip-pocketing is described by the lawsuit as occuring “when an experienced, well-established senior agent extends the promise of representation to an actress without credit or experience” but never actually takes the “hip-pocketed” actress through the formal procedures of firm representation and then sexually exploits the woman. ICM sources tell me that Robinson is not listed in their records as a client.
Though the class action claims to “chronicle how young actresses wind up on the ‘casting couch’ to be sexually exploited through a criminal conspiracy of powerful men in the entertainment industry,” the complaint targets only one agent at ICM, the 79-year-old Gilardi. Robinson claims that, two years ago, she visited his office where he verbally agreed to be her agent and have ICM represent her. She alleges that on May 20, 2007, the 79-year-old Gilardi “made sexual advances” towards her in an ICM limousine while they were on their way to an awards show.
The rest of the complaint talks about the sexual advances and sexual battery, including a rape, that Robinson allegedly endured in 2007 and 2008 from John Rockwell, 74, who she says is Gilardi’s ”professional and personal friend”. Rockwell is not employed by ICM but she describes him as her personal manager and she claims he arranged for Gilardi to rep her. There is no mention that she ever reported the year-old rape to local authorities. But the complaint says Robinson suffered a nervous breakdown because of her alleged “hip-pocketing” and has been receiving psychiatric treatment.
The lawsuit makes no allegations of sexual battery by Gilardi or ICM. It does allege ”a criminal enterprise (RICO) involving a scheme to sexually exploit young actress [sic]. The scheme involves ICM, one of the top talent agencies in the world, and one of its legendary agents, Gilardi.” Robinson claims there were certain words exchanged between Rockwell and Gilardi — “the phrase ‘found a star’ was code to Gilardi that Rockwell had found a new victim for their scheme of sexual exploitation” – that show they were “co-conspirators”.
The complaint also claims that Robinson “has since learned that this scheme has ensnared other girls who were ’hip-pocketed’ at ICM”, maybe as many as “hundreds”, without providing any details.

Maybe this will give ICM a chance to finally clear out some of their dead wood. Look at Gilardi’s client list. Half of them are dead.

The Entertainment media has built an aura around the industry. If this woman is from a small town, then she might not know what goes on in holywood. She might have stars in her eyes. You know, the ones the PR machines are really good at creating.
There is no excuse for criminally negligent conduct, especially regarding sexual exploitation.

If Gilardi is so upstanding and respectable, then she had nothing to fear or suspect about him. So the argument that she should’ve known better doesn’t make sense, and is psychotic anyhow.

It takes an incredible amount of courage to accuse anyone of rape and undergo the misery and expense of a trial, so my bias is with the complainant. I don’t believe women make this claim lightly. After all, she subjects herself to this ‘blame the victim viciousness’ — Anita Hill, anyone? — and exposes herself in front of the entire world, as well as the courts. Why does anybody who has not been wronged risk all this?

I am familiar with Rockwell. Five-ish years ago when I was 22 and new to LA I met him and he tried to woo me repeatedly with all kinds of flashy and flattering talk, promises, propositions (business & personal), social invitations, etc. I didn’t entertain ANY of his offers because I noticed the red flags, but from what these girls are alleging the manipulative endgame of this geezer doesn’t suprise me in the slightest.
Wow. I have personally witnessed the depravity of old men in power in this business- and when those powerful men tell you that they can end your career before it ever started – they mean it- so you try to find a way out that doesn’t get you black balled –
I am certain that it happened- and if it is class action- doesn’t that mean they had to find multiple victims?
I pray that what this girl said happened did not, and that if it did those scumbags responsible get sent to prison for a long time.
That said, as others have noted, hip-pocketing just means the agent can’t take on any new clients at the time and/or doesn’t want to take one on fully until they see how hard it will be for the person to get work.
Writers are hip-pocketed all the time. Mostly schlubby, out of shape, never-see-the-sun writers. So the term is clearly not about sexual favors.

“Jack” is correct. Women do not make such accusations lightly because inevitably the backlash is like being raped again. Holding attackers accountable is traumatic and life-ruining, and it’s understandable why some women don’t come forward immediately or never do.

The people that bash her for being naive or oblivious to industry practices just had this whole thing go right over their head. The fact that she was naive or oblivious is precisely one of the key points she is making! I don’t know whether her claims have any merit, but based on some of the comments here, some of you people have serious issues with blaming victims.
As a 23 year old female TV writer, I experienced a similar situation at ICM. In my case the agent hip-pocketing me cost me a writing job that was already on the table when he pulled some quid pro quo bullshit. And to all the jerk-off old-school men posting on this site, no, you don’t see it coming. Your male friends, peers, and colleagues never experience it. No one warns you, and you have no recourse because you’re not officially on the books. In my case, I was lucky enough to get away before the dude tried to touch me, but Christ. It took me two years to get my career back on track. That agent has since been fired, and he started up a management company / front of some kind downtown. ICM and the big 5 need to reform their HR departments to address the abuses that go on with hip-pocketed clients.
considering she apparently didn’t file charges for the alleged rape, it seems like it was a price she was willing to pay IF she’d gotten bookings out of it. If that IS the case (and we don’t know, of course) then the most she should be able to go after the agent for is ‘theft of services’ or ‘breach of verbal contract.’ Again, not saying I have ANY more facts than the rest of the posters here, just that if someone agrees to trade sex for payment (cash, a part, representation), then it’s hard to call it rape retroactively when they don’t get their “payment” for services rendered.

Having entered the business when I was 14 with the acting thing then eventually landing at ICM as an agent’s asst. where I knew Jack and trusted him to hip pocket my WIFE (Dead serious), I’m well aware of what goes on from time to time.
These claims might be true. They might not. If they are, why was a rape not reported? If there WAS a rape but then the actress booked a stint on CSA: Miami, would it have been reported? Call me “sick” but think about that last question. I mean really. I was working on a movie a some time ago and an actress blew a director to land the co-starring role. She got it and is now known globally and has a huge quote. Not saying it’s right but again, come on people…

this story seems a bit strange… first of all i am 5’5 and weigh 105lbs. and i can guarantee you that if a 79 yr old man tries to rape me… I KNOW I can take him down. So I am just not buying this story. This sounds more like he probably was going to entertain the idea of representing her. They had sex. Then when she saw she was not getting what she wanted, then I think she went for the kill. Don’t blame her for trying. But a model who is probably 5’9 can definitely take out an 80 yr old man. COME ON!!! It sounds like she is the scammer. When I was in my 20′s I KNEW exactly what I was doing… what the heck was she doing putting herself in the situation in the first place. What a dumb a%*. I would make sure I had contract in writing before agreeing to go anywhere with that old man.

While any exploitation of any gender wrong, the facts are:
1) “Hip pocketing” is a perfectly legitimate business practices of representation that involves everyone from young ingenues to shlubby old screen writers. (Its a very common practice in literary as an agent may only rep a writer on a single script and not want to undertake the process of more formal representation until it sells – particularly if the writer is a “one-and-done” spec writer)
2) There is nothing “sexually” implied by hip pocketing, though it is very common place for agents and managers who are dating talent to “hip pocket” those people they are dating. But this is not necessarily any more nefarious than in any other industry – a car mechanic is more likely to repair their girlfriends car off the books, a publicist is more likely to provide free publicity work to someone they are dating, etc. etc.
But might I also add, hip pocketing occurs with children and relatives as well. I find it unfair to single out representation for its codified system of perks to friends and loved ones.
3) Women take advantage of male agents as well. I know many a young ingenue that has deliberately tried to sleep with an agent, producer, or casting agent in hopes of getting noticed. I usually lied and said I worked in another profession to avoid this from happening – and this is a common practice of people who work at agencies to avoid getting “hit up.”
4) Any time men and women are so desperate to “make it” that they will throw personal morals as well as common sense caution to the wind, there will be unscrupulous individuals who flock to take advantage of the situation.
Generally speaking, those agents in it for the wrong reasons get washed out of the business quick – or at least washed to the dregs of the business where they might continue to ineptly peddle their hucksterism.
This is not a business where reputations don’t matter – and while there are the rare cases in which blind eyes are turned to egregious offenses because of the immense talent of the individual – i.e. Roman Polanski – even in those cases, punishment comes in the form a tarnished career never reaching its full zenith due to despicable behavior.
5) In cases where agents do have sexual relations with clients or potential clients, and just the publicized cases of actresses who married their reps shows that it does occur, it generally is handled with a modicum of respectability and is entirely consensual.
