EXCLUSIVE: Film market research consulting firm Online Testing Exchange (OTX) has squared off in court against Screen Engine, the upstart rival research firm hatched by ex-OTX motion picture president Kevin Goetz following his abrupt resignation on Feb. 25. OTX claimed it scored the first blow when it was granted an emergency injunction yesterday by Los Angeles Superior Court Judge James C. Chalfant that prevents Goetz, another OTX defector, Rachel Parness, and Goetz’s personal attorney Christine Perakis from using OTX’s proprietary “norms,” or historical research, to get Screen Engine revving.
Courtroom judgments are evidently as subjective as research screenings. Goetz’s attorneys, Robert E. Wynner and Gary W. Nevers, denied that any substantive order was issued or that Goetz has been hindered from doing business in any way. “OTX and Screen Engine, LLC are discussing a stipulation concerning the use of normative data that OTX Corporation contends was obtained from OTX, and that OTX contends is confidential and proprietary to its business,” said Wynner, who denied that Goetz has used any proprietary information in his new business.
Said Nevers: “The judge’s decision yesterday confirms that Screen Engine LLC is free to continue its business without any interruption or change in its operations.”
OTX filed a 116-page complaint charging Screen Engine with misappropriating its research data, and the firm is asking for broader injunctions and monetary damages. The complaint alleges that Goetz–a 23-year research vet who previously worked for OTX research rival NRG–laid the groundwork for Screen Engine with Parness and Perakis by grabbing OTX historical data before exiting.
“Nobody wants to stop anyone from fairly competing in a free market, but when you misappropriate our property and intentionally take steps to harm and disrupt our business, that’s not fair competition,” said Vincent Bruzzese, Goetz’s successor in running OTX’s motion picture group. Bruzzese said OTX had “overwhelming evidence” to back its charges.
“We can assert that materials and information which is benefiting their company was taken and misappropriated before their resignations,” Bruzzese said.
Bruzzese said OTX built its own database by testing thousands of films in focus groups for nearly every major studio and producer over the last decade, and using that accumulated data as the basis for recommendations on how pictures might perform in any genre.
“You need a large number of cases and scores to say a film is above or below a norm and to determine whether a movie performed well or not, and to be able to break it down by demo segments and genres,” Bruzzese said. “What this injunction does is force Screen Engine to use norms that are limited to what they in their nascent stage have accumulated so far.”
One veteran studio marketer said that Goetz has one of the best reputations in the research game, and that he is a favorite of execs and filmmakers because of his ability to calm them during the harrowing process of recruiting audiences to criticize their films. The source said that is Goetz’s strength and that OTX should have locked him down before its recent sale of the company to Ipsos, which occurred just before Goetz exited.
Said Goetz: “As a result of the decision, I feel so vindicated. Screen Engine will continue focusing solely on responding to the needs of its clients.”

The only mistake Kevin made was not staring his own company after leaving NRG. He is clearly a star in the research field and shame on OTX for being too dumb to notice. Damn right they should have locked him up AND given him the keys to the kingdom. You go Kevin!
Without a screening business, I’m not sure what OTX has left. Has anyone had any success with them? Their tracking, creative, and positioning research is severely lacking – all data, no insights. They are all sizzle and no steak. Good luck, Ipsos.

To MKT Maven Kevin oversaw all testing at OTX. He’s terrible. His screenings favor filmmakers. He is no friend to the studios.
Screen Engine did something shady, and now they’re caught. Doesn’t matter how popular someone is, it doesn’t excuse unethical behavior.
Everyone who know anything about this buisnes knows that the studios have all the norms, so is really nothing proprietary about this info. That’s exactly how OTX was able to start a sceening division in the firstr place.
OTX should put their effort into building their own company, which they are only able to do with the aid of the emplyees Mr,Goetx trained. It seems like OTX must really be frightened about thbeir future and are wasting time and energy lashing out.
Mr Goetz has been recognized by his peers and the press as not only an innovator in his field, but one of them most honest and ethical people in our business. That is whythe is so well liked. Who the hell runs OTX anyways?
The purchasers of OTX should have done a better job of “research” on who the key people were before they closed te deal. Or maybe the sellers presented the “data” correctly and made sure Mr. Goetz was awarded his rightful place of importance.
There is enought buisness to go around. After all, NRG is still standing.

The poor spotsmanship on the part of OTX has assured that the managemnet of our studio will not be inclinded to work with OTX in the future. There are other places to shop!

Goetz was the only reason most companies used OTX to begin with. It’s Goetz that has always carried the knowledge while working at NRG and then OTX. The research companies use information granted to them by the studios as well as other sources. How can OTX claim that historical data or any other information belongs solely to them. Get a grip, they didn’t secure Goetz, they lost Goetz and now they want him out of the playground… They are bullies.. Good luck to Screen Engine….

He mentors newcomers, gives back to the community ( he started a foundation for MS),and has a sunny, positive disposition.
When he told me about the new venture, he had nothign but positive things to say about his former employers.

When I used Kevin back in his days at NRG for a screening the guy was pure ego, and hardly knew research. When I used him again at OTX the ego got better but the things coming out of his mouth showed that in the end the guy is just a good moderator, that’s all. Wouldn’t be surprised if OTX’s claims are true. Never had a problem with OTX and always found their reports insightful, which is more than I can say for Goetz himself.

Goetz has always been clever but never smart, depending on his superficial charm to cover up his fundamental lack of understanding of the nuts, bolts and hard tacks of the market research industry. In an ideal world he would be exposed as a charlatan but unfortunately, this is Hollywood and the jury is still out.
All that mentoring comes with a price — never benevolent for the sake of being a good guy. You’ll see.
I’ve known the team at otx for a long time, saw them all take a lot of abuse from him behind the scenes, was on the receiving end of it in a past life. begs the question, why the “bozos he trained” didn’t go with him when asked.
