UPDATE: Insiders are denying the rumor that Bob Berney is going to work with Harvey and Bob Weinstein. I’m told there haven’t been any talks — yet. Meanwhile, I’ve learned that Berney has the ability to take key staffers with him wherever he’s going.
EXCLUSIVE 5:30 PM: In a pre-Cannes bombshell,
Bob Berney resigned from the top post of indie distribution company Apparition. I hear its owner, River Road’s Bill Pohlad, was blindsided by the move, especially since Berney and his staff were about to travel to the Cannes Film Festival and look for pictures to acquire. Pohlad has abruptly canceled that departure, especially since there wasn’t really anybody else empowered to negotiate Cannes deals. So now Apparition won’t be a presence at the international fest when it starts on Wednesday. One thing for sure: Berney could not have exited at a worse time for Apparition, and maybe that was the point.
Though Pohlad has been through a number of executives since he started his film company, there hadn’t been talk of discord between Berney and himself. Berney spent the better part of a year raising money after his Picturehouse was shuttered by Warner Bros. Though he hoped to establish a new company with several filmmakers, Berney wound up aligning with Pohlad as the sole financier when the venture was announced last August. Pohlad and Berney originally said their goal was to acquire and release 8 pictures per year, and Apparition got underway with the Jane Campion-directed Bright Star last fall.
But it had been slow going, with Apparition distributing The Runaways and The Square, and at year’s end set to distribute the Terrence Malick-directed Tree of Life starring Brad Pitt and Sean Penn, which is apparently still the plan. Pohlad did not give Apparition the Doug Liman-directed drama Fair Game, which stars Naomi Watts and Sean Penn in the real-life Valerie Plame political drama, and which premieres in competition at Cannes. That film will be distributed domestically by Summit. Was Berney bitter about not getting to distribute the hot-button film? I haven’t been able to reach him yet to find out.
Deadline’s post became the talk of the Delta Airlines terminal tonight, where a phalanx of film executives are waiting to board a flight to Nice for the Cannes Film Festival. (Hey guys, if you haven’t taken off, we’re still gathering details and want your input.)
PREVIOUS: Here’s the email that just went out to staff from Apparition’s owner Bill Pohlad about Bob Berney, the head of the company:
To our Apparition colleagues and staff:
As some of you may know, Bob Berney has submitted his resignation to me. I suspect that this news comes as a surprise to many of you. It certainly did to me. So I can’t claim that we have a plan in place yet in the wake of this announcement. I can, however, assure you that we will be working in the days ahead to explore our options regarding his replacement. In the meantime, Valerie Bruce, our Senior Vice President of Business Affairs, will serve as interim COO.
I apologize for whatever confusion and uncertainty this news may cause, but know that we are proud and grateful for all the work that you have put into the company and appreciate your continued support.
Bill Pohlad

Could the reason be that The Runaways bombed? Kristen Stewart’s haircut made her look like a 35 year old trailer habitue.
The Runaways didn’t perform as well as it could have in the box office because Pohlad decided to hedge his bet and pull back on P and A thinking he could rely soley on the press to do the work.
Bob did not agree with this, but went along since Pohlad has the $$.
If every studio relied on the press to do all the work with selling a film, none of them would spend any $ on P and A.
It obviously doesn’t work like that.
Soory, no. Wrong. Personally I don’t think it was a smart move to have the movie open limited THEN wide. The anticipation for the movie was already there. Then when they cut back the wide release it made it even harder for it to garner any profit at all. The movie itself was great, it’s just too bad not many could see it. And Kristen did not look like a 35yo whatever-you-said. WTF?
Oh geez. The crazy jealous twi-hard wack jobs (see DoRe/8:52pm) who criss-cross the web popping up on boards and in topics that are only remotely related to Kristen Stewart to slam her, have popped up here, ready to attack this kid. Get a fcking life twaht. Note to anyone anywhere: Who’da thunk it, but Kristen Stewart is actually the new Angelina Jolie, inspiring as much irrational hate and jealousy, as she does rabid fandom – it’s still obsession at the end of the day however. Stewart seems to stay above the fray, and do the work, exceedingly and amazingly well, and much like Jolie, she doesn’t deserve this kind of bile from catty bitches either. Nikke you need a moderator to get to scrubbing some of these freaks.
You’re really funny. A rumour that Kristen will play in the sequel of Wanted in which Angelina played equals being her?
And no, she isn’t a kid anymore but why am I telling you this? In 30 years she’s still going to be a kid for some people who can’t live in the reality.
Did you just compare Kristen to Angelina? Oh dear.
I’m sure Berney has his reasons. Kinda sucks for everyone else affected by this though.
I bet his staff are really pleased he just cost them their Cannes trip!
Pohlad wasn’t serious so of course Berney bolted. Guy promised p and a of $10 m on Runaways and provided $1m. He was telling Colin Covert in Minneapolis that they were not acquiring Splice (which will make serious bank for Warners) when they were almost done. He is basically the idiot stepchild with too much money and no clue what to do. That company will be gone and Berney will be fine.
If this is true, Pohlad deserves to lose Berney. The Runaways had zero promotion in my market – one of the largest film-going cities in the country. Seriously, it was in 2 theaters here, and I never saw a single commercial. Such a waste of a promising film…
Runaways bombed because it sucked.
Berney would not have distributed the film if he had the choice. But he did not have the choice.
I’m guessing that the lack of a real budget and direction is the root cause. We shall see.
The Runaways is the best movie of 2010. Period. It’s the only movie that people will remember from this year in twenty years from now.
You don’t spend $1ml on P and A when you have the good will of the press and critics behind a movie such as The Runaways did.
Pohlad was over leveraged on the Malik film and the Liman film. They had been working on both of those for way too long. Way over budget on both. He figured the press would do all of the heavy lifting with The Runaways and that he didn’t need to spend money on P and A. That’s where it went wrong.
Period.
The Runaways was the best movie of 2010? In what alternative universe? The music was not that good when it was new, and the film fell flat. Even with a wide release to begin with, the audience just wasn’t interested. The movie shouldn’t have cost $10 million to begin with. Where did that money go? It didn’t show up on screen. No one will remember this film in 20 years because no on saw it to begin with.
The Runaways probably will be the only movie people remember from 2010 in a couple decades from now. it makes no difference that it didn’t make a killing in the theaters. that is directly related to the shit job that Apparition did by pulling all of the p and money.
most classics aren’t blockbusters. once this movie hits dvd it will spread like wild fire.
Best movie by far i’ve seen all year. It stars one of the biggest movie stars in the universe.
It’ s also her best performance to date. When all the twi-hards get older they will all eventually see The Runaways. Most of them couldn’t see it b/c of the R rating and lack of advertising in the suburbs.
And yes, it will be talked about 20 years from now.
What other movie from this year are people going to be interested in??
It’s Sid and Nancy or The Rose for this generation. The performances from Michael Shannon, Kristen and Dakota are the best this year hands down.
Thank you for mentioning Sid and Nancy. You rule. That movie made shit at the BO and yet is still played probably everyday on tv in some market or other. Still referenced all the time.
And I just wonder why the p and a money was pulled. Just like you said, the movie starred the most famous female celebrity under 25 on the planet, had massive buzz as well as press/critic support so WHY was money not spent when it should have been? I don’t get it.
what is the best movie of 2010?
The Runaways will be one of few that is remembered years from now.
“The Runaways is the best movie of 2010. Period. It’s the only movie that people will remember from this year in twenty years from now.”
uhh … no.
So in 20 years people will remember The Runaways but not The Tree of Life?
Uh huh.
THAT IS CORRECT. The Runaways is an instant classic.
Agreed.
These people don’t know what they’re talking about lol. This movie is a CULT CLASSIC already BECAUSE of its failure at the BO due to its absolute crap handling and distribution. It never had a chance. It has mad pathos already ;p
And you better believe it’s gonna live on and on for *a long while* through dvd, internet and cable.
Right on!!!!!!!!!!!!!!!!!!
God I hope not!!
I met her. She was very rude.
Besides her b!tchface, did Kristen also flutter her eyes, bite her lips and drone on in monotone? I hear she does this in every single movie and calls it acting. In addition to the can’t act aspect, her movies post Twilight will all bomb because she has no screen charisma. Oh wait, her movies prior to the Saga bombed as well so nothing new there. What was Apparition thinking when they hired this independent film box office bomb magnet?
I disagree. Her screen presence adds a depth to roles that goes beyond the script, I noticed this especially in The Runaways. She’s dropping her acting tics (didn’t see any in The Yellow Handkerchief, New Moon or The Runaways). Independent movies have a hard time competing against big studios for box office dollars, I wouldn’t hold that against her (or against Ben Stiller or Ryan Reynolds for their indie efforts). She could’ve been cast in the Tomb Raider movie, but stayed true to On The Road, a movie she was involved with since 2008.
I have no special insight here, but is Apparition anything without Berney’s name/reputation? I don’t know the man, but the success of Big Fat Greek Wedding and Passion of the Christ under his watch seem to be the only thing making Apparition anything more than just another wannabe distributor.
All of these billionaires think they are going to revolutionize the business and they always end up leaving much poorer and fighting with the people they employed. Only exception is Arnon Milchan.
having too much money without a shred of talent makes hollywood the best sandbox in the park for the dispossessed.
Could Berney be headed to the new Miramax to work for Harvey?
Smart. Based in NY where Berney is. Brings cred to a company that needs to make some fast moves. Replaces Ortenberg, who absolutely filled a real role (and is sorely missed.)
WHAT’S GONNA HAPPEN WITH WELCOME TO THE RILEYS?KRISTEN STEWART CAN’T AFFORD TO HAVE ANOTHER BOMB ON HER RESUME.WILL THIS PREVENT THE FILM FROM HAVING A CHANCE AT THE OSCARS LIKE SOME CRITICS ARE SAYING?
Kristen Stewart + independent film = a stinker of a box office cherry bomb.
I’m not sure what’s going on with Apparition, but recently they’ve had very good movies like Bright Star, The Young Victoria, and The Runaways, all of which receiving critical acclaim and positive reviews, only to basically get neglected with very little advertising, promotion, and limited releases in a small number of theaters.
Add Black Dynamite to that list. Easily one of the best comedies in years. Pulled after 2 weeks in theatres. Pity. Another thing that really annoys me is that they didn’t even release a theatrical trailer for the Runaways until 15 days before it opened. I mean, really.
The Runaways being a good movie( i liked it) or not, and Kristen Stewarts haircut have nothing to do with this article. Not the point. It does seem like he chose the perfect moment to say F you! I mean right before Cannes..sheesh
Poor Jessica Knowlittle…
The p+a spend on Runaways was 7mm.
Tree of Life is a mess. Bill was trying to offset his investment last year in Cannes.
-RnsW
Sorry. The p and a spend on theRunaways was no where near 7m. it was under $2mil.
Completely off.
Ok ok ok sorry. I was told 7. that feels right.
-RnsW
Is that typical for a release this size? Only 200+ screens and hardly any advertising. $7 million, really?
You are right! It was 7 Millions. The Runaways director declared this in the Q&A after the first screening in the Sundance Festival.
it must have been frustrating for BB to be kept on such a short leash unable to pull the trigger on great films that went to other distributors because assumedly the reins of caution and guidelines on what could trigger a decent P+A budget were so tight and restrictive. Don’t know the internal circumstances but it’s sad that another promising distributor bites the dust. Of course it’s possible that Apparition will continue and thrive without BB but it seems somewhat doubtful although perhaps it’s time for Sara Rose to step up and get in the driver’s seat? Everyone knows she has the best taste in the business
Agreed. Sara Rose was/is the best thing about Apparition. However, Pohlad is not a shill and he cannot be blamed from stopping Berney ‘pulling the trigger’. Whilst he’s a little plodding, you can hardly call him an ‘idiot stepchild’ given his track record. Apparition tanked for a number of reasons, internal politicking certainly being one of them, but a number of things were handled in a totally ham-fisted way. The awards campaign for ‘Bright Star’ for instance.
Sara isn’t that smart- she survives by doing nothing. That way she avoids blame.
How dare you accuse Pohlad of having a track record. He’s a rich boy who never had to do any actual work in his sad life.
“How dare” I accuse Pohlad of having a track record? His “sad life”? This is almost not worth even replying to. Is he meant to apologize for having inherited wealth? At least he’s trying to champion intelligent, independent cinema with it. And clearly, in the past he has been successful – ‘Into the Wild’ ‘Brokeback Mountain’ etc…Apparition had a twisted internal dynamic on a number of levels, and that was ultimately the reason for its failure, not having a ‘controlling’ ‘entitled’ owner.
They Call you STUPID Tibbs. He didn’t release Brokeback or Wild. He has no track record and is considered the idiot runt of the litter. You watch- company gone and shuttered in 4-5 weeks. So much for your hero, Mr. Dullard
Doesn’t say much about Berney if he was dealing with a “twisted internal dynamic” amongst the people he hand picked to run the place.
Don’t forget that Apparition has released two movies that enjoyed box office successes: “The Boondock Saints II: All Saints Day” and “The Young Victoria”.
Runaways
1. near zero promotion.
2. what idiot put kristin (twilight) stewart in an ‘R’ rated movie an expected her 12 year old fans to turn up?
3. whoever came up with the poster for the film should be shot
4. the dakota-kstew gay subplot didn’t help. all those twilight fans (old and young) are fans of stephenie (mormon) meyer
The Young Victoria
1. nice film.
2. production budget $35M worldwide sales $26M. not a boxoffice success _at_all.
3. emily blunt is not hot
Dakota and Kristen both did a great job in The Runaways, but Apparition was crazy to think that Twilight fans would see this movie. It appealed to a completely different demographic. Kristen was hired based on her work in Into the Wild, it would be a huge shame if this promising young actress were to be defined by a mediocre franchise.
LOL what was wrong with the movie poster?
You’re right about the Twilight mormon dynamic tho. Although I wouldn’t place her fans as being that young. More like High School ages through to early 20s.
Berney’s last distribution success was, um, Passion of the Christ? 6 years ago? Really? Obviously, that film did massive business, but the guy has been releasing films since then and they’ve all tanked. Look at his tenure at Picturehouse and Apparition. What has worked? What has even been a memorable or innovative campaign? Anyone? Anyone? Could it be we have a case of the Emperor’s new clothes here?
Pan’s Labyrinth
Now go the hell away
Yeah, Pan’s Labyrinth. That was four years ago. Picturehouse and Apparition released how many films? And the best you can do is Pan’s? I’m just sayin BB seems to have a a reputation based on a handful of old successes. Maybe people should balance that out with his long and recent list of sputtering films. And sorry but La Vie might have been a coup to get an Oscar win but it was a BO loser
Pan’s labyrinth was an amazing film/successful and the campaign for Marion in La Vie en Rose won her an oscar
dudette, KS wasn’t hired based upon her Twilight fanbase. She was hired before Twilight was released. Why do people think that Dakota and KS were hired based upon the Twilight success? Dakota wasn’t even in Twilight. They were hired b/c the filmmakers thought they were the best actors for the job. They are actors, they are not the characters they play. They can separate fantasy from reality, obviously some fans cannot.
thx for the info. but dude. i am so not a fangirl. the people at apparition should’ve been aware who and what her fan base is now and not you know 5 years ago. and should have made some adustments. had they gotten a pg-13 rating maybe the film would’ve at least broke even. it is naive to think that people these day go to see films just because the story seems interesting. and the film won’t do well overseas because nobody in china could give a s**t about joan jett. and btw. dakota fawning is in twilight 2.
They need to release The Runaways in Japan where people actually remember the band.
This!
PG-13 rating would’ve been a mega-copout. All the greatness and raw beauty of the film would have been washed out. No thanks. I’ll take cult status forevermore tyvm.
Bob Berney has cut a wake across several companies. I worked with him at HBO which co-financed PICTUREHOUSE with NewLine. I watched as he made flop after flop, bad decision after bad decision and when there was finally a well reviewed film of quality, KIT KITTREDGE he chose to open it opposite a little Pixar film called WALLE. He rests on his laurels of GREEK WEDDING, but doesn’t tell you about the movies and franchises he’s destroyed due to his hubris and bad decision making.
Overall, I’d say to Bill, cut your losses. Bob Berney is full of hot air, strutting and fretting his last moments upon the stage, only to be heard of no more. His legacy is a tale told by an idiot, full of sound and fury, ego and false promises, but ultimately signifying nothing.
Berney is a scumbag to, on the eve of Cannes, abandon the company he built with Pohlad’s money leaving Pohlad in a very tough position. It’s an irresponsible betrayal of epic proportions. Don’t know how Berney comes back from this without significant loss of trust from filmmakers.
forgot about Into the Wild – one of my favorite films of the last decade. I think it’s interesting that this website has been cleansed of all positive comments about BP since last night…Comments, NF? Also, to RnsW, that was pretty funny about Jessica Knowlittle – I know more that any of you put together – including NF.
You know more than these people? You hide it well.
I agree. “Jonny Not So Wise” with an agenda perhaps? Calling Pohlad the “runt of the litter”. Profound. I’m very aware that he didn’t release those two pictures. As I said before, his choice to produce these kinds of independent films, regardless of his financial clout says something about his taste. In Berney he sought a partner in promoting intelligent cinema, the like that only a handful of mini-majors still do. That Berney’s record with Apparition was unfailingly weak is not up for debate and to leave the company on the eve of Cannes in such a way speaks volumes.
You’re brilliant, Tibbs. I think Johnny Not so Wise not only isn’t but is Jeanne, Bob’s wife. Talk about agenda…Poor Bill didn’t know he was unwittingly acquiring TWO partners!
I am curious about the legal rights of the films currently slated for release like Tree of Life, and Welcome to the Riley’s.
It seems to me that Bob Berney is the reason those producers chose Apparition as a distribution company. Let’s be honest, Bill seems like a man of great taste in choosing films he finances, but Bob was the expert in the release game.
What happens to the films now? Will they just be shelved until a new head comes into Apparition?
Sara Rose! Really??? It has come to this???? Well I guess if Ellen Pittleman has become the international distribution expert then Sara Rose deserves a promotion.
Amblin Daze wrote, “…acquiring Splice (which will make serious bank for Warners)…”
If only we could immediately send you screaming from this town for making that IDIOTIC prediction.
There was once rumor that Silver’s Dark Castle was planning a $25 million P & A push for “Splice”. If that’s true (doubtful), everybody but Silver and Warners knows that’s $24,999,999.99 down the drain.
WE ALREADY HAVE ENOUGH IDIOTS HERE.
GO HOME.
The amount is $36 m and you aren’t everybody. Hell you aren’t even every retard.
so what happens to The Tree of Life. i really hope it comes out this year
