His $7-a-share tender offer doesn’t expire until 8 PM ET tonight. But he’ll be Lionsgate’s largest shareholder after stating publicly today he has received 12.5% of the studio’s shares from stockholders presumably including Mark Cuban. That 31% is a big jump from the 19% stake he held in the film company before he put his offer on the table. It’s also a blow to current Lionsgate management which has kept advising shareholders not to deal with Icahn. He offered $7 a share for the remainder. MORE

So Icahn is coming in like gangbusters to take over Lionsgate, a studio that’s been putting out plenty of product lately. Is he simply after the studio’s inventory? Doesn’t he run the risk of ruining the studio by driving off the talent that has made it successful? The value of any creative enterprise is the people behind it; lose them, lose a lot.
Make ‘em hurt Carl. It’s a useless studio with current management and deserves to be turned over or turned out.
Time to hold back those Lionsgate submissions and wait for the new studios heads.
