Swiss Reject U.S. Extradition Of Polanski
UPDATE: Roman Polanski is on his way back to France. The AP is reporting from Bern, Switzerland, that the Swiss government declared Oscar-winning film director Roman Polanski a free man today after rejecting a U.S. request to extradite him on a charge of having sex in 1977 with a 13-year-old girl. “Mr. Polanski can now move freely. Since 12:30 today he’s a free man,” Justice Minister Eveline Widmer-Schlumpf declared, after informing authorities in the United States, France and Poland, in addition to Polanski’s lawyer. Polanski was arrested on September 26th as he arrived in Zurich to receive a lifetime achievement award from a film festival. Since December, the director had been held under house arrest at his chalet in the resort of Gstaad.
The Swiss mostly blamed U.S. authorities for failing to provide confidential testimony about Polanski’s sentencing procedure in 1977-1978. The Swiss government said it had sought confidential testimony given on January 26th by Roger Gunson, the Los Angeles attorney in charge of the original prosecution against Polanski. U.S. authorities rejected the request. Widmer-Schlumpf said this decision was not meant to excuse Polanski’s crime, saying the issue was “not about deciding whether he is guilty or not guilty.” The government said extradition had to be rejected “considering the persisting doubts concerning the presentation of the facts of the case.”
According to the stunning Swiss decision, “The 76-year-old French-Polish film director Roman Polanski will not be extradited to the USA,” the ministry said in a statement. “The freedom-restricting measures against him have been revoked.” Thus seems to end the 3-decade pursuit of Polanski by Los Angeles authorities — unless he travels to another country willing to apprehend him and weigh sending him to LA. But France, where he has spent much of his time, does not extradite its own citizens. And the AP noted that public scrutiny over Switzerland’s deliberations may dissuade other nations from making such a spectacular arrest.
Authorities in Los Angeles and Washington cannot appeal the Swiss decision. There was no immediate comment from the LA County District Attorney’s Office. French Culture Minister Frederic Mitterrand’s office expressed satisfaction with the decision, 9 months after Mitterrand said Polanski had been “thrown to the lions.”
The Swiss Justice Ministry said it took into consideration the wishes of the victim, Samantha Geimer, who long ago publicly identified herself and has joined in Polanski’s bid for dismissal. The Oscar-winning director of Rosemary’s Baby, Chinatown, and The Pianist was accused of plying his victim with champagne and part of a Quaalude during a 1977 modeling shoot and then raping her. He was initially indicted on 6 felony counts, including rape by use of drugs, child molesting and sodomy, but pleaded guilty to one count of unlawful sexual intercourse.
In exchange, the judge agreed to drop the remaining charges and sentence him to prison for a 90-day psychiatric evaluation. However, he was released after 42 days by an evaluator who deemed him mentally sound and unlikely to offend again. The judge responded by saying he was going to send Polanski back to jail for the remainder of the 90 days and that afterward he would ask Polanski to agree to a “voluntary deportation.” Polanski then fled the country on the eve of his February 1, 1978, sentencing.
Based on references to Gunson’s testimony in U.S. courts, the Swiss said it “should prove” that Polanski served his sentence after undergoing 42 days of diagnostic study. “If this were the case, Roman Polanski would actually have already served his sentence and therefore both the proceedings on which the U.S. extradition request is founded and the request itself would have no foundation,” the ministry said.


Sigh.
The US never cared about Polanski. They care about precedent.
This wrangle was another attempt to place the American legal system above those of foreign nations. The Swiss authorities were more than willing to extradite him – if the Americans would have played legal ball by giving the Swiss insight into the US proceedings. They didn’t, because this would have set a precedent that would weaken the US objective of having its own legal structure be the dominant guideline. So, the US would rather NOT get Polanski than do it by accepting a precedent that would weaken their overall legal dominance (e.g. by letting the Swiss re-judge an American case like this one)
This approach isn’t limited to jailing a deviant aging film director. In the last decade, the US legal system has become the dominant legal framework for decisions from environmental to property and intellectual law. US internet law has been adopted by many nations. In Switzerland, the US is actively trying to shape the banking laws.
Amazing. This pedo is set free. I don’t want to hear any defense of this monster. FACT: He drugged and raped a child. These facts are not in dispute. He is a great director and for that he’s a pass. I, for one, do not want to hear about any fuck up by the prosecutor or anything else. The fact that he’s a convicted pedo, and further after he fled LA he starting screwing underage girls again (albeit this is apparently not a big deal in France). And worse, Hollywood has been making a way to his door non stop since this pervert was convicted and fled.

More amazing that you feel the need to be so indignant when even the girl involved has asked for the matter to be dropped. What the hell was a 13 year old girl doing out with him unless she wanted to get it on with an older, sexy guy? Where were her parents? Stupid of her, yes, and she paid for her stupidity, but Polanski was given a sentence and served it. The end. This need for retribution is SOOOOOOOOOOOOOOOO American. Get over yourself.
Look… I´m not saying what he did was correct but he served a sentance…. albiet a light sentance of 42 days… and he was released and thought not to re offened… THAT´S the US justice system… Then the judge said he was not happy and threatened to send him to jail for the remaining 48 days and then deport him…. Now, that´s BS. Powers that be decided he was a free man. He´s never reoffened period. Now he´s just spent 9 months in house arrest? That´s longer then most do on rape. Let him be and get on with your life.

While I personally disagree w/ the Swiss court’s decision, I must abide by it as it is written, “Render unto Caesar the things which are Caesar’s, and unto God the things that are God’s” Matthew 22:21. Polanski will one day be judged accordingly.
Polanski has already been judged, and judged, and judged. He escaped the Nazis, Charles Manson and the California So-Called Justice System. If there is an afterlife, he’ll be well taken care of with a cush gig and peace beyond peace. No fires of Hell or damnation for him. He’s known that in this life far more than any of us or you can imagine. He lost his mother and unborn sibling to Hitler, his wife and unborn child and three friends to Manson and this hell over one American teenager who cried rape with no proof other than her own word. No, it’s not in the cards for Roman Polanski to face anything other than calm waters and a good wine in whatever heaven awaits him.
And another rich, powerful rapist and escaped criminal gets away with it after paying off his victim.

the if justice is served of not; will remains (for the time being at least) obscure…but now if Polanski were not the director of: Chinatown;the tenant; the ninth gate;the ghost writer; and of course the pianist…one could easily says that if live if most interesting than his movies( maybe a fine Darren Aranosfky s film happens in the near future, with his bio) he fled the Nazis, escaped the soviets and now even the l.a. justice department( lets forget mason and his cult) could he escapes Hollywood next; and make another of his strong pics?
Not surprised by this. The combination of the time lapse, forgiveness from the victim and Polanski’s wealth and influence made this outcome a strong probability. I’m certain there are lots of people who fail to see what the big deal was in the first place but I guess that’s why its called “Lifestyles of the Rich and Shameless.”
What wealth? He had to put up his Paris loft as collateral for his bail? There is an erroneous believe Roman Polanski has tons of mulah. You’d be wrong in that assumption. He owes tens of thousands in legal fees to his lawyers fighting this case. Samantha Geimer apparently benefitted from him to the tune of a half a million dollars.
This is very disappointing to hear. Time does not make a crime disappear! And I don’t even care if the victim doesn’t want him prosecuted now. It’s not about her, it’s about the sovereignty of our justice system; it is disgusting that a celebrity can get of the hook for a crime like this, no matter how long ago it occurred. Justice should know no time limits!
get off the hook? He served time, and then the judge threatened to do something which is illegal too! The justic system is f ed for sooooo many reasons… get over it. Yeah it´s lame that celebrities get a lighter sentance… Young what´s her name getting 90 days for being a drunk while someone else might have got 6 months- or a year….. well you know what I find worse? Laws which try to keep people in jail based on thier skin color of finiacial class!

I totally agree. Honestly, we don’t have more current Monsters to be going after than a 70+ man who served his sentence and was forgiven by the victim. This was not about the crime this was about sensationalism.
figured the moment Roman learned he was not going to be headed to the u.s he would be headed back to France though had him running to France the moment he made bail. and Roman will proably be more careful traveling from now on

It seems to me, from all accounts I’ve read, that Polanski served his sentence as was agreed to in his plea bargain. So he’s supposed to serve it again?

I agree the child molester has served his very light sentence and should not continued to be harassed, however,Had this person not been “rich and famous”, I can assure you his sentence would have been much more intense. The most important issue is that this person does not do any similar crimes again. Hopefully, at age 70 he can only think about what he used to do.
