Two European sales companies — British based Hanway Films (the sales company of British producer Jeremy Thomas) and Paris-based Celluloid Dreams — are calling for Avi Lerner to step down as vice-chair of the Independent Film & Television Alliance. The problem stems from accusations that, at the same time he’s helping run the organization pledged to be the “voice and advocate for independents worldwide”, some companies which Lerner controls are apparently exploiting those same indie filmmakers by allegedly owing them hundreds of thousands of dollars.
Lerner is co-chairman of Nu Image, which in 2007 bought the U.S. distributor First Look
which is being sued by around 20 other film companies. Hanway Films’ head of business affairs Richard Mansell says his firm is owed nearly $500,000 by First Look, and pledges to soon pursue Nu Image through the courts in Los Angeles. Celluloid Dreams has won a court case against First Look for over $720,000 still owing from the U.S. release of Quentin Tarantino-starrer Sukiyaki Western Django, but hasn’t seen a dime yet. CEO Hengameh Panahi, one of Europe’s most respected sales agents, explains: “You can’t exploit somebody’s film and then not pay people.” IFTA would not comment on what it says are legal matters involving its members. Hanway Films’ Mansell says: “How can he represent the interests of an organization which is meant to adjudicate on and penalize wrongdoing by distributors? It makes IFTA itself a joke. If the organization had any integrity it would ask him to step down. IFTA is not being asked to comment on a legal dispute between its members: it is being asked to comment on activity subject of a court decision.”
Here’s what happened: First Look went bankrupt last month. But its movie assets are still controlled by Nu Image through its Millennium Entertainment subsidiary. Fears are that, by having the related company Millennium Entertainment take over First Look’s assets, Nu Image will escape its obligations.
As for Avi Lerner, whose company Millenium Films recently ran afoul of the Producers Guild of America, tells me he’s unaware of any UK court judgments against him. As for anybody who has one stemming from First Look, Lerner tells me: “They’ve got a judgment against a company that doesn’t exist, so who cares? All I wish them is good luck and try to collect the money.” Lerner stresses he never had any involvement in the day-to-day running of First Look, and what he discovered horrified him. “I made a big mistake by buying this company. I am the first one to fight for the rights of the indie producer. If First Look or Nu Image has done wrong, I believe in honesty and I believe in putting all the facts on the table.” Lerner says he decided to put First Look in bankruptcy because he didn’t want to spend the rest of his life shuttling from court to court. As for Hanway Films and Celluloid Dreams calling for him to quit the IFTA, Lerner says he’s never heard of the pair. “Tell those two producers next time there’s an election for the vice-chairman not to vote for me.”
British producer Richard Holmes is still another indieprod who says he’s been burned dealing with First Look. Holmes won a court judgment in London at the beginning of this year ordering the U.S. distributor to hand over $176,000 owing from the American release of his Irish comedy Waking Ned. He’s now trying to get that judgment enforced and calls the situation ”a disgrace”. As Holmes claims, First Look is “still trading as Nu Image/Millennium and attracting other producers into their quagmire.”


Avi Lerner is a super douche to indie filmmakers. We have a project at First Look. Never seen a penny. Meanwhile the film is tracking far above average (according to other metrics) in rentals across Netflix, Blockbuster and iTunes Movies. He plays ignorance but this is just a shell game we’ve all seen before. Even if indie filmmakers had the dough to sue, and even if they won, this is a no win pursuit as Avi’s MO is simply to answer with more games of deceit.
I got fired from Nu Image years ago apparently for “asking too many questions”. Always suspected this group of folks. NOT SURPRISED in the LEAST to hear of these troubles. I smell a crook with anything Nu Image does.
This is exactly why its so difficult bringing in private equity investors into this industry. Whether he is at fault or not, when investors hear of nightmare scenarios, it creates a difficult environment for us producers who rely on private equity to finance our films.
This industry needs a major overhaul in how it conducts business.
If you have to ask the question to begin with then you are clueless. Contracts to Avi are just hypotheticals. He’s never met an agreement that he has honored unless it was to his benefit. Get paid in advance (preferably with a certified check) and hope the movie is good in spite of him.
Dealt with Avi in the past. He is the original Slim Shady. Doesn’t read scripts only approves packages and panders to stars who are dimming. Avoid him at all costs.

Dust-up: Lerner’s business partner Dimbort came under fire by the Producers Guild of America this year for giving his teenage granddaughter a producer credit on the drama “Solitary Man,” starring Michael Douglas, “despite performing no discernible producing functions,” the guild alleged. Lerner defended his partner, saying, “We have the legal right to give anyone a credit on this movie.”

Yes. If you have industry connections and can get to Avi he will back your horrible script as long as you can get a star attached so he can pre-sell. He will give you a modest budget 5-75 million to work with. But the quality means nothing. He makes loads of trash and thing that cannot find a home elsewhere. As a UK producer, I don’t have a problem with this. But a a fan you should know if his name is on it and the people involved are well known there is a good chance it is not the best material or else a more discerning company would have Bern involved.
Has never heard of Hengameh Panahi and Tim Haslam? Celluloid Dreams and Hanway are 2 of the most well-known and respected international companies, and with good reason — they get movies made and pay their obligations.
Don’t be so sure celluloid dreams and Hanway pay their bills. And before you write Avi off has everyone forgotten there’s an economic meltdown going on in the indie film business?
There’s not an international distribution company out there who’s doing better than they were five years ago. Avi’s feeling it like everyone else.

I think they were talking about Avi First Look domestic, not Avi International/ Nuimage. Two very different companies doing very different things. Avi the Indy sales company, is worthy of IFTA… They make more films then most indies. First Look, is another story. Plagued by bad debts, Henry Winterbone who knowns nothing about films, just excels in getting laid, hired bad people and many of them… over paid for films etc…How he managed to talk Avi and Trevor into taking over FL confuses everyone, but knowing them well, ego played a huge part. . Since neither men did their proper due diligence, it is no surprise, that they are still at a loss. And since Avi and Trevor never return phone calls, companies like Hanway and Celluloid dreams got screwed over. A phone call and small payments would make both companies happy, rather then problems being pushed under a rug and hoping for them to go away. (They rarely do) So Avi the indie sales company, should not be kicked out of IFTA. (Not that IFTA really does much) but Avi should learn from this, as should everyone… If you buy something, pay for it, if you can’t afford it, explain your issue, people usually will work with you.
Dealt (and still deal) with Avi and he’s one of the most honorable producers/sellers in the business. Sorry to hear about your bad experiences, but none of you really know what you’re talking about. Just because First Look is an albatross of a company, Avi’s reputation should not be compromised. This is the movie business, shit happens, good and bad. Funfacts: Celluloid dreams is now a half rate company that has fallen from grace due to various shady business practices and misrepresentations. Hanway has had one pseudo hit (An Education) in the last 4 years but mostly produced a series of expensive losers for their buyers. Not to mention that celluloid and Hanway once merged into a disaster of a company called “Dream Machine” and then separated after 2 lousy markets. Their own internal misgivings couldn’t function as one.
Millennium/Nu Image never met a rule they wouldn’t break if they could – DGA health and welfare? They’ll try to roll it into your DGA minimum directing fee because why *should* they pay extra for something like that? Writer’s rights? Welcome to arbitration hell. Payment? Try to get the world’s tallest business affairs person to return your call.
Avi Lerner gets movies (w/ Clive Owen!) made. But who wants to be nickel, dimed and abused for the pleasure of not getting paid and not necessarily getting your movie released?
There are 2 class action suits (over 20 films) against him and his companies at SAG for non-payment of residuals.

This man is one of the greatest indie producers of all time.
He has transformed a direct to video company into a theatrical company with a major hit (“Expendables”).
He has another franchise theatrical film coming out, “Conan”, in August of 2011.
Everyone comes to Avi to do business and will continue to do so.
As for the UK people who seem to be the most critical of Avi, stay in the UK and don’t make movies that anyone wants to see.
We have plenty of business here and are making good movies.

Agree re Solitary Man. This was obviously headed for the straight-to-video pile. Avi to the rescue. Okay, you can’t pay him to distribute so you pay him with credits. Sad all around. Let’s a movie be seen that shouldn’t. There is quality on the shelf that will not be seen. Sure, Avi is not breaking a rule but for the people who deserve credits it is disgusting. And, for the creative parties who rationalize in their heads the movie is real now. So sad. It’s terrible for our industry.

I do a lot of business with Nuimage/First Look; Just because you excel in selling films for International, should not make you believe the same holds true for the US. The US market is not an easy one to tap into. Danny the Co- CEO always felt it was a mistake for them to buy FL. I have to agree. The acting CEO of FL still has no clue how to run this company, nor does the previous or current COO’s. (Avi especially) If they were smart they would sell FL and start concentrating on their productions and International sales company. It also wouldn’t hurt Avi to leave behind the two ladies who seem to have some what taken over Nuimage and destroying the successful foundation the three of them have built.
Avi’s biggest issues are women and ego. If only he knew how to control his women and separate his personal and business…
My suggestion to Avi- Start cleaning up the mess you created with Domestic, (Pay people back) Sell FL… let Danny and Christian sell Nuimage films to all the domestics and concentrate on what you do best, making films and smoozing agents, talent and managers. (Avi can’t sell domestic to save his life)

After Nu Image/Millienum Films/First Look shafted Werner Herzog/Ed Pressman with Bad Lieutient and Soderbergh and his other producers on Solitary Man, and many other films, why would people continue to do business with them?
Both those films could’ve opened in 1,500 screens and made some money. instead, they slowly rolled out on no more than 300-400 screens for a month and has to make its cash on the DVD/VOD end of things.

Getting your movie released is better than not getting it released at all. This is why Soderbergh did the movie with him. This was passed on all over town. So have it shelved or have it released and maybe make some money. You said ask the filmmakers. Look at New Line and Knock Around Guys. Sat on the shelf, but better a release than no release at all.
What the hell do you expect? You get in bed with the devil, expect to get burned. Eli Samaha and that scumbag Andrew Stevens did it for a decade (looks like Mr. Stevens may even see some jail time).
It’s not like the studio’s don’t rob you either, they just do it with a bigger smile on their face.

Had a meeting at Nu image/Millennium earlier this month. Everything about that company rubbed me the wrong way. Especially the asshole in the front office (you know who you are) that everyone mistakes for a receptionist. He kept screaming “we need a bigger sign!” For the record, the front desk is on the second floor (which is just stupid).
Follow up to the meeting and Nu Image/Millennium rubbing me the wrong way… the receptionist kept comically answering the phone “Nu Image/Millennium can you hold please?” over and over and over again. I kept thinking… “There’s no way this many people are calling these guys.” Turns outs they were probably owed money to.
Did a movie for him once, about 2 weeks into shooting I hadn’t been paid and I threatened to quit. A model/actress of his showed up at my hotel with an envelope full of cash at 1am. Weirdest expeirence I’ve ever had. Never saw a cent in backend points either. My lawyer laughed at me when I mentioned suing. Avi is classless. This article is not surprising.
Anybody who knows anything about the independent movie scene knows all about Avi and Nu Image. This is not news. As long as you recognize who and what they are, get your money up front and do your deal accordingly, you will be fine. Nu Image makes schlock, and has long been known as a place where careers go to die. But they make movies – a lot of movies – and have been helping keep many in our industry employed. Once Avi was asked if he had first read the script of a dud he produced, and he replied, “No. Why would I want to ruin the premiere?” Nu Image is not about filmmaking, it’s about the package, the deal, and the names they can put on the poster.
This story is about First Look, however, not Nu Image. Avi made a massive mistake when he bought First Look a few years ago, and now he has to pay for his mistake. It’s not like he made millions off of First Look and is now pocketing the money and screwing the filmmakers. First Look bled red ink. Avi lost millions on it. He has done what just about any businessman would do and has shut it down and transferred assets utilizing our country’s corporate bankruptcy laws. Don’t hate the player, hate the game. Unfortunately, producers of the movies distributed by First Look are the ones that will suffer.
The thing about this story that everybody seems to be missing is that IFTA is a worthless, irrelevant, spineless organization that has outlived its usefulness by 10 years. The chairman is Lloyd Kaufman, a nice guy, but a guy who has never produced a film budgeted over $1 million, and who’s only “success” was “Toxic Avenger” 25 years ago. The head of Troma is the face of our industry’s independent film trade organization? Nuff said. While I despise Avi’s business practices, it should be noted that he is one of the few people left at IFTA actually making theatrical movies. IFTA just can t afford to lose one of the few active theatrical companies they have left.
I don’t know these guys well, but i know the producers who work for them. you are right, avi is only in this business for the women. his girlfriend heidi was forced on ‘solitray man’ and steve soderbergh and paul schiff went apeshit when danny dimbort’s granddaughter got a credit. steve and paul later learned that the only reason for the graddaughter credit was because heidi was a producer. (heidi used to be an actress) this seems to be a pattern. hmmmm.
And his other girlfriends are forced on the directors to cast in the movies. ask koppleman & levien (solitary man), simon west (the mechanic) and patrick lussier (drive angry). they all had to hire his disgusting and talentless girlfriends.
heidi was also FORCED on the clive owen movie “Trust”. i know the situation well as i worked on the movie. she is clueless.

Good call. Though I never named names regarding his girlfriend. But forced, hardly, Avi takes care of his two girls along with the children he had with him. Ask the employees of Nuimage who gets bonuses ? Who gets perks? Both women have enjoyed free reign within the company. The reason for the Grand Daughters name added to the credits, was indeed for this reason. Both men in my opinion are children. If Avi wants to be taken seriously, keep the girls, but at a distance. Stay away from sales, stick to producing. First look was/is a HUGE mistake… Stick to what you know well, the International business, keep your personal and biz life separate. Women are Avi’s biggest issue, if he did not have these two women in his work life, things in business, would go much smoother. Wake up Avi, you are killing your partnership and business. You aren’t 20.
