As we told you back on March 10, it was unlikely that Charlie Sheen would ever get his day in court against Warner Bros and/or Chuck Lorre. This is even more true today. The latest development is that Lorre’s lawyer Howard Weitzman has succeeded in wrapping Lorre into Warner Bros’ arbitration over Sheen’s contract. Deadline previously reported that Weitzman was trying for this just hours after Charlie’s juicy lawsuit was filed against the studio and the executive producer of Two And A Half Men. That’s also when the Judicial Arbitration and Mediation Services accepted the Warner Bros vs Sheen dispute for arbitration. Now JAMS will include Chuck vs Charlie, too. The contract, like most in Hollywood, calls for private arbitration to settle all disputes, thus thwarting Team Charlie’s attempt to draw the studio and Lorre into a messy public court fight. Insiders tell us that pretty much the only way Team Charlie could face Lorre in court now would be if Sheen’s lawyer Marty Singer wins an injunction against JAMS, and that’s considered extremely unlikely. Right now, no such injunction has been filed.

It’s not always about the money – plus I’m sure he has plenty of money by now. It’s about takin’ it to the man – in this case Chuck Lorre and WB.
You give Sheen way too much credit. He was an overpaid actor making millions of dollars per year, he is “the man.” For that matter, this is totally about money and Sheen has probably “blown” through a chunk of his money on drugs and whores.
No kidding. Sheen is not as rich as everyone thinks. More money just equals more problems and expenses. Wasn’t it reported that he spent $500,000 on his Vegas night. He has five kids, two ex-wives and a lifestyle that they have all been accustomed too. And I am sure his “goddesses” don’t work very much anymore. Sheen was probably counting on winning this lawsuit, but it doesn’t appear he will get very much. I’m sure he will get a nice check, but nothing compared to the amount he would have gotten with two more seasons of “Two and a Half Men.”

This post does not make much sense. While I am not a CA attorney I am going to assume the JAMS process is the same everywhere. Has Sheen been compelled by the court to accept arbitration against Lorre or did Sheen agree to it which seems highly unlikely.
That fact that JAMS has “accepted” Lorre into arbitration is not dispositive at all if Sheen disputes that he is required to arbitrate against Lorre. The acceptance of Lorre by JAMS is administrative and not legal. Sheen’s lawsuit against Lorre does not magically disappear because JAMS accepts the arbitration claim.
The court would have to rule on that, dismiss the lawsuit and compel Sheen to arbitrate against Lorre.

Yes, what JAMS agrees to do has no legal bearing on the question of whether arbitration is required. Charlie’s lawsuit in court will go forward unless and until Lorre’s lawyers move to compel arbitration and win. Given the track record of California courts in upholding mandatory arbitration in employment cases – and given that Lorre isn’t a party to Charlie’s contract, I suspect Lorre isn’t going to win this round. WB may find itself in court, too.
Ultimately, this is all just to set up the value of the settlement. The case stays in court = bigger check for Charlie. the case goes to arbitration = smaller check for Charlie.
You are correct except that the court could also place the civil suit on hold until the JAMS arbitration is done, then decide whether to proceed if JAMS doesn’t resolve all the issues, or dimiss the suit if it does.
Don’t count out the Condor of Calabasas yet. He’s turning himself into a brand with the merchandise and live shows. #TEAMWINNING

WB/Lorre are well on their way, but must still file a motion to compel arbitration (instead of an answer, if they haven’t already) in the civil case and convince the judge to put it on hold pending the outcome of the JAMS arbitration. Even then there could be more procedural surprises, so try not to seem too surprised when they’re pulled out of a hat. Once I handled a matter with parallel JAMS and guild arbitrations arising from the same dispute–same facts and same law–it was like “Groundhog Day” before one arbitrator and then the other. Happily the result was the same since both arbitrators were experienced in the biz and knew what they were doing.
Thomas, if Lorre is not a party to the underlying agreement how does the acceptance by JAMS have any legal effect on Sheen at all. I am not a CA atty(Texas) so maybe I am missing something here.
I really do not understand, all of the ratings for the show speak themselves for it’s popularity. Charlie Sheen is living as if it was his character Charlie Harper. So lets all quite throwing those rocks when living in a glass house!!!!

Charlie sheen is the man! ( period) Chuck Lorre should be ashamed of himself and Charlie’s team should be able to take to court and let the people resolve this issue. Chuck started this, he should have never said ANYTHING about Charlie and his situation.
