Dish Network is starting to feel the heat for offering Starz as a free promotion to celebrate the satellite provider’s 30 years of operation — it turns out Starz and Walt Disney aren’t in the mood to party. Both have filed separate suits against Dish, which they are accusing of giving subscribers free access to the premium channel — which includes access to certain copyrighted Disney movies — in violation of existing deals. Disney argues in its suit, filed Monday in New York federal court, that Starz can only show its movies if the channel is acting like a premium service, and that Dish changed the dynamic of the arrangement by giving Starz away for free. Today, Starz joined in the fight in a Colorado district court, saying the promotion violated its contract with Dish. From the Starz filing: “On or around February 1, 2011, Dish began providing virtually all of its subscribers with free access to seven different STARZ channels and one ENCORE channel. In blatant violation of section 5(c) of the Dish Agreement, Dish told consumers that it was giving them these channels for “free.” Specifically, in a communication that, on information and belief, went to virtually all of Dish’s subscribers, Dish stated that “Starz premium movie channels have been added to your account, free for the next 12 months. … To get your free Starz, you don’t need to do a thing—no commitments, no requirements and the offer will be reflected on your monthly billing statement as ‘Starz – Free 12 mo.’ ”


Heaven forbid more people get to watch your network and eventually subscribe…
Sounds like a good deal for Starz, but their lawyers have simply seen an opportunity to sue. No good deed goes unpunished.
I’ll be sure not to continue with Starz after the free period, something I was considering doing, but between this and Netflix Instant I think it’s best I don’t give them anything.
Dish Network gave me the opportunity to see programming I never would have been able to see otherwise. I am fan of Joss Whedon and was very grateful to be able to see Spartacus: Gods of the Arena. I am a fan of Doctor Who and look forward to seeing Torchwood in the summer. I paid to see all three Toy Story movies in theaters which Starz recently showed as a trilogy and a gave fans a chance to relive the magic. Starz and Disney should be grateful for the extra exposure. I don’t approve of this legal action.
I have Dish Network and Netflix, the same movies / series are on both, the only thing that isn’t is new episodes of Camalot. So they can cut Starz anytime they want, with Netflix I watch when I want.
I agree! I was considering adding Starz to our Dish package once the free year ran out, but not anymore. You’d think they’d want to use this wonderful opportunity to get new viewers who otherwise never would’ve watched their channels. I know we never had any interest in getting Starz before this free year thing, and now I love all the movies & their new show Camelot.

being loyal? HEAVEN FORBID!! LOL!! I’m a proud Dish subscriber,
and also was considering picking up STARZ when the free period was
over. Now, I won’t. As far as Disney is concerned? LOL. Don’t
they have enough heat right now from the soap opera fans to deal
with? Maybe Disney/ABC should take a page from DISH and RESPECT
their viewers. Nah, it’s easier for them to sue. IDIOTS!!!!
But what is FREE to the customers, DISH is paying STARZ and DISNEY for, aren’t they?
If DISH is paying the per-subscriber-per-month-fee to the providers, what is the problem – STARZ and DISNEY are getting paid for EVERY subscriber who is getting it “free”. DISH is paying “The Premium”. I think the wording of FREE is the issue. What DISH should have said to the customers is “We’ll pay your STARZ/DISNEY package for a year”. AS well as making it an “opt in” rather than free to all.
It will be interesting to see what the Judge thinks, or if it goes to mediation.
I think Starz was drawn into the lawsuit because of their agreement with Disney. How popular would Starz be for Dish subscribers if they had to black out all Disney content for the 12 free months? Still, a ridiculous move on the part of Disney. Face, say goodbye to Nose.
The Disney Channel used to be a pay channel. I think maybe a satellite company began to throw it in in their basic package as incentive to sign up and eventually more cable companies did the same, even though Disney didn’t have commericals and was a pay channel. Eventually they became an ad supported channel.
So I guess Disney wants to differentiate their content from the stuff showing on their channel. The newer content first appearing on Starz, then eventually to the Disney Channel. And Starz wants to be branded as channels you want to pay for so while they may appreciate the business from Dish, they could be doing longterm damage to their brand as channels not worth paying for.
I still say they have no case if Dish is paying the subscription price that Starz is due. Next contract make it harder for Dish to do what they’re doing.
The fact is Starz gave away Starz content to Netflix for 30 million per year, when Dish is paying hundreds of millions for Starz. That makes Charlie Ergen not a happy customer, so he decides to give it away to his customers. Starz was actually ok with it till Disney cried about it. Disney is not happy with Starz agreement with Netflix either. It boils down to the fact that Dish if paying Starz big money, they better watch out or Dish will drop them like a hot potato.
why did dish raise their price on our cable bill when we were suposed to be getting stars for “free” ? $45.00 for basic chanels which vare mostly advetisments and reality shows are not worth it. very disapointedd customer
I love Dish for trying do something for their long term customers , not just the new sign ups. Disney has got to be the greediest company in the history of America. The mouse is a rat and I hope they lose this lawsuit.
