Disney lost its bid for a preliminary injunction against Dish Network today, with a New York District Court judge denying a motion that would have stopped the satellite company from offering a promotion for free access to Starz movie channels that include Disney films. Disney filed the request last month, saying the giveaway — to celebrate Dish’s 30th anniversary — limits the value of its movies and is copyright infringement. Starz also has filed suit against Dish in the matter.

Dish is paying Starz the agreed upon monthly licence fee for It’s channels as if EVERY Dish Subscriber were paying for it!
In other words – STARZ is making MORE MONEY than they would be paid just from the subscriber base! You got to give Dish credit to do this – it’s a nice way to say thank you to the subscribers, plus as I just mentioned – STARZ is making more money!
Does the language of Dish Contract say they can’t offer the channel bellow market value to subscribers or give it away free if they are still paying STARZ the agreed upon fee?
Are they worried that Dish or another provider might offer premium channels at,or below “cost” to subscribers as a “lost leader” to gain more subscribers?
It will be interesting to see what a judge says!
Is Disney and Starz upset because it is for 12 months because pretty much every cable/sat provider does promotions where it is a free weekend of the premiere channels every so often. Like Directv is making all the premium channels free next weekend thurs – sun. seems like this is just a money grab by Disney/Star because they are not getting subscription fees.

Dish is not doing this for every customer. We got a letter from them saying they were doing this as an appreciation for their long time customers. Since we were almost at the end of our contract, I think it was designed as an added inducement to try and keep customers by offering them a premium service for free. I, too, would think that Starz is getting whatever they have paid for, and Dish is the one who is biting the bullet now with hopes they will benefit down the road, probably by customers who stay with them, and might decide to keep the Starz service after they have to start paying for it.
The copyright infringement allegation is ridiculous. What, is Disney going to sue every time someone looks sideways at the cover of a Disney video in a store because they’re not getting paid for it? Sheesh.
