The Delaware court that is sorting out the Los Angeles Dodgers’ Chapter 11 filing has authorized the team to enter into a $150 million bankruptcy financing arrangement that will allow owner Frank McCourt to meet the Dodgers’ payroll obligations this week. The deal came together today as Major League Baseball dropped opposition to the financing after getting the Dodgers to agree to not auction off their broadcast TV rights for the next six months and seeing that a $4.5 million fee from the facility’s lender — JPMorgan Chase’s Highbridge Capital Management — be reduced to $250,000.
The TV rights are everything to McCourt now; he says that a deal in place with Fox Sports worth $3 billion over 17 years would put the team back on solid financial ground, but MLB commissioner Bud Selig would not approve the contract, saying too much of the upfront money would go to McCourt, not the franchise. A Dodgers lawyer told Bloomberg today that the team still has the right to propose a TV-rights auction while under court protection, so who knows what the league really gets out of that part of the agreement. One possibility is that Selig and the league will seize the Dodgers within that six-month time frame; baseball clearly believes the Dodgers and their TV rights are worth more on the open market if a new, more palatable owner (we’re talking to you, Mark Cuban) were to step up to the plate.


The Associated Press is reporting that MLB is looking to seize the team anyway. MLB’s constitution says that the league can take over the team if that team has filed chapter 11 bankruptcy.

Cuban was interested in the Cubs and never had a shot with MLB; he’s just a little too activist and disruptive for their tastes. There’s no way he gets an honest chance at the Dodgers, though he’d be a great choice. An involved owner who gives a damn about winning and about the fans.
Too bad Arte Moreno can’t own two franchises.
If Frank McDick really cared about the Dodgers he would have let them go a long time ago. But, the guy is a total scumbag who used the money for himself and his seven homes, employed his family who did nothing for the team, and he cut security which helped lead to the horrific beating of Brian Stow. All true baseball fans with cheer the day this prick is shown the door.

If you think Mark Cuban is a more palatable owner to Selig and the Old Boy network of MLB owners, you really shouldn’t be reporting on the story at all.

It will take a damn long time to figure out what the actual value of the Dodgers is with all the plundering and splitting up of assets.
Selig is reaping what he sowed allowing someone with no tangible assets other than a bit of real estate to take over the team. I remember years ago hearing an Aussie call in to an LA sports talk station right after Rupert bought the Dodgers.
He was prophetic in saying “Mate, you should see what he did to our Aussie Rules Football League. Just wait until you see what he does to MLB.”
Years later to look at the Texas Rangers and the Dodgers, he was damn on point.
If you read around the web McCourt has split the teams interests into separate companies. The parking lot is separate interest from the team as is the stadium. This all has to be figured out by MLB as its the reason why so much cash found it’s way out of the org and into the McCourt family.
MLB will take over the franchise to avoid an outcome where someone who MLB does not like buys the franchise. Similar action occurred in the Phoenix Coyotes bankruptcy.
An MLB takeover will avert problems with an inside sale, which case law has been specific about but has been ignored in the GM, Chrysler, and Coyotes bankruptcies.
That said, I am surprised the owners of the BoSox, the Yankees, the Royals, the Astros, Marlins, etc. want to pay ManRam’s deferred salary. Actually, the thought of those lazy fucks in Pittsburgh having to part with their profits to pay the Dodgers’ debts makes me laugh.
If Mr. Cuban buys any team, my hope is that he buys his hometown Pirates and gives people of the best flyover state in the country something to cheer about.
