
Days ago, Summit Entertainment took the unusual step of announcing it had identified and was filing criminal charges against a woman in Argentina identified as the “principal hacker who earlier this year stole unreleased materials from The Twilight Saga: Breaking Dawn which were then distributed on the internet.” Now, Summit is responding to allegations made by Daiana Santia after she held her own press conference this morning to deny she was the master hacker depicted by Summit and the filmmaking team behind Twilight Saga. In her press conference, Santia reportedly said she only saw Twilight Saga images while combing the web and that she doesn’t have the computer savvy to distribute them to anyone. She also claimed that she and her family were harassed by Summit in an attempt to go through her hard drive and that Santia is considering legal action of her own for harassment and defamation of character. She is also insisting that Summit’s claims be handled in Argentina and not in the U.S.
Summit swiftly responded to her charges in a memo just sent to Deadline:
- First and most important this is NOT about greed or the Studio wanting to bully a woman from a small town in Argentina – rather, it is about stolen material that is private and sensitive which was obtained by illegally accessing private/secure servers as well as personal email accounts. Ms. Santia’s actions came to light after these materials began appearing on the internet towards the end of March, 2011. Since Summit learned of Ms. Santia’s involvement in late May 2011, Summit has been in contact with Ms. Santia and her representatives with no resolution or further good faith efforts on their part, thus the only alternative left was to pursue legal action to ascertain that Ms. Santia no longer holds the images and video in any shape or form. Prior to said action the studio clearly communicated to Ms. Santia and her representatives that a press release would be distributed naming the actions being taken as well as naming her specifically.
- Summit’s first meeting with the Santia family occurred on May 31, 2011 at which point the studio was told they would fully cooperate. A subsequent meeting took place on June 8, 2011 with Ms. Santia and her lawyer at which time Ms. Santia confessed to the intrusions. It is also important to note that Ms.Santia is 24 years of age. The family was contacted as a group as the IP address used was registered under a family name.
- Specifically on June 8, 2011 Ms. Santia confessed in the presence of her attorney that she accessed servers and email accounts via a systematic attack — stealing photographs, unfinished images and video footage over several months. Additionally there is indisputable evidence linking her directly to IP addresses that were used in the unauthorized access. Her actions appear to be premeditated and not done on a whim, but rather using technology and tactics that require thought as well as time and skill. Because Ms. Santia decided that she does not want to cooperate, Summit has been unable to settle this matter privately with Ms. Santia and her representatives in Argentina.
- Ms. Santia claims to have deleted the stolen materials off her lap top as well as her family’s desktop computer, however both common sense and historically similar cases have proven that a defendant’s word cannot be taken as final. Additionally, Summit must confirm the extent to which Ms. Santia shared the materials with others.
- When first approached by Summit, Ms. Santia’s representatives indicated their willingness to permit Summit to review the computers. Based on this communication, Summit flew technical experts to Posadas, only to have Ms. Santia renege on their offer after the arrival of these experts. To this day, Ms. Santia has refused to cooperate in giving Summit access to these two computers to verify for itself that the images and footage have in fact been deleted, and to confirm the extent to which files were shared. We do not feel this is an unreasonable request but rather a prudent move to protect the IP and the studio. Additionally the studio has made an offer to have representatives chosen by Ms. Santia present when the computers are searched in order to protect the Ms. Santia’s privacy relating to anything else that is not related to this particular situation as they are of no interest to the studio.
- Had Ms. Santia cooperated Summit and its representatives would have worked with her to reach a compromise that would not necessarily involve legal action in Argentina and the United States.


Property is property and if it’s not protected then it becomes diminished in value.
Is this going to affect Twilight’s Box Office performance?
I say B.S. One one hand, we have China stealing state and corporate secrets. On the other, we have this lady who just wanted pics of Robert Pattinson getting his vampire on. China has flagrantly abused privacy and yet this is the person of interest in the world of computer hacking? It’s an intimidation game and nothing more. It’s not not like she sold anything or tried to defame the product they are selling.
Really? THAT’S your defense? There are worse things happening, so you shouldn’t try and punish ANYONE committing less than that? I’ve never seen a Twilight movie, but if the woman actually hacked into a private sever and stole files. Whether or not she made money off of it is not really the point, is it? Do I have a right to hack into your computer and read your private emails and documents if I don’t make money off it or try and defame you? Or can I break into your house if I don’t actually steal anything? It doesn’t take a lot of thought to see the problem with your defense.
i think the bigger question here is: “why does summit have such poor security that a girl–a girl in a developing country could access their servers and e-mail accounts?”
i would think that logic would dictate that summit would like to hide this whole thing. i don’t know the particulars about argentina’s laws. but all i can say is diego maradona still owes millions in back taxes to italy and this claim is at least 15 years old.
Summit is saying this woman had the wherewithal to hack into protected servers and email accounts to steal the material. She’s countering that she isn’t even savvy enough to know how to share the stuff she “found” by trolling the net.
Should be interesting to see how this plays out – either she’s lying, or Summit is pointing the finger at the wrong person.
So why does she hesitate to show her hard drive?
Why should she have to show them her hard drive? The theft occurred in March, according to Summit. They’re claiming it wasn’t until June when they made a connection to this woman. By then, presumably any number of people would have the material on their own computers. Summit has to prove their case from the other end – that the server hack can be traced to her IP.
Way to go Summit. You made $300 million dollars in US only for the last Twilight movie. And with all those Twiyards will probably make another $300 with next one. And this what you want to do out of you creed? To bully some poor woman? For what?
What kind of damage she did? You lost money because of her actions? Well CBS lost millions of money because Charlie Sheen got drunk, high and stopped showing up at work. He violated his contract. Many people lost bug money because of him. And? Why isn’t he in jail? Because he has money for attorney.

Ms. Santia is lying, but what do you expect from someone who comes from a country that claims the territory of another and cannot even call the Falkland Islands by their proper name?

I have visited Argentina and met a great bunch of people. It still doesn’t change the fact a fascist military junta, responsible for the ‘disappearance’ of thousands of its citizens, invaded the sovereign territory of another nation, Great Britain, in an attempt to impose its will on the local population, none of whom welcomed this brute force intrusion in their lives. Deciding you want something that is not at present legally yours does not make it right, even if you call it by another name. This is the same logic Ms. Santia applied when she helped herself to Summit Entertainment’s intellectual property.

I can’t imagine Summit entering this situation without proof. And having lived around lot of countries where intellectual property rights and piracy is of little concern to users, I can certainly believe that somebody in Argentina went ahead and blissfully obtained copyrighted material and put them online.
If you want to punish a poor Argentinian woman for Summit not putting an adequate lock on their door, be my guest. It does seem silly, though. She has no money and Summit can only look like a bully. Their best offense would be a better defense. It would cost them substantially less in both reputation and capital. Notice that I respectfully answered you and didn’t attempt to berate you. I saw the images myself…no they werent finished but summit wanted everything to come out when the movie does. the twilight fanbase has far from dwindled…i run a twilight fan sight and i am getting more and more ppl every day. the images that she stole are from the most anticipated film of the twilight saga so far…ppl are going nuts waiting for this movie to come out..
I’m amazed at the excuses people are making for this woman, who isn’t poor by the way. She has a reputation as not being so nice among the fanbase and has what’s coming to her. My guess is someone hacked a producer’s email or was given the password to this server which housed the film dailies and passed on this password to Daiana not expecting her to share the contents with the rest of the world. Daiana is NOT a Twilight fan, that is certain. She blatantly stole these videos and images. Also the people who posted them on their Tumblrs and blogs and tweeted them are also guilty of distribution, but probably won’t be prosecuted. Summit wants the big fish. If she had been given the keys to a bank, robbed said bank and handed out stacks of money to random strangers, is that ok?? NO. It’s still stolen goods. Copyright law is a LAW. What is wrong with people??? We get to choose which laws should be enforced?? That server wasn’t owned by Summit, just like the server that housed the Eclipse pictures that were leaked last year. Another company’s in charge of securing that site, but someone got a hold of the password and shared it with others. Enough with the pity party. Daiana had a chance to cooperate. She’s probably protecting someone and will pay the price.
