I don’t know whether Comcast has a strong case in its suit yesterday charging that DirecTV is misleading consumers by advertising “free” access to its NFL Sunday Ticket service. But the filing at the U.S. District Court in Chicago shows that the No. 1 cable company sure feels passionately about the matter. “This is a false advertising case against a serial false advertiser,” the complaint begins. DirecTV isn’t offering the football programming for free, Comcast says: ”Only in a maze of dense disclaimers and sub-disclaimers, DIRECTV discloses that the offer
(i) applies only to new customers, (ii) requires a two-year commitment, (iii) requires enrollment in a premium level of service, (iv) applies only to 2011, and (v) entails automatic renewal in 2012 at ‘special’ renewal rates.” Comcast wants the court to stop DirecTV’s ad campaign: “Given its history of relentless false advertising, DIRECTV likely will attempt to stall until the NFL season is well underway, and consumers have been duly misled, before withdrawing its current campaign. Unless the Court takes immediate action, DIRECTV will be emboldened with the belief that it has the right to lie with impunity and avoid liability for its deceptions.”
Comcast says the DirecTV ads violate federal laws prohibiting false advertising, Illinois’ Consumer Fraud and Deceptive Practices Act, the state’s Uniform Deceptive Trade Practices Act, and common law barring unfair competition. The cable company wants DirecTV to retract the ads — and pay Comcast “all profits wrongfully derived” as well as triple the cost of damages, and a punitive fine to go to a consumer protection agency or advocacy group.

Caveat Emptor.
Though I admit I had to do a Tivo rewind when I heard the ad’s FREE SUNDAY TICKET copy. Too bad I’m already a subscriber.

Wow — I took advantage of DirecTV’s offer last year, and I was well aware of all the stipulations that Comcast thinks make for “false advertising.” Their lawsuit is bullshit.
How is it false advertising if the details are listed in the disclaimers and told to the customers prior to signing them up?
Not only did Direct TV mislead people with this promotion…Direct TV has offended many existing customers who pay far greater monthly fees.
For the first time in 15 years, I have started to shred my Direct TV monthly billing.
Direct TV is losing revenue from existing customers, which will far exceed the revenue generated from this not well thought out and/or ‘possibly’ illegal promotion.
The blindness is from their short term greed, and this does not bode well in the long term.
Direct TV is losing me as a customer after 15 years. I have 4 boxes with them and one of which does broke after 3 yrs, so they sent me a new one. Be very careful because they have a tactic to charge you for service calls: First they have a department called Claims department, which needs to call you back within 2 hours after speaking with Direct TV directly (ironic). My “new’ box does not work and the other three work that I have work just fine. Direct TV guy said he contacted the Claims dept and told them about my several problems (he added a few problems that it might be which I know to be false) and it requires a service call which costs 49.99. I corrected him for the 5th time and said: I DO NOT HAVE ANY PROBLEMS WITH THE DISH OR MY OTHER THREE BOXES, I JUST HAVE ONE PROBLEM AND THAT IS WITH THE NEW BOX YOU JUST SENT ME, AFTER BEING A CUSTOMER FOR 15 YRS YOU REALLY WANT TO CHARGE ME 50 bucks???. After getting really upset he finally waived the 49.99 because I’ve been a loyal customer… but it wasn’t unitl I was very upset that this happened. I can tell this is in their scipt writing for the people at Direct TV that take your call, so be VERY careful! THEY TRY TO CHARGE YOU FOR SOMETHING!!!!!! even if it’s their fault!!!!! good luck…
DirectTV intentionally commits a deceptive practice with NFL Sunday Ticket. In 2011, they automatically re-subscribed me and billed my account after I had stopped NFL Sunday Ticket in 2010. In our consolidated bill, we didn’t discover for two months. Then they said it “couldn’t be stopped” for the whole season. They suggested inviting friends over to our house and charge them to recoup. What an insult. The call service supervisor was completely arrogant and aggressive toward my wife, who ended the call in tears.
File with the FCC. File with BBB. File with your State Attorney General. Sign me up for class action?
Euh… comcast wake up that is how ALL products are advertised. Look at a car commercial, the fine print is non readable but Ford isnt suing another car company for it !!!
Love my DIRECTV. Sucks I’m already a subscriber so I can’t get the NFL package for “free,” but what do you expect from a company trying to attract new customers? I can understand that. Comcast is just afraid because its sports packaging sucks in comparison.
Couldn’t agree more. DirecTV has become completely “new customer” focused and is alienating long time customers by offering them nothing for their loyalty. Their customer service has gone down to tubes in the last year. I’d been a happy customer for about 10 years (with the highest package), now I am considering canceling service it has gotten so bad.
Without SundayTicket Directv is out of business. I suffer all year with it just for football

I just signed up for the new service and at no point did I feel like I was being misled, people should just do their homework before signing up for anything. The add never says free NFL ticket for life and clearly states it is for the 2011 season. Yes, there is an automatic renewal for 2012 at a “discount” but not if you cancel before the season begins. The 2 year agreement has always been a catch. I completely agree that this offer is grossly unfair to existing subscribers who have been with DTV for years. I know someone who called and complained and they received a hefty discount for the ticket for this year. Comcast should be upset, but only because this is a hell of a deal.
I’m also a long time Directv customer. And e called about the NFL Ticket. I’m asking you if you could tell me a bit more about your friend that called and complained. I’m looking for a value discount they received for maybe a specific customers service rep they may have talked to.

Been a DTV subscriber since the 90s and eventually, ironically, three years ago got a job at one of the phone centers that take orders for service. They are very strict about making sure each signup knows exactly what they’re getting. There are NO surprises, no bait & switch: new customers only (of course) 2 years (always been)& you can drop NFL for the next season. The lawsuit is completely frivolous. And they have never given away the NFL ticket with Choice Extra before (middle package); it was always with the Premier level (highest package)
I know, it sucks for long-time subscribers when you see these annual deals where DTV gives all this free stuff away, but that’s business, I guess. I still think their rates are good, relative to service & quality. I’m 54, I have a good theater set-up at home, so a full Premier package with 300 channels works for me. When times are tough, I have all the entertaiment I need at home and friends come to my house to watch stuff. (BTW: $300 or so per season is fine! Have you been to an NFL game in the past few years? That’s the cost of two with good seats & food for one game!)

I’ve been a DirecTV subscriber for 5 years. Ever since I accepted their offer for free premium channels and free NFL Ticket in September 2011, my monthly bill has never been correct. This past month, they erroneously charged me for BOTH the NFL and premium channels… my bill was over 200 bucks when it should have been about 90. After struggling with them over the phone, they said it was a glitch and I should see a credit on my next bills… but they won’t refund my credit card. I’m hard-pressed to believe this is a “glitch”… seems like they know exactly what they’re doing.
