Comcast failed today to block DirecTV from advertising that it offers NFL Sunday Ticket at “no extra charge.” A U.S. District Court judge in Chicago denied the cable giant’s request for a temporary restraining order.
Comcast asked for one charging that DirecTV’s campaign is based on “an outright lie. As none of the ads disclose, the offer is not for free NFL Sunday Ticket service — the offer requires a two-year contract with hefty termination fees for early cancellation, with the NFL Sunday Ticket service automatically renewing in the second year at full price. DirecTV has gone to great lengths to conceal this fact from consumers.” DirecTV countered that the ads are accurate and straightforward. “We’re pleased the judge recognized Comcast’s veiled attempt to limit our ability to compete in the marketplace and denied the TRO,” says Jon Gieselman, DirecTV’s SVP Marketing and Direct Sales. “We’re happy to go head-to-head with Comcast any day on whose service is superior, so we look forward to competing in the marketplace rather than the courtroom.”

i actually remember seeing a commercial about this just the other day and the whole ‘NFL Sunday Ticket at no extra cost’ certainly caught my eye.
my first thought, of course, was ‘that’s a load of horse shit, can they actually get away with airing such a bold-faced lie?’
i guess i got my answer. capitalism > consumer interest. (what a shock, right?)
How is this plan any different than all the cell phone plans that promise you this or that but require a 2 year service plan? Or any other promise made by a retailer? If it sounds too good to be true, then it probably is.
DirecTV’s ads are not a bold face lie. You will get the free Sunday Ticket. They just don’t specifically tell you how. Omissions are not lies. They’re just immoral. But, I’m told, that’s how the world works.
there’s a difference between running a commercial for a service “at no extra charge” or “free” with an asterisk followed by fine print at the bottom of the screen explaining the details (even if it is impossible to read) and an add that runs the same commercial with nothing but “at no extra charge”.
one is an “omission”, the other is a “bold face lie”. now, i can appreciate this fantasy world you live in where they’re one and the same but yea…no, they aren’t.
Stuart says: “Omissions are not lies.”
Have you never heard the term ‘lying by omission’? If that’s your true attitude I sure wouldn’t want to do business with you… and since I’m a lawyer, you SURE wouldn’t want to try that omission trick with me.
I just got Directv and NFL Ticket is free for one year when a new customer signs up for tge service and when the season is over you just call and tell them you don’t want it renewed for the second year. Pretty simple to me
DirecTV is very InDirect with their information. They did the same thing with their regular programming- offering a good deal for the first year and locking you into a two year contract without telling you the rate will almost double for the second year. Very misleading! and no On Demand…WTF!
So when is comcast’s monopoly on NFL games over with? That is the magic date when we can all order NFL games at will/with competition?
Not much good news emanating from Comcast/NBCU. Show cancellations and now this bit of sour grapes. Sounds like they’re just bat shit crazy over there at 30 Rock under their new overlords.
As for me, I’ll be watching something else other than any NBCU-owned channel – and doing it on DirecTV.
Directv has ondemand.
Waaahhh!
“At no extra charge” means just that. It means that there IS a charge (for standard service), but there is not going to be an extra charge for Sunday Ticket. Sunday Ticket renews every year for every customer who subscribes to it, not just the new customers opting to take advantage of this deal. If you don’t want to pay for the following year (of Sunday Ticket), you just cancel it during the off-season. If you do this, you’re only paying for your TV service and you received the 2011 NFL Sunday Ticket season “at no extra charge”. Oh my, someone call a lawyer, you got what you asked for.
As for the guy who said he was locked into a 2-year deal and the price went up the second year… you knew that before you willingly agreed to that 2 year contract. If you don’t like the price at the end of the 1st year, you are free to reduce or downgrade your service, you just can’t cancel it. That would be a breach of contract. If you don’t like the fact that you won’t get the lower price for the duration of the contract, DON’T ACCEPT THE CONTRACT AND CHOOSE ANOTHER PROVIDER.
Yes, I’m upset that I see ads for new customers receiving NFL Sunday Ticket “at no extra charge” since I have been a paying Sunday Ticket subscriber for 4 years but… I’m not upset enough to cancel my service so I’ll just live with it. I accepted a long time ago that loyalty to a business no longer means you are entitled to discounts. It in fact means the exact opposite, it means you get your service fees increased so they can attract new customers with lower prices.
BTW… !@#$ Comcast!
Directv sucks! Your ads suck and your “no extra charge” (with the help of Deion Sanders as a fairy?!?) sucks. You call them and mention the ad and they play dumb. The lady said “Deion who?” Directv operator “We are so happy the lockout is over! I’m a huge football fan and we’re glad to have it back. We can offer it to you for $4000.00 until January”. Me ” click”. Lies! Wasted my time and now more than ever I want to cancel. Congratualtions I’m a moron for hoping you would treat all your customers new and old equal based on you lie…I mean ad. The ad is VERY misleading and it lets you think its free for this season. It’s not. They offer you a payment plan and its all just a ploy to get you on the phone. The ad ends with “just call 1800-Directv”. Why the hell can’t you just purchase games for one team? I just want to see my team not just the Seahawks because I live in the Northwest. It’s 2011 right? We should be able as a consumer to pick and choose what we want. They would make a heck of a lot more money if they were willing to give people what they want instead of charging the few people who can afford the Sunday ticket an arm and a leg. Sorry poor people like football too.
I know Grammar Police it has mistakes.
