The 3rd U.S. Court of Appeals has ruled for a second time that the FCC didn’t have the right to fine CBS Corp for airing Janet Jackson’s famed wardrobe malfunction during the Super Bowl halftime show in 2004. The commission fined the network $550,000 for “fleeting” indecency after it showed Jackson’s bared breast for less than a second as part of her outfit was torn away by co-performer Justin Timberlake during the performance, which was seen by 89.9 million viewers. CBS appealed the fine, and the appeals court voided it in 2008. The case went to the Supreme Court, which vacated the judgment and sent it back to the appeals court. Today’s ruling was made on the same grounds as the first one: that the FCC didn’t give broadcasters fair warning about a shift in indecency enforcement. ”While we are disappointed by the court of appeals decision, we note that the court overturned the FCC’s 2006 forfeiture order on narrow procedural grounds,” the FCC said in a statement. “In the meantime, the FCC will continue to use all of the authority at its disposal to ensure that the nation’s broadcasters fulfill the public interest responsibilities that accompany their use of the public airwaves.”


And the FCC continues to make fools of themselves. What a waste of energy on their part.
Whether you’re a Democrat or a Republican, I believe most can agree that the FCC is just a waste of government resources.
They have no problem with all the violence on TV, but one bare breast, OMG, don’t let that taint the youth.
Can you believe this is what we spend our tax dollars on? What a complete and utter waste of resources.
What “shift in indecency enforcement” do they need to inform broadcasters about? It’s common knowledge that you can’t show bare breasts on television and that doing so will result in a fine. Howard Stern was repeatedly flogged by the FCC and no court ever came to his rescue. Is there any corporation that doesn’t have control our government?
Thanks for reminding me again why I can’t stand Timberlake. He’s the one who exposed her breast, yet took none of the flack for it. Douche.
dude EXACTLY! Timberlake immediately went into hiding and Janet took all the heat for this. Timberlake’s career took off and Janet’s went in the toilet. Remember all the black musicians that said they’d boycott Timberlake b/c he didn’t own up to it (and then they all wound up doing collaborations w/ him about 6 months later)?

The irony here is that CBS probably spent much more that the $550,000 in legal fees fighting this dubious fine.
Yes, the FCC was out of line with this, unless they can prove conclusively that CBS knew in advance this was going to happen and was a willing participant in a questionable publicity stunt. It is highly doubtful CBS would have been this creative!
But CBS needed to fight this to not allow FCC to set a precedent. I seem to fecall Bono dropping an f-bomb at an awards show, and that network (NBC?) got a pass. And in the end, Americans just need to grow up regarding these things. Travel anywhere else on the planet, and local (often government-sponsored), channels regularly broadcast much more titillating material.
The FCC doesn’t get it. Unless they can show it was done on purpose, they never had a case and just thought this was a great way to make some cash, meanwhile they’ve spent more fighting to get the money that what they would have made from it.
The FCC needs to be held accountable to more than the president. They should be elected individuals, not appointed, so when stupid crap like this happens, the public they say they’re protecting can have an effect on whether this is a good course of action or not.

7 years ago and less than a second, FCC. Less than a second. What a colossal waste of time and tax dollars. What a joke. The US would be the laughing stock of the western world if every other nation hadn’t moved on & forgotten about this whole thing oh…about 7 years ago.
