
WELLINGTON, New Zealand (December 4, 2011) – WingNut Films proudly announced today the completion of WEST OF MEMPHIS – a documentary film chronicling the untold story behind one of the most infamous miscarriages of justice in American history; the story of an extraordinary and desperate fight to stop the State of Arkansas from killing an innocent man.
The film has been produced by first-time filmmakers Damien Echols and Lorri Davis, in collaboration with the Academy Award-winning team of Peter Jackson and Fran Walsh. Jackson and Walsh became involved in 2005, when they helped to re-invigorate the then stagnant case by funding a new investigation. The film has been written and directed by Academy Award-nominated filmmaker, Amy Berg (Deliver Us From Evil).
Starting with a searing examination of the police investigation into the 1993 murders of three eight-year-old boys – Christopher Byers, Steven Branch and Michael Moore in the small town of West Memphis, Arkansas, the film goes on to reveal hitherto unknown evidence surrounding the arrest and conviction of the other three victims of this shocking crime – Damien Echols, Jason Baldwin and Jessie Misskelley Jr.; all three of whom were teenagers at the time of their arrests and all three of whom spent 18 years and 17 days in prison for crimes they did not commit.
How the documentary came in to being is in itself a key part of the story of Damien Echols’ fight to save his own life; it reveals how close he and his wife Lorri Davis, along with his legal team, friends and supporters, came to losing that battle.
As Echols has stated: “September 2008 was one of my lowest points. Judge David Burnett had refused to hear any new evidence – this included new DNA testing… as if proof of our innocence was somehow irrelevant. I thought we had come to the end of the line, that there was nowhere else to go. It was at this point that Fran and Peter suggested that maybe there was another way of fighting back… that if the evidence was not going to be allowed to be heard in a court of law, it would be heard in another forum. That was when they said to me and Lorri, ‘We should make a film’.”
WEST OF MEMPHIS reveals the exhaustive research that uncovered startling new findings pointing to the innocence of Echols, Baldwin and Misskelley Jr. and includes new forensic evidence that points to other suspects that the West Memphis police chose to overlook. It was this new evidence as highlighted in the documentary that ultimately prompted the Arkansas Supreme Court to overturn previous denials of appeals and allowed for a new evidentiary hearing to proceed.
Faced with the very real prospect of a new trial being granted and in order to avoid potentially large compensation claims for wrongful imprisonment, the State of Arkansas struck a deal with the West Memphis Three, as Echols, Baldwin and Misskelley Jr. had come to be known, whereby the men agreed to enter an Alford plea; an unusual and rarely used legal maneuver through which the defendant is able to assert their innocence whilst accepting it is in their best interest to allow a guilty plea to be entered against them, in exchange for their freedom. The film follows these events and examines how the State Prosecutor’s declaration that the case is now closed, leaves three innocent men convicted of a crime they did not commit and a triple child murderer still at large.
Director Berg says, “This film represents the trial these men didn’t have. With the support of Damien and Lorri, along with unprecedented access to those closest to the case, we were able to make a film that shows the inner workings of the defense – the investigation, research, and appeals process, in a way that has never been shown before. This film began as a study about innocence; but I feel it goes beyond that now – it asks the question, what value do we, as a society, place on the truth?”
Says Jackson, “Seven years ago, Fran and I began this journey with Damien and Lorri, having no idea where it would lead. We now realise, that journey is not over, that even though these men have been released from prison – they are not free. Our hope is that continuing evidence testing and further investigation will lead to the unmasking of the killer of these children and that one day Damien, Jason and Jessie will be exonerated.”
In addition to never before seen footage about the case and the trial, WEST OF MEMPHIS includes interviews with Echols, Davis, Baldwin, Misskelley Jr. and Jackson as well as interviews with friends and families of the victims, defense lawyers, state prosecutors, local law enforcement, judges, forensic experts, journalists, surprise witnesses and prominent supporters including Eddie Vedder, Henry Rollins and Natalie Maines.
Original music for the film has been written by acclaimed songwriters and composers Nick Cave and Warren Ellis.
The film has been Executive Produced by Ken Kamins who will be leading discussions with potential distributors.




Ironic that Nikki just commented on the distinction between reviewers and the Hollywood publicity machine. One thing the press release for West of Memphis doesn’t tell you is that the Alford plea is also an admission that the prosecution had enough evidence to obtain a guilty verdict in a jury trial, and the standard for that is “beyond a reasonable doubt.”
At the same press conference where the state released the three men, Scott Ellington admitted he would lose if they had a new trial. AND that the agreement was a fiscal one to avoid lawsuits. The state did not expect to win any new trial hence agreement to the Alford plea, where the three men maintained their innocence.
Damien Echols, Jason Baldwin and Jessie Misskelley are free because they are innocent.
Am I missing something here? Weren’t there three “Paradise Lost” documentaries on the West Memphis 3?
With all the issues we, as a collected people, face every day, why has this become such a cause célèbre? I understand what happened – and implications of what happened going unnoticed – but it’s a little off-putting how crowded this band wagon has become. I’d love to see more public figures do good with their status for MORE causes.

Um, not to take anything away from these filmmakers, but Joe Berlinger and Bruce Sinofsky have been on the WM3′s side since 1996′s “Paradise Lost” (as DHD has more than noted).
Many people believe the WM3 were guilty as charged. They were found guilty by a unanimous jury the first time. They plead guilty instead of waiting for a trial the second time.
All of this is from court records or articles.
Misskelley confessed three separate times, once with his lawyer present. Misskelley also told two other people about the crime before he was arrested. Baldwin told someone else he committed the crimes.
Echols was seen in muddy clothes near the crime scene. Echols is reported to have either told or bragged about the crime to four people before he was arrested. Echols also had a history of psychiatric treatment.
His reported actions included brutally killing a dog, starting fires at his school, threatening to kill his teachers and parents and stating he liked to drink blood. He talked about getting his girlfriend pregnant, then using the baby as a human sacrifice. He claimed to be possessed by a spirit and to converse with demons. (from exhibit 500 court documents)

If Damien ever slips up on the dosage of those mind-numbing anti-psychotics he was on in prison, there’ll be blood on these people’s hands. But I’m sure Natalie Maines, Johnny Depp, et al won’t be holding press conferences saying “oops!”
Do you just copy and paste the same outdated incorrect information on every article about the WM3? None of the things you listed are true and the confessions were recanted (never mind they never matched up to any evidence anyway). These post is a really good peek into the ignorant hysteria and rumor panic that got the three men convicted in the first place, tho.

Echols brutally beat a dog to death and pulled out its innards. Misskelley didn’t confess just once, but THREE times! Once with his lawyer begging him not to.

I think you’ve deluded yourself into believing the WM3 are innocent because you’ve devoted so much time to their cause. Think of the 3 boys that were killed!!!
@Kathy B What exactly about West Memphis Three Information’s comment is ‘outdated’ or ‘incorrect?’ Misskelley did confess to police three separate times–once with his lawyer begging him not to. Echols did brag about killing the three boys, and even said so in an interview. And he did torture, kill and mutilate that dog. Remember, it was Badwin’s own cousin that said that, and as far as I know he’s never changed his story. I think it’s irresponsible and even shameful to claim those facts aren’t true.
What about those supposed “witnesses for the prosecution” who admit freely, that they gave false witness against these three innocent men, at the actual TIME of the FIRST court proceeding? They are on record, you know, as knowingly lying in court about this, because of the hysteria surrounding this case, and because they maybe? wanted their 15 minutes of “infamy” too.
Wesy Memphis Three Info.: THIS IS EXACTLY the “temperment of the climate”, and it’s aftermath, of what occured to those three innocent, and sweet young boys, that brought about the WM3′s sentences. I believe wholly, that you are afraid of the truth actually getting out, about West Memphis back then, and now, and how the Alford Plea agreement is being used as a “blanket” to cover up for one of the most heinous misscarriages of Justice that has occured in Modern American Jusiprudence, period. Why are you so afraid for it to come out?

How could you write this story and not include the fact that this film has been made already – and more than once? Sad. I guess anything that happened more than ten years ago is so ancient it doesn’t bear mention. Maybe it’s time to write a script called E.T.
Surely the more movies and doco,s made that inform us and get us all closer to the truth is a good thing.
As for being out of date or whipping a dead horse,it is easy to see that a lot of opinion and facts have been fed by mis truths ,well long may they keep making films like these if it takes us closer to finding the actual killer/ killers.
It should never be out of date to have justice served upon the guilty person of three innocent lives. I know as a parent I would be wanting the killer/s caught.
Look forward emensly to this film if only to clear up a lot of misconceptions . I think most would agree that a major load of rumor has become fact over the years. I read things that these boys were supposed to have said or done only to find it was rumor that was published as fact. Yet 10 years later the same claims are being made ,not because of any fact,only because people read it 10 years back in a paper or the web research and get on forums like this and sprout claims that have been proven as fiction ,like they were set in stone hard evidence fact.
I think it is great that a renowned film maker has bought into this and has uncovered things that will eventually help lead someone to finding the scum that perpetrated this most disgusting crime.
I guess people will see only what they want to see ,but boy ,would I hate to have these people as role models in my life.
More movies and docs that inform us and get us all closer to the truth is a good thing–if all the facts were presented, not just ones that support the WM3 cause. The Paradise Lost films pretty much amount to propaganda. Shame on the filmmakers for not telling the whole story.
