Economist and writer and humorist and actor Ben Stein has filed suit against Kyocera Corp and advertising agency Seiter & Miller alleging that an agreement for him to appear in TV commercials was illegally breached because of his personal and political beliefs about global warming. Stein’s memorable jacket-and-tie deadpan persona has figured in numerous TV commercials and appearances. Not to mention his iconic turn in the movie Ferris Bueller’s Day Off. According to Stein’s suit, Grace Jao of Seiter & Miller in December 2010 contacted his agent Marcia Hurwitz of Innovative Artists about appearing in commercials for Kyocera printer products and about speaking at a company function. Over the course of about five weeks, the suit claims, the parties reached an agreement on all significant deal points including payment of Stein’s fee of $300,000 for shooting the commercials and for the speaking engagement. The circumstances led Hurwitz to believe the deal was done, the suit says, and Stein planned accordingly.
Early in February 2011 Jao contacted Hurwitz, the suit says, to inform the agent that questions had been raised over Stein’s beliefs about global warming and the environment and whether they were “sufficiently conventional and politically correct for Kyocera,” according to language in the suit. Hurwitz told Jao that as far as she was concerned the deal was done, the suit said, and Stein’s political and scientific views were not part of his contract for extolling the company’s printers. Stein told Hurwitz to inform the defendants that he was extremely concerned with environmental issues but he was no means certain that global warming was manmade. He also told her to inform the defendants that it was a matter of his religious beliefs that God and not man controlled the weather.
On February 16, 2011, Livingston Miller, president of the ad agency, informed Hurwitz via email that the agency had decided to “withdraw its offer” even though negotiations had resulted in an acceptance of the offer and other stipulations. The reason? According to the suit, because of “Ben’s official positions on various policy issues that appear on the web of which we have only lately become aware.” Kyocera and the agency Seiter & Miller then hired a Ben Stein lookalike, the suit alleges, and dressed him with a tie, sport jacket and glasses and brazenly misappropriated Stein’s public persona for commercials — thereby intentionally inflicting emotional distress on Stein.
In addition to breach of contract and breach of good faith and fair dealing, Stein’s suit charges Kyocera, Seiter & Miller and associated individuals of illegal religious discrimination and with wrongful discharge for political expression, which are illegal under California law. Stein seeks the sum of $300,000 for work he agreed to do, attorney fees and court costs and punitive damages.

Yeah, when perhaps half the country or more think global warming is a political scam. Some “unpopular opinion”.
There was a time when more than half the population thought the world was flat. And that the sun revolved around the Earth. They killed people for saying differently. So, I’m not certain you should be so proud to defend the popular view.

It’s not just the general population that is skeptical of AGW, but also among the rank and file scientists within organizations where the leadership publically endorses the idea of AGW. The leadership of those organizations will not cut their own nose to spite their face. They want the government grants to keep exploring AGW. It is amazing to hear the irreverence for the conventional position as I sit in meetings with technologists and scientists when discussions come up, often in a humorous vein, about global warming. I’ve yet to find more than scant few scientists who will publicly defend the conventional position that man is responsible, or more to the point that the miniscule amount of CO2 is the primary driver of climate. You would think from listening to the news reports that all scientists treat this position as gospel. You would be shocked. It’s all about the money. So Ben is spot on.
AGW CO2 is not scientific consensus. Climategate 1 and 2 emails show that it was a large number of insiders running a political scam that raked in the dollars. They shut up anyone who disagreed with them and the compliant entertainment/media types went along for the ride. It won’t be the first time in science that the group think was wrong about something. It’s unfortunate that people with limited or no real experience in the business muddy up this website with straight out of high school comments. As much as I dislike Ben Stein’s politics, this is a slam dunk for him. Legal precedent going back to at least the early 80′s all but guarantee him full contractual compensation. If Kyocera has any play at all, it’s to sue and drop the lame ass ad agency that could have fully vetted the talent in question as easily as following his tweets.
This so called expert was telling everyone to buy real estate at the peak of the bubble.
It’s a little disingenuous to pretend this is about politics. This is about not wanting someone who’s this profoundly stupid representing your products. Science isn’t a democracy. The fact that some people are too stupid to accept reality doesn’t change the fact that it’s reality. Ben Stein’s a moron’s idea of what a smart person acts like.

I think Stein has a valid suit because everybody knew his views on global warming which incidentally as times have gone by and scandals have arised from the studies on global warming – more and more people share Stein’s views. Evenmoreso, it was the advertising agency who seeked Stein and there was a verbal agreement which is as valid as a written one.
But what makes it more interesting is that an advertising agency is going to discard spokesman on the basis of their beliefs or comments, then they’re going to be without any spokesmen. Yep, it’s discrimination.
I guess Ben will have to make due with his highly embarrassing freecreditscore.com commercials.
I tend not to buy products Stein touts because of some of his stupider political statements during the W years; global warming was not a factor in my opinion. The real question is, if i won’t buy from Ben Stein, why would I respond positively to a look alike? I probably would not be favorably influenced by such stupidity, as a matter of fact, the thrift of Steins persona would be more of a negative impression than the real thing.

If you remember correctly – almost nobody won Ben Stein’s money. Brilliant, free-thinking people always intimidate the “follow the cow in front of you” dolts. Nothing new here.
The fact that people still don’t think that either Global Warming or Climate Change is not the result of human pollution is just disturbing.
But then again these are the same people that don’t believe in evolution and probably still think the Earth is flat.
What they do believe in is money, corruption and the return of slave labor.

And Chico, above, rightly brings up the topic of blacklisting. Denying someone work because of their political affiliation is something Hollywood used to protest against. Whats funny is that Stein, while an opponent of global warming, is pretty liberal in his views of taxes, a supporter of Al Franken and even promoted Ralph Nader in the past.

Ben Stein has been overexposed and is now a caricature of himself. Boring and truly obnoxious.
Wow. The very fact this is an issue demonstrates that, like it or not, right or wrong, ‘global warming’ is a political issue, not a scientific one.
I’ve been closely following and ghost-writing on ‘global warming’ topics for nearly two decades now. I practically live it and breathe it. And so, from my own experience, I assure you that if you start asking everyone you meet on your daily routine, “is global warming real?” the vast majority of people will say “eh, I don’t know. I’m too busy to pay much attention.”
Actions like this, declining this man’s contract because he doesn’t embrace IPCC brand ‘science’, simply shows this agency is harboring extremists and activists. 99% of people would never have known, or cared in the slightest, about this issue if these idiots hadn’t made a big deal out of it.
I listen to music and watch movies with singers and actors who hold conflicting views from my own, on a number of topics. So what? Good grief. It’s not a crime to be reasonable and get along with others.
