UPDATE, TUESDAY 4:40 PM: A jury has still not been seated in the case, and selection will resume tomorrow at 1:30 PM once the potential juror panel has been replenished. Once selection is completed — hopefully by late in the afternoon — opening statements will begin. However, with Judge Elizabeth Allen White being strict about ending proceedings at 4:15 PM, it is unlikely opening statements will get far. Sheridan and Cherry were present in court all day Tuesday.
PREVIOUS, MONDAY PM: Desperate Housewives may be in its final season, but the real-life war on Wisteria Lane is just getting underway between actress Nicollette Sheridan and series creator/executive producer Marc Cherry, ABC Studios (formerly Touchstone TV) and ABC. Sheridan, who played the villainous Edie Britt for the series’ first five seasons, is suing Cherry and the network for wrongful termination and battery. The case, which began jury selection today and is expected to last 12 days (UPDATE: The judge said this afternoon she expects the trial to conclude no later than March 12), features a juicy witness list that includes past and present ABC and ABC Studios executives like former ABC Entertainment president Stephen McPherson, former ABC Studios president and current CW president Mark Pedowitz, ABC Studios’ head of business affairs Howard Davine, Desperate Housewives executive producer/showrunner Bob Daily as well as other current and former writer-producers on the show including Alexandra Cunningham, David Flebotte and Lari Kirkland Baker. Also called in are most of Sheridan’s former co-stars on the show — Eva Longoria, Felicity Huffman, Marcia Cross, James Denton, and Sheridon’s former love interest Neal McDonough — but surprisingly no Teri Hatcher. But present on the list is former Law & Order: SVU showrunner Neal Baer. That’s in addition to the two principal parties Sheridan and Cherry, who are expected to take the stand for eight hours each. Sheridan likely will be one of the first witnesses called when jury selection and opening statements conclude.
After a short morning appearance today by Sheridan and Cherry in LA Superior Court, the trial was given over to jury selection. That group will get a crash course in behind-the-scenes network TV: With Sheridan’s claims of sexual harassment and compensation for the show’s entire run already rejected by Judge Elizabeth Allen White, the case now revolves around the sequence of events and decisions in late 2008 that led to the end of Sheridan’s tenure on the hit series. If she wins, the court has said she will be entitled to about $4.2 million, her annual salary.
Sheridan’s contention is that her character was killed off and she was let go from the show in February 2009 because she complained to ABC execs that Cherry hit her during a September 24, 2008 argument. Cherry, who has admitted he did lightly strike Sheridan on the head during the confrontation, claims the incident had nothing to do with Sheridan leaving the show. Cherry said he decided in May 2008 to cut Sheridan loose and had received approval from ABC and series producer Touchstone. In his deposition, Cherry called it a “cost-cutting measure.” Producer Lori Kirkland Baker, who worked on the show at that time, has a different understanding of events. In her deposition, she said Cherry began talking about problems he was having with Sheridan and killing off her character in late September 2008. In December of that year, Cherry — whose alleged abusive actions toward other cast and crew was declared by the judge a no-go zone for Sheridan’s lawyers in the trial — supposedly told the show’s writers that he planned to kill off Sheridan’s character at the end of Season 5. But he decided with network support to kill off the character and drop Sheridan much earlier.
Sheridan is represented by Mark Baute, Patrick Maloney, and Sean Andrade of downtown law firm Baute, Crochetiere & Maloney. Cherry, Touchstone and ABC are defended by Adam Levin and Aaron Wais of Westside lawyers Mitchell Silberberg & Knupp.


I would be great if she won and took the cash. Pompous egomaniacs like Cherry need to be put in their place. Hitting someone in the head is not a way to problem solve. May he have many, many sleepless nights over that dunderheaded decision.

He should of figured out a way to get along with her. Because he fired her the show did suffer! This was a fight of ego’s and because Marc has anego the show suffered becuase he fired the actress and killed off his best charector.
The show was almost unwatchable when Nicolete was on it however once she was gone it became a huge creative mess. I stop watching the show when they did nothing with Dana Delaney.

industry where a boss can hit an employee and not expect ramifications..
while i really like DH and this final season has been the best in years… they should have tied these ladies together with a murder plot way before the final season… but the way sheridan’s character was poorly, quickly and uneventfully disposed of shows this was not some long planned exit of one of the housewives but a quick decision based on “something” happening… i believe her and i want her to win
It’s so obvious that Marc Cherry is guilty of everything Nicolette is accusing him of.
Let’s hope she wins the case and puts him in his place. Vile little man.

That makes no sense. Cherry is an egomaniac and a jerk. He got so rich so fast from this show the power went to his fat head. I’m amazed ABC wanted this to go to trial they should have paid her half of what she wanted and she should have been happy with that.
This trial will be very embarrassing for Cherry and for ABC. Nicolette has nothing to lose by going it will be great for her she’ll be on TV every day and she’ll love being back in the spotlight.
Sheridan for the WIN. Even though I stopped following the show years ago, it would have been cool if the final scene was Sheridan showing up alive in the last scene – since she really was the fifth housewife.
Yes. Her “demise” was abrupt and uneventful. Not a single talk show appearance to promote her last show and give it a ratings boost. I think she is right and want her to win this.
She has sued each and every person that has ever worked with her, going all the way back to Falcon Crest and Stan Kamens. She never wants to pay her reps who work so hard for her. She has stiffed and sued every manager she has ever had, including the one that put her on Desperate Housewives and turned a guest star role in the pilot into a series regular! She is one of the most litigious, ungrateful actors in town.

Funny you say this considering she was never on Falcon Crest and the cast of Knots Landing (which has been very candid about who they did and didn’t like) has nothing but positive things to say about her. Also strange how she continues to be employed, including a pilot for CBS last year…
She sounds like she has a terrible inferiority complex and she’s constantly biting the hands that feed her. But she will still win this after she testifies, the jury will love her because she’s going to be glamorous in their eyes they will be starstuck by her even though she’s not that much of a star. I can’t stand her I don’t think she’s beautiful or talented but she definitely got screwed by Cherry on this show and he is going to look like a fat pompous dictator her lawyers will make him look like a little hitler by the time they are done with him. ABC will offer her money during jury deliberation they won’t want to risk a verdict in her favor and the money will make her happy because even if she wins ABC can file an appeal and she won’t get paid for another year.
So she was making about $200k per episode. A lot of dough for a show that’s been unwatchable for years.
Her exit was very odd considering her screentime had been increased so much and that particular season she had the lead story and mystery. Her character always lived off her popularity, something I think Cherry resented. SHe wasn’t part of his long term vision and network support meant him having to keep her.
The timing of her exit was VERY strange. Her character didn’t even live long enough to live out the mystery involving her husband. It’s a shame, but I never watched DH after she was written out.
I’m just happy this pile of heap called DH is finally being shown the door after this season. If cherry loses, ABC should also just scrap his new show and have nothing to do with him anymore and can’t see anyone wanting to hire this woman with her controversial past either.
I know people who were there during the incident in question, and they think the lawsuit is a total crock.
From the blessedly little amount time I worked with these nut jobs as a PA years ago, I seem to remember Nicollette leaving set to go home to grab her dog because she was jealous of all the attention the old neighbor was getting with the dog she brought to set. With the exception of Flicka, the whole cast was out of their fucking minds.
You’re the third person I’ve seen to give the exact same firsthand account. Sheridan is a known lover of attention and I’m sure she’ll relish this spotlight.

On the other hand, at least she didn’t halt production because of crying jags brought on by self starvation.

Desperate Housewives did suffer when the Edie character was killed off. The show really wasn’t the same after she left. I hope she wins(whether the network or Mr.Cherry ends up paying). I enjoyed her character immensely,and,if what she is saying is true-hopefully she will win the case. If what she is saying happened the way she says it happened-the guy shouldn’t get away with it. Thank you.
Marc is a mean man and also likes to pinch. I’ve been following the case closely and hope he gets what’s coming to him.
This show has been unwatchable for the last couple of years. I tried to get through an episode two weeks ago and just gave up. A show that started out clever and fun has devolved into a schtick-fest. It’s like a bad mid-90s sitcom.
was a fun show but i stopped when she left..i find her very interesting and she holds my attention…seems like someone always fighting to be relevant..and she is gorgeous…anyways..i might have to watch these last few episodes..everyone says are so good..but in my mind the show nosedived when they killed her off.
