The battery portion of Nicollette Sheridan’s lawsuit against Desperate Housewives creator/executive producer Marc Cherry has been dropped, with Cherry’s defense lawyer saying Cherry is ”no longer a defendant in this case.” Judge Elizabeth Allen White today deemed the battery claim did not meet the standards of workman’s compensation statutes that apply to these matters. When court resumes this afternoon, lawyers from both sides are expected to reaffirm the matter with White. “Obviously I am thrilled by the judge’s decision, but I am going to withhold all comment until the case is resolved”, Cherry told Deadline.
Sheridan’s lawyer Mark Baute said outside the courtroom that the dismissal is not a big deal for the actress’ case against ABC Studios and ABC. He said the action allows Sheridan to go to the heart of the matter — the wrongful termination claim. “You hit me, and I complained,” Baute said, “and you fired me because of it.”
Sheridan took the stand briefly before the lunch break to give a concise version of the alleged head-hitting incident between her and Cherry on the Housewives set on September 24, 2008. “He was dismissive and he hit me”, the actress said in a quivering voice.

And the difference here is that, while it was uncalled for and inexcusable, Marc Cherry gave her a dope slap to the back of the head. He didn’t try to beat her to death in a moving car and put her in the hospital.

Hearing the other cast members speak who are no longer on the show then he’s a person who was just showing her how the smack was going to be. Then she took it out of context and accused him of hitting her! She makes me want to vomit.
I’m a director and I would never work with her. What if she tripped running in one of my action scenes and then she goes to the judge to say, “He told me to run in high heals and I told him I didn’t want to. Then I finally agreed. Then I sprang my ankle. Oh wait a second I take that back, I mean he caused a life time of not being able to walk right.” She’s now become a liability and only a stupid show or movie would want her on. Sheridan sets an example for all the bratty actors out there that we try to screen out in the audition process.
Even if she is crazy and by god WE’VE ALL SEEN THOSE D-BAG TYPES of actors, well, even if she is an exaggerating drama-queen she should have still kept her mouth shut. It wasn’t like he kicked her in the gut and took a leak on her like a gangster-rapper. All of this drama that’s wasting everyone’s time. At least we all got to learn that Nicollette Sheridan is a liability for any set.

Does anyone honestly believe that Eva Longoria, Felicity Huffman, Marcia Cross, Teri Hatcher and the male leads on DH would stay quiet if they witnessed Marc Cherry intentionally hit the talentless Nicollette Sheridan? Come on, NS is just pissy because she lost her job. She’s not getting a lot of work. She needs money so why not try to extort some. If anything, I think that this whole situation puts NS in a negative light. Good luck in finding work moron.
Hm, I’m not sure that you have any idea how screwed up Hollywood really is. There are much worse things going on on some Hollywood sets than producers hitting their employees and the colleagues look the other way.

Well I am glad. Cherry didn’t deserve any of this. She’s NOT a pleasant person to be around or work around. She wasn’t their first pick to begin with if memory serves and they kinda saddled her in there because she was somewhat of a “name” she was never a “lead” on that show and never meant to be billed as such which I think was always a source of contention from NS’s part. But let’s be honest, what doesn’t piss that chick off. I mean really. She’s just one of those. Perfectly nice, but always upset about something. The mere fact that she filed this lawsuit is telling. People get fired every day. Marc Cherry did not have it out for you NS. He may not have enjoyed you on the set, you may not have enjoyed him. Others may not have enjoyed you, and vice versa….. but its no reason to go around filing a lawsuit. There just aren’t any grounds here – at all. As a very casual view of the show I’d been wondering for YEARS when your character was going to get written out of the picture – the simple fact — YOUR CHARACTER had run its course!!!! Its not personal!!!! And Cherry, he’s not a fighter, it was an error. Okay, mistakes happen, we move on. Who wins in this situation? The lawyers.
It may not have risen to the level of battery as defined in the law or interpreted by the court…but that does not mean it didn’t happen or that it didn’t create a hostile work environment, or that following her complaint, that there was no retaliation. In fact, the Court is only saying that it does not qualify for workman’s comp.
obviously it’s just gossip to us outsiders. but from what i’ve read, many industry insiders do believe Cherry hit Sheridan and that he is notorious for his bad temper and rudeness toward women but never to men. well, that doesn’t sound like much of a surprise to me…

By Judge White’s dismissal of the battery charge against Marc Cherry, this lawsuit is beginning to deflate. It is probable that ABC will still settle the suit rather than let the jury deliberate. But at a much greater reduced offer than may have been demanded by Sheridan originally.
How is Marc Cherry not potentially responsible for the alleged retaliation/wrongful termination? Even if Sheridan was technically employed by ABC, wasn’t he still her boss and pretty much the guy who decided to kill her off (allegedly) after she complained about his conduct?
Nicolette comes off like a major head case, and Cherry like a smug prick. Both sides lose in their blatant reinforcement of the stereotypical views of actresses and showrunners.
How can battery charges be dismissed when he’s admitted (multiple times and on the stand as well) to hitting her in the head? Whether it was soft or hard, he’s still admitting to hitting an employee in front of people in order to humliate the shit out of her and “put her in her place”. This whole trial is a joke. Is ABC paying off the judge too or what?
An aging actress gets mad because they fired her, so she tries to pack her savings account through the court system. She added the head-bop thing for a sympathy factor, that never came.
He would never be personally liable for that because of the protection of he and ABC entities.(corporation, LLC, etc) The battery charge was against him personally. But even though that part of the case is dismissed, the facts of the incident and aftermath are still more than enough to win the other charges.
