UPDATE, 2:57 PM: Former ABC Entertainment president Steve McPherson told the court this afternoon that he approved the killing off of Nicollette Sheridan’s Edie Britt character in May 2008, months before a head-hitting incident between Sheridan and Cherry on the Desperate Housewives set. He then told Deadline after his brief appearance on the stand that he is surprised the case ever got this far. ”It’s kinda crazy,” McPherson said outside the courtroom. “Both parties are really nice people, and I’m surprised it even made it to trial,” he said. McPherson, who left ABC abruptly in 2010, declined to discuss the Cherry-Sheridan incident but told Deadline it had nothing to do with the actress leaving the series. “We made the decision to get rid of the character six or seven months before anything happened — whatever happened,” he said, echoing his testimony.
On the stand, McPherson confirmed Cherry’s and Pedowitz’s previous testimony that he gave his approval of the decision on May 22, 2008. “I was running the network, they needed my approval to kill of the character”, he told the jury. “I gave my approval.” The alleged Cherry-Sheridan head-slapping incident occurred in September 2008. Under questioning from Cherry defense lawyer Adam Levin, McPherson said he had no emails or memos about the decision because “we wanted to keep it confidential”. He testified that the only people at the meeting in his office that day were himself, Cherry, Pedowitz and Housewives producers Sabrina Wind and Bob Daily. He added that he would have done exactly the same thing in regards to the killing off of any major character on any major network series. “We didn’t want it to get out”, he said.
Earlier in the afternoon, ABC human resources exec Volk continued her testimony over her hearing of the Sheridan-Cherry incident and the subsequent investigation weeks later. “I concluded that the story I was hearing was consistent”, she told the jury. “It appeared to be a minor incident that was resolved and I had received no further complaints, and I considered the matter closed.” Volk reiterated she never interviewed nor heard from Cherry or Sheridan about the incident.
PREVIOUS, 1:42 PM: ABC human resources executive Lynne Volk testified today that the network did not open an investigation into the head-hitting confrontation between Desperate Housewives creator/executive producer Marc Cherry and series star Nicollette Sheridan until weeks after it occurred. “I recall being told that Ms. Sheridan and Mr. Cherry had an interaction,” Volk told the courtroom as she recollected her conversation with Housewives line producer George Perkins hours after the incident on September 24, 2008. “Ms. Sheridan had been upset by their interaction, there had been an apology and everything was fine.” The subsequent investigation was launched only after Volk had a conversation with network business affairs executive Howard Davine in mid-October 2008, after then-ABC Studios boss Mark Pedowitz read an article about the incident in the National Inquirer. That probe, according to earlier testimony from Pedowitz, did not include questioning Cherry or Sheridan and concluded that the complaints around the incident were “baseless”.
Volk testified at Sheridan’s wrongful termination and battery trial against Cherry, ABC Studios and ABC that during the official probe she spoke to Housewives director Larry Shaw and Cherry’s assistant Jason Ganzel, both witnesses to the incident, during “relatively short” interviews November 15, 2008. She said though that she never spoke to Cherry or Sheridan. Volk said that Ganzel told her, as confirmed by her notes of her interview, that the incident was “inconsequential” and Cherry did not slap Sheridan. Pedowitz earlier testified that he received an “oral report” from Volk in early December 2008 that said complaints about the incident were “baseless”, and no further action was taken by the studio.
Steve McPherson is expected to take the stand this afternoon for what is expected to be brief testimony. Judge Elizabeth Allen White told the jury earlier in the day that she expects to conclude by Tuesday.



What is really curious, but not mentioned, is that Lynne Volk NO LONGER works for ABC Studios…WHY is that?
No conspiracy there. Things change.
Sure she does – she left the company briefly and came back. She now works for Disney internet group.
The network & producer’s credibility is shattered when you can’t answer…why ANYONE would pick up a $4.2M Option…AFTER YOU ALREADY DECIDED TO KILL OFF THREE CHARACTER…(and the only ones in the meeting are now all defendants our defense witnesses). (…unless, of course…you really didn’t decide to kill off the character…because that meeting never took place.)
Wait, so they want me to believe that a 4.2 million dollars option was picked up so they could keep a secret? And this is supposed to be a cost cutting measure? Really? Especially in a business where there are no secrets?
I recall when the character was killed off. It seemed sort of haphazard and badly done. Even then I wondered if they had just decided to get rid of her.
Isn’t McPherson a sexual predator or sexual discriminator or something? When’s his trial?
Yeah, there was a sexual harassment scandal that the Disney bigwigs used as an extra excuse to cart McPherson out of the ABC job after EVERY DRAMA THEY LAUNCHED IN THE 2009-10 SEASON FAILED! (V fan in the back, sit down – your show was a pity renewal that was burned off between Dancing cycles the next year) It also didn’t help that most analysts gave long odds on any of their dramas for 2010-2011 (BoP fan in the back, same goes for you). Given the success of Revenge and Once Upon A Time (and, on the comedy side, Suburgatory and maybe Last Man Standing) it’s hard to argue against both McPherson’s termination and Paul Lee’s hiring (at least for now. If next fall turns out as poorly as this midseason for ABC, though…).
The ABC-Cherry stand is ridiculous. Aside from them picking up her 4.2 million option AFTER they decided to kill her off, there are no emails or any documentation OF ANY KIND about this alleged May 22, 2008 meeting – in a day and time when almost every minor daily decision is documented as such. I hope the jury can see through this nonsense!
Steve McPherson once patted me gently on the head, like I was a dog, when I played a role on an ABC show during his tenure. Honestly, I think it was an equally demeaning gesture as however hard Marc Cherry might have struck Nicollette Sheridan.

This trial is turning into a joke but just hoping all this craziness gets resolved next week and then everyone can go their separate ways but as I stated beforehand, can’t see any studio wanting to put up with Sheridan or actresses being very weary of working with Cherry. Just get this resolved already and Cherry, next time, kep your damn hands to yourself.
People need to get the time lines straight
First they picked up her $4.2M Option for season 5
Second she wasn’t killed off until sweeps of season 5
Third would you really tell a disgruntled star they were going to be killed off? They would blab it all over the press.
Fourth Disney/ABC is known for killing off characters for bigger ratings DURING sweeps. If the secret got out can you imagine how disastrous it would be if everyone knew?
I remember Edie being killed off, it was already being inferred she would be toast a good month or so before. This isn’t like a movie spoiler, re TV, these things always get out and into the press ahead of time, i.e. that the possibility exists that someone will be killed off and speculation of who it may be. See what’s going on now with Denton and his character. I believe they made the decision after the incident, and like priccks, left her in limbo about her future with the show. I recall seeing a YouTube interview with the cast and cherry – dont know where it was from…may ave been a DVD thing….featured behind the show footage with cherry interviewing his actresses, what was very obvious was that he had limited nicolettes face time in the little deal, and even snarkily teased about booting someone. They need to gettheir hands on it. It was obvious to me cherry hadit in for Sheridan…now it all makes sense.
I was glad when they took her out. I couldn’t stand her or her character. I hope they win the suit because she is just stupid. And I hope they sue her because they had to let out that Mike was the one getting killed this season. That could totally ruin it. I hope she never gets hired to work anywhere again because she is a witch with a b instead of a w.
