3RD UPDATE, 4:30 PM: Michael Reinhart, credited as a construction coordinator on Desperate Housewives, has been identified as the caller who told Nicollette Sheridan’s lawyer that ABC planned to delete all emails related to Sheridan’s departure after she had filed her original lawsuit. Although IMDb lists him working on Housewives only in 2011, a source with knowledge of Reinhart’s employment history says, “The guy has been on the show since the pilot.” Attempts to contact Reinhart were unsuccessful, so Judge Elizabeth Allen White instructed her clerk to try to reach him directly at the end of the day today in hopes of having him appear in court tomorrow. They want him for what is known as a 402 hearing — it does not require a seated jury to be present — to determine whether he has information that is relevant. This afternoon, during jury instruction, Reinhart’s name was mentioned in court and defense lawyer Adam Levin “objected to Mr Reinhart taking the stand.” Later, Levin told Deadline: ”These mystery emails appear to be a last-ditch effort by the plaintiff to save her case — I want to see the emails”.
2ND UPDATE, 12:27 PM: Here is the official transcript of the voicemail (listen to the audio here) from the Desperate Housewives employee who called Nicollette Sheridan’s lawyer Mark Baute on Sunday afternoon:
Hi Mark. I’m an employee of Desperate Housewives. I received an email soon after Nicollette filed suit; I think it was meant for a much narrower distribution, but it regarded having IT come in and wipe clean the hard drives of the producers in response to the correspondence that they’ve had e-mail wise about firing Nicollette. Um, I think I got it by mistake; I believe they were going to have the Disney IT person come in to do the sweeping of the hard drive .. that’s about all I know; you obviously can check this number and figure out who I am but I really don’t want to get involved. I’m a real low level employee there and I shouldn’t have got that e-mail, I’m on the general email list. but there was definitely a conspiracy to cover up the correspondence on email wise in regards to Nicollette. See ya.

UPDATE, 11 AM: Baute said the revelation that ABC attempted to have emails erased from Housewives‘ employees’ hard drives is legitimate. “I spoke to the guy for 45 minutes yesterday on the phone,” Baute told Deadline this morning, “and in my opinion this is for real”. The attorney said he received the voicemail in his office yesterday afternoon and expects that the employee in question will testify tomorrow morning. The plaintiffs rested their case this morning, and the defense has been bringing in a series of witnesses this morning. The jury is expected to receive instructions from the judge this afternoon for deliberations later this week.
PREVIOUS, 9:57 AM: Nicollette Sheridan’s lawyers dropped a bombshell in court this morning during Sheridan’s wrongful termination and battery trial. Mark Baute and Patrick Maloney played a voicemail from a “low-level” Desperate Housewives employee who said he was mistakenly included on an email that indicated ABC intended to use its IT department to wipe everyone’s hard drives of all communications in regard to the killing off of Sheridan’s Edie Britt character. The email was distributed to the series’ senior producers shortly after the actress first filed her suit on April 5, 2010. The staffer stated that there was “definitely a conspiracy to cover up correspondence.”
Baute and Maloney told the court they want to bring the caller in as a witness tomorrow and that the staffer has been dodging service of a subpoena since yesterday, which was to be the last day of the two-week trial. Defense attorney Adam Levin expressed shock at the voicemail and told Judge Elizabeth Allen White that this was “the first we’d heard of this.” White took both sides into chambers after the revelation, after which the trial resumed.
Sheridan contends she was cut from the show in its fifth season as fallout from an alleged head-hitting incident between her and Housewives creator/executive producer Marc Cherry on Sept 24, 2008. Cherry, who says he “lightly tapped” the actress in the process of giving her direction, testified that the decision to kill off the Sheridan’s character was made — with studio and network approval — on May 22, 2008. His version was backed on the stand by former ABC Studios president Mark Pedowitz, former ABC Entertainment president Steve McPherson, and Housewives producer Sabrina Wind. Cherry, accompanied by Wind and fellow producer Bob Daily, said he received Pedowitz’s studio approval in a private meeting that day. In his brief testimony Friday, McPherson said he gave network approval later that day in a meeting in his office, saying he had no emails or other documentation about the decision because he wanted it kept “confidential.”
The lack of electronic communication in the matter has been surprising. When asked on the stand last week if she sent or received emails about killing off the character, Wind told the court that she “could not recall.”
Sheridan was informed that her character would be killed off the show on February 10, 2009, one day before filming began on what was to be her last episode.

This is a town full of real scumbags, ain’t it? If only I could believe that the alleged conspiracy was out of the ordinary for business behavior in the entertainment biz. Sadly, it’s the norm in an industry populated by folks whose parents never taught them right from wrong.
If the Supreme Court believes corporations are people and ABC really did this, why can’t ABC then be put in prison? That’s why the current SC is a farce.
Am sick of corporate malfeasance and also tired of whistleblowers being punished when they should be praised and rewarded.
DAMN RIGHT THIS DUDE STEPPED UP TO THE PLATE! Kudos to him. Some think it’s stupid, but those of us in this town who do have some morals left in our souls (probably has something to do w/our upbringing) are praising his efforts. Hopefully, he has money saved up, a wife who has a steady income, or a construction union who will back him up in case things get rough. Sorry ABC/Disney…not bus as usually. Doesn’t matter how much Nicollette was paid. If this guy felt she was a decent enough human being for him to back up, then that’s his decision. Hopefully, a co. who respects decency will pick him up after the show ends.
Poor guy is going to lose his job and be blackballed form the industry. He should have printed the email and mailed it anonymously. He could have also called from a phone that could not be traced to him.
I feel sorry for the guy because his integrity will result in the destruction of his career.

Wow, a bombshell! I confess that I have been on Sheridan’s side in this case from the beginning. This news certainly does cut through the spin from the other side, which has been persistent and very slick. I only hope it leads to a favorable ruling for Sheridan.

Medals are given to brave people, not crazy people. Sacrificing yourself in combat to save your comrades is brave. Ending your career to save a highly paid actress from losing a lawsuit over her character being killed off is insane.

I know this may sound radical but the employee who blew the whistle faced a moral decision and did something of use. He knew he had information that could possibly stop a liar from succeeding in rewriting the facts. Calling this employee a fool pretty much sums up why liars get away with so much so often.
You’re absolutely right, Cherrybomb. But right or wrong, that was a helluva sacrifice to make for a little bit of moral high ground. That’s like reporting your boss for lying while talking his or her way out of a traffic ticket. The losers in this case are going to be financially inconvenienced, but no matter who wins or loses here, this poor low level employee is going to pay the biggest price in relative economic terms.

Now that Cherry and ABC have been publicly exposed as the liars and frauds that anyone who knows them personally already knows them to be, hopefully the jury with side with Nicollette and make them pay big time.

This trial has just become interesting again. I have to admit I would have loved to see the look on the defense lawyer’s face when the voicemail was played in court.
This happens all the time studios and networks are notorious for destroying evidence they will do anything to win they lie they cheat they steal it’s their corporate mentality and all they need is a printed copy of that email they don’t need the witness in person just the email that was sent. The jury will understand what happened.

It’s not surprising that they tried to scrub all the IT evidence, what IS surprising is that they lucked into mistakenly being included on that voicemail.
The witness is clearly reluctant to testify. It will be interesting to see if he/she is honest on the stand or tries to stonewall in an attempt to stay in the company’s good graces.
I’d say that just by leaving that voicemail, he is well past any possibility of staying in his employer’s good graces.

I love the response of Sabrina Wind:saying she “could not recall”-that is the routine response of people who are guilty/hiding something. Abc & this Marc Cherry are such a bunch of slime. side kick and he’s her gravy train. I worked there during that time and believe me March Cherry is TOTALLY GUILTY. I salute this guy for coming forward with his email knowledge…. But, I feel bad because he will, of course, be blacklisted…that’s this stupid crazy business for you. The assholes get the accolades while they crap on everyone else. I understand that Nicolette was quite a handful..but that doesn’t make her deserve the hell Marc Cherry put her through. Maybe when she wins this lawsuit..she can throw “Mark” some of her winnings..he deserves it.
Summed up perfectly John M, and if it’s true that MC put NS through “hell,” that’s a good way to cause her to mess up her lines, etc. Nothing is worse than knowing your boss doesn’t like you, and not knowing why. Maybe he never liked her from the get-go, and wanted her off the show. I liked her performance on DH, and thought she was an asset. I never thought her acting was bad. Isn’t that how she should be judged – by her performance?

How convenient is it that this voice mail popped up right now when the prosecution needed it the most? And how can a call like this possibly be used as evidence without verification of who left it?
Anyone on the crew of Desperate Housewives that have been there from the beginning when they listen to this voice mail will instantly know who “DEEPTHROAT” is…..I don’t even work on the show and I immediately knew the voice behind the message. Low level??? I’d say more like Mid Level.
This “bombshell” doesn’t pass the smell test to me. I don’t doubt that the studio et al would play fast and loose to hedge the game in its favor, but the idea that an email would be circulated, presumably by someone in business or legal affairs, among sr. execs announcing the intent to destroy potential evidence in a lawsuit suggests a level of bad, potentially liable, judgement that is beyond the pale. We live in a world where there are no secrets, so someone circulating such an email would have to know that their actions could be creating a host of potential witnesses for the NS side, including the IT department, which, if there is any truth to the claim, is where the NS team should find corroboration. Don’t see how NS prevails on the termination, but the head tap is up in the air, depending upon who you’re routing for…

I don’t know about ABC, but I worked for one of the “Big Two” auto manufacturers for many years: there, company policy was to destroy EVERYTHING not clearly defined as required by law when it reached two years old. I would be curious to know ABC’s policy.
