UPDATE, 4:45 PM: Here comes the big guy — former ABC Entertainment president Steve McPherson is slated to testify in Nicollette Sheridan’s wrongful termination and battery trial on Friday at 1:30 PM. McPherson, who left ABC in 2010, has been cited in testimony by Marc Cherry and former ABC Studios president Mark Pedowitz as having given the network’s permission to kill off Sheridan’s Edie Britt character in May 2008, four months before the Cherry allegedly struck Sheridan in the head during an on-set altercation. Sheridan claims she was eliminated from the show because of that latter incident.
Testimony today saw several witnesses take the stand out of order due to scheduling issues, and saw Cherry’s ongoing testimony pause yet again to accommodate those changes. Sabrina Wind, a Desperate Housewives producer and Cherry’s self-described “right-hand gal,” took the stand this afternoon and contradicted several statements her boss made during his testimony. Wind, visibly nervous, said she could not recall getting a call from Cherry shortly after the alleged head-hitting incident between him and Sheridan on September 24, 2008. Sheridan’s lawyer Mark Baute then read from Wind’s deposition last year, in which she said she “did not” receive a call from Cherry as he previously testified. Wind, in another contradiction to Cherry’s testimony, also said she did not keep the producer up to date on a human resources investigation into the alleged incident. Wind, who is Cherry’s partner in Cherry/Wind Productions, also said she knew of no discussions about financial savings or “unprofessional behavior” on Sheridan’s part as reasons for killing off the actress’ character.
Earlier in the afternoon, former Desperate Housewives co-executive producer Lori Kirkland Baker testified that she never saw a supposed writer’s index card saying “Steve drinks OJ.” Baker, who was with the show from 2007-09, also said Cherry first announced his plans in December 2008, after “just being given permission by Steve McPherson to kill off the Edie Britt character.” Cherry said in previous testimony that McPherson, along with Pedowitz, gave him permission to kill off the character in May 2008, and that he had been working on a storyline to that effect. Wind’s testimony is expected to continue tomorrow. James Denton, who played Teri Hatcher’s love interest on the show, could possibly be called by the defense.
(UPDATE, 6:20 PM: After court concluded for the day, defense attorney Adam Levin issued this statement: ”Three witnesses have testified on behalf of the defense that the final decision to kill Ms. Sheridan’s character was made in May of 2008. One witness has testified for the plaintiff under perjury and penalty that she wasn’t in the room when the discussions took place.”)
PREVIOUS, 2:21 PM: Marc Cherry resumed his testimony today in Nicollette Sheridan’s wrongful termination and battery trial. The Desperate Housewives creator/executive producer answered more questions about the timeline of the decision to kill off Sheridan’s character Edie Britt, which is at the core of the actress’ suit against Cherry, ABC Studios and ABC. Cherry continued to claim that the main reason he decided to kill off the Britt character was “creative”, because “the purpose of the character was over” by Season 5. But Cherry said financial considerations and concerns about Sheridan’s “egregious” and “unprofessional” behavior also factored into his decision; that seemingly contradicts testimony Tuesday from former ABC Studios president Mark Pedowitz, who told the court killing off the Britt character was a purely “creative” matter. Pressed for specifics Wednesday, Cherry cited Sheridan making remarks about scripts that were “insulting” to writers, a time she was seemingly unprepared for a scenes, and an incident during the show’s first season between Sheridan and co-star Teri Hatcher in which Sheridan told Cherry that Hatcher was “the meanest person she had ever met.”
In another revelation, Cherry told the jury this morning that to keep the news of the Britt “mystery story” arc a secret, he used the code words “Steven drinks OJ” on an index card that Housewives writers used to organize story arcs for Season 5. That card was created in early May 2008, Cherry testified, before a September 2008 head-slapping incident occurred between Cherry and Sheridan that the actress said led to the decision to kill her off the show. Cherry said the “Steven” mention on the card was a working title for Edie’s new husband — later changed to “Dave” — and the “OJ” was “because OJ Simpson killed his wife.”
Earlier in the morning, Cherry testified that he thought Britt’s death would give the show “some juice” and “open up” possibilities for new characters. As his lawyer argued last week, Cherry, under questioning from defense attorney Adam Levin, insisted that Edie Britt was “not a leading character” but “an important series regular.” The defense also introduced various sets of writer’s assistant’s notes and other bullet-point documents, dated May 14, 19 and 22 of 2008, that mentioned “Edie’s death” as a part of that season’s storylines. Cherry told the court that while some storylines and ideas were abandoned as the season progressed, he never wavered in his plan to kill off Britt, especially after he received permission from Pedowitz and then-ABC Entertainment president Stephen McPherson on May 22, 2008.
McPherson, who is on the witness list, is expected to testify later this week.

Producing television, as many of us know, is really hard work: everyone is sleep-deprived and either anxious about the next order for a show that’s failing or trying to bust ass to keep momentum going on a show that’s succeeding. We’ve all had to deal with imperious executives and pain-in-the-ass talent…and some of us (including me) have actually BEEN that pain-in-the-ass when we started to believe in our own ineffable genius.
But, no matter how stressed out we are, we really aren’t supposed to hit our husbands/wives, boyfriends/girlfriends, children…OR COLLEAGUES. Mean-spirited gossip? Goes without saying. Withering retorts? Utterly permissible. Snide comments? Impossible to imagine production without them. But smacking folks? ABSOLUTELY, POSITIVELY WRONG, WRONG, WRONG. (And illegal, by the way.)
At the end of the day, Hollywood just isn’t Victorian England, or present-day China…you can’t hit employees who bum you out. Isn’t it really that simple? Don’t hit others. Don’t we try to teach that from infancy? Aren’t modern-day middle-school students arrested for that?
Our whole industry has jumped aboard one or another of the various “anti-bullying” campaigns, and we should, because bullies SUCK ASS and can really damage lives…and sometimes cause deaths. How can we not deplore this kind of bullying on the part of the senior producers on a fucking television show?
Ms. Sheridan’s case is a complicated one, involving all kinds of tort claims and it certainly is likely to be (at least in part) a “cash grab” but you, Casper, have gone right to the heart of the matter. To quote you: “HE HIT HER!!!”

Mean-spirited gossip and drive-by slander of non-public people can be just as destructive to one’s professional and personal life as a smack. Mean-spirited gossip should not “go without saying” and people who gossip are pitiful low forms of life. The world is getting meaner and more juvenile, and people really need to check themselves.

This is great news for me now I’m certain to get a green light at ABC for my Desperate Showrunners pilot and I want Marc Cherry to star in it. He will play himself he’s a great actor very believable and extremely funny he can do everything. I will also let him write a few episodes before we kill him off for our November sweeps month rating stunt.

Let’s hear more about Teri Hatcher and her relationship with the other Housewives. Recent published photos have shown her apart from the others and I wonder if the early buzz on the series was correct in stating the cast didn’t get along.
I don’t know who is worse, Cherry or Pedowitz. But TV would be better without them. I hope Nicole cleans their clocks.

Nicolette’s lawyers will have to change their strategy and tell the jury they are only seeking money for him hitting her in the head. It’s becoming clear through testimony that the decision to kill off her character was made long before the incident in question. If they don’t do this they will lose, the jury will decide in Cherry’s favor and Nicolette won’t win any money at all. As obnoxious as Cherry is he’s guilty of hitting her it’s evident that ABC unless they are lying approved his plan to kill off Edie Britt four or five months before he hit her.
So a Season ONE comment from NS about TH lead to her firing four years later. Right…. And if NS criticized the scripts, um, she probably had good reason to. Usually actors who comments on scripts actually care (whether they are right or not about the scripts).
I’ve been to court before and if this is the stuff he’s got against her then he is not to be believed. These women have worked together for years and it’s only normal they would have drama from time to time but if this is the best he can do…..”she’s the meanest person she ever met”, wah, wah. Come on!
Sabrina Wind just won this lawsuit for Nicolette. Sabrina’s testimony is a classic Perry Mason dramatic moment and the jury will believe Sabrina much more than they might believe Cherry or Pedowitz.
Sabrina Wind testified to what she knew and remained consistent with her deposition. Touchy situation indeed.
I don’t know if Hatcher is the “meanest person” Nicole’s ever met. But I do know there are/were tensions between her and most of the leads from day one, so that can hardly be Nicole’s fault.
If Hatcher is the “meanest person” then kudos to Nicole for saying it. We should all be so honest. If she isn’t then at worst it was a throw-away remark. In other words: big whoop! Hardly stuff worthy of one’s termination.
Cherry sounds like a real d-bag. I remember his comments about Eva Longoria’s body type, comparing her to a adolescent boy. That was rather cruelly stated; I mean isn’t she a pal? An employee? Maybe Cherry ought to fire himself.
Just putting in my two cents – the whole thing about the conversation in the hallway speaks volumes about the retaliatory nature of the incident. I am sure there were notes about killing off each and every character on that show if it would help the ratings. The TRUTH is that once you sue you don’t work.

Cherry is so clearly pulling all of this out of his ass as he goes along.
The whole wrongful termination part of the lawsuit makes no sense, and I don’t understand how a judge even agreed to hear the case. Nicolette may well have been treated badly, and in my opinion her departure was a huge creative blow to the show, but producers have the option at the end of every season whether or not to renew an actor’s contract. There are no stipulations of what reasons are or aren’t allowable. On the contrary, series contracts typically state that a producer may choose not to pick up an actor’s option for any reason whatsoever.
Meanwhile the rest of us get on with our everyday lives in the real world.
Did they ever explain the death of the narrator to this show? I stopped watching when I saw they filmed this crap in the ‘Burbs house….
Get rid of NS to make way for new characters ???? Gee, that worked out well – NOT:) I can’t recall a new character who was as entertaining as Edie Britt was and none of the storylines worked out well. There were so many times I fast forwarded episodes. A bit of Edie of would have made it more fun.
