UPDATE: Warner Horizon, which produces The Bachelor franchise, issued a statement in response to the lawsuit.
This complaint is baseless and without merit. In fact, we have had various participants of color throughout the series’ history, and the producers have been consistently — and publicly — vocal about seeking diverse candidates for both programs. As always, we continue to seek out participants of color for both The Bachelor and The Bachelorette.
PREVIOUS: Football players Nathaniel Claybrooks and Christopher Johnson filed a class-action lawsuit today in federal court in Nashville against The Bachelor and The Bachelorette for racial discrimination. According to the suit (read it here exclusively), “over the course of 23 seasons, not one time has the show’s eclectic mix ever included a Bachelor or Bachelorette who is a person of color.” Seeking unstated damages and fees, the 24-page filing also asks the court “that an injunction be issued requiring Defendants to consider persons of color as finalists for the role of the Bachelor and the Bachelorette.”
Bachelor executive producer and Bachelorette creator Michael Fleiss, ABC, Warner Horizon Television, Next Entertainment, and NZK Productions are all named as defendants. The Bachelor has been on the air since 2002, The Bachelorette has been on since 2003.
Claybrooks and Johnson, both black, say they unsuccessfully auditioned for The Bachelor. “Mr. Claybrooks’ interview lasted for a much shorter time than the interviews with white applicants who went before him,” the suit alleges. “Mr. Claybrooks felt that he was being rushed through the process and was not given the same opportunity as his white counterparts.” The suit says Claybrooks, who auditioned at Nashville’s Indigo Hotel in 2011, never heard back from Bachelor producers.
A trio of law firms — Barrett Johnston, Mehri & Skalet and Perkins-Law — represents the duo. Claybrooks currently plays for the minor-league Nashville Storm, and Johnson was a wide receiver at Tennessee State and says he is preparing to try out for the NFL. The plaintiffs and their attorneys are expected to revel more details of the suit and their motivation in filing it at a press conference later today.

Meanwhile, in comedy, the success of African-American leads has been proven time and again. The Game, an all-Black show that was dumped by the CW now airs on BET and routinely gets more viewers than ANY SHOW on the CW. So… what were you saying? Oh, right. There is simply NOT big money behind shows with black leads (rare exception Cosby 20 years ago). Everything by anyone associated with BET network “scripted narratives” proves that. There have been a plethora of reality shows showcasing African Americans that have been gigantically successful. “The Real Housewives of Atlanta” & “Basketball Wives” (which has become a franchise series for VH1) are just a few examples. Whatever reason the producers of “The Bachelor” &”The Bachelorette” have for not having leads of color will have to be deliberated in court. But your false equivalency is merely the reflection of your bigotry & stupidity & why television as a medium is losing incredible amounts of revenue by sticking to its same racist status quo instead of reaching a larger diverse audience.
As for why many dramas w/ African American leads fail– it’s because of the white men in charge who know nothing about African Americans, their lives or culture; the lack of promoting AA actors to lead status beforehand, & how disingenuous the plots & characters are because of it.
Here’s a prime example of an amazing drama series w/ an African American lead: Star Trek: Deep Space Nine. It lasted 7 seasons because the late, great Michael Piller, though white, had a great respect for all humanity (unlike you), for Avery Brooks & the character they created together, Captain Benjamin Sisko.
There have been some successful black leads in shows, but NEVER in a romance based show like this because it would be so vulgar and gross nobody would watch in the mainstream. The truth is that no one wants to see on television the way a lot of black people interact romantically (mind you I said a lot not all hence the fact that there are some that make it on the show except so far as a lead). The show would end up being canceled because no one would watch. Just tellin the truth. No political correctness or racism here, just truth!! If you want things to be different then change them by actions not by crying racism. It is what it is……..they can’t put XXX rated shows on mainstream television (and I’m not just talking about sex, but the language, and just general actions)

I love these shows and don’t think they should change what is successful. If they want to have an all black bachelor then do it on the BLACK network or the LATINO network. Don’t screw with something that is already working. I even have gay friends but I don’t want it thrown in my face. i.e. t v shows and now comercials (kendal fire) The sitcoms are even getting very racey. Geez can’t things just be left alone!

I personally don’t watch the Bachelor or Bachelorette because I think they’re idiotic as are 90% of the “Reality TV” shows. But, I do find it “interesting” to hear these shows have aired for 10-11 years, yet NEVER had a Bachelor/Bachelorette of African American or Hispanic ethnicity.

Watched one episode of “The Game” and was shocked at the stereotypical diatribes being loosely thrown around about pro athletes. Bad writing and even worse acting. I can see why it bombed on network TV.
It’s a shame that in the 21st century that a majority of White America feel that actors of color aren’t on the same level as their white counterparts when it comes to acting ability. I’ve seen several shows (situation comedies, movies, and premiers) in which white actors, their roles were so dumb and just didn’t make any sense. I asked why had the show lasted so many seasons. The backers of these shows are white and wealthy and are not only willing to finance this garbage but refuse to take chances on people of color. When will you realize actors of color are some of the most talented people there are,they do exist and stop living in denial about the double standard when it comes to the roles that are actually given to their white counterparts when they are truly the better actor for that role.

They do have ‘white-only’ job expos. They’re called ‘Job Expos’. Those organizations/events were founded to address the rampant disparity on funding for Black to attend college, get jobs, etc. The vast majority of available jobs go to white. The vast majority of college funding goes to whites. I’m not speaking of the fact that America is till majority white, and awards/jobs are given in proportion, I’m talking about the fact that a white face STILL carries certain privileges in this society, whether you want to admit to that or not. Hate to break it to you but MOST shows with white leads fail their first season. The difference is the white-led shows get endless chances throughout the season and next season to try again and again and again. Now has the quality of that all-white television programming improved or gotten worse?

I always believed that television imitates life and by the time I bor my 1st child (1984) discrimination would not be an issue in America. How naive of me. Listen all programs on public TV should have a wide spectrum of colour. Black, Chinese, Korean, Cuban or Canadian. TV should display positive consequences for our children. I never thought I would ever see commercials displaying white women and black men. The Bachelor and Bachelorette, I donot watch, because there are no people of color. I know there are beautiful educated, rich people of colour, but it seems the directors, producers and writers only want to display people of color in degrogatory ways or comical. this show is irrefutable.

In reading the comments, it seems no one has thought of one possibility that could account for no one of color being on. There were no qualified people of color auditioning or the other non-people-of-color people were better. Just because they show up doesn’t mean they are going to get it. By using their thinking, I should file a lawsuit against the NFL or NBA because I have not been selected to play in those leagues. Never mind that I’m not talented enough, I should be hied to balance the diversity. That would make no sense, and neither does hiring someone for these programs just for the sake of diversity.

If they feel non-whites will adversely affect ratings, then not hiring them is their decision to make. This isn’t a government funded unity project, it’s network television. If there’s nothing wrong with having only white Bachelors and Bachelorettes, then they should explicitly state on the requirements for the show that applicants must be (or look) Caucasian (just like how they already require applicants to be single – separated doesn’t count).

Just wanted to point out that one of Rudy Huxtable’s friends who was a regular “visitor” on the show was White. His name was Peter. On the ocassions when school was featured there were white children. If it’s Clare and Cliff’s children that you’re talking about then that’s just plain silly.

The FCC grants licenses to the networks (ABC/NBC/CBS/FOX) to air shows to America. This country is now quite diverse, and free TV should reflect that. Real talk.

The show never backed out on a promise to them and they don’t get paid for it anyways. The show is pure trash. And it’s no coincidence the producers want to keep their blueprint for casting just as it is — white guy/white gal.
In the end, the producers do not have to do a damn thing when it comes to casting.
It’s a fantasy show aimed at women who love watching tv shows about fantasies (romance, exotic locations, cute guys, first dates on top of a mountain with John Legend singing right beside you!).
So if the fantasy world the producers have built is all white/all the time, so be it. I think it’s silly, but the show is a joke, so I cannot get too upset.

@derby It’s not a fantasy show. Most fans watch it to make fun of it. The spoilers are already out before the season airs. It’s so silly and ridiculous that it’s the silliness that’s entertaining.
People of any color who have brains and good taste should avoid the Bachelor shows like avoiding botulism. Both genders of the program are an exercise in repulsion. Even Fear Factor is less perverse.
The 1st Amendment gives the producers of this garbage the right to cast it with all Filipinos, if they wanted to. The right response of the black community should be to protest that this show exists at all, especially if a black woman is featured as a member of the brothel/chattel on the Bachelor version. I hope black Americans boycott these shows and their sponsors, just to show themselves as having self-respect.
P.S. Most U.S. viewers value talent over ethnicity. The Unit was fairly successful, and featured a black lead. Undercovers had two black leads, but it failed because the show itself was boring. I have nostalgic feelings for the old Six Million Dollar Man show, and if they rebooted it with a talented black actor and didn’t distort it like they did the Bionic Woman reboot, I’d watch it happily.

Assuming the producers of this show ARE discriminating, free speech and preedom of association laws pritect them in ways that businesses and other institutions that are open to the public are not. This is a TV show which is akin to a private club or homemade movie. They can cast who they want or not cast who they don’t want to cast.
I think people need to get their heads around the fact that SOME discrimination is legal and acceptable.
Imagine you’re an attorney who only speaks English wanting to work for an immigration firm in Los Angeles and you get turned down because you DON’T speak Spanish as well or you are a female who was raised Episcopalian and get turned down for a job teaching at a private Hebrew school for boys?

I can say that there were times where Hollywood (not just the producers of this show) have not been fair to people of color, but that is not the point of this conversation. I do not watch the show, never watched the show, and I am an AA woman. Personally, I am pretty tired of seeing nothing but bitchy white women on both shows. Like they are the best looking thing since sliced bread. I have seen very few men of color or women of color or hispanics, asian, east indian women on either show.
