Lawyers seeking a retrial for Nicollette Sheridan in her Desperate Housewives wrongful termination suit this week fired back against ABC Entertainment and Touchstone Television for asking Los Angeles Superior Court Judge Elizabeth Allen White to grant a verdict in ABC’s favor and dismissal of the actress’ claim for punitive damages instead of a retrial. The case ended in a mistrial last month when jurors deadlocked 8-4 in favor of Sheridan. In court papers filed this week, Sheridan’s lawyers contend Sheridan deserves a retrial and that her claim for damages is valid. Sheridan claimed in her lawsuit that her character was killed off in retaliation for her complaining that show creator Marc Cherry struck her in the head during production. Judge White threw out the battery claim against Cherry. Sheridan and her attorneys maintain that she was written out of the series after an internal investigation by the production company cleared Cherry of wrongdoing. “The record establishes a conscious disregard for Sheridan and reveals that Cherry and Touchstone sought to penalize her and deprive her of significant income because she had the audacity to complain about being struck by her boss while at work,” Sheridan’s court papers state. ABC contends that the record supports the network’s claim that the decision to kill off Sheridan’s character was made because the producers decided that “the character had run its creative course.” A hearing on the ABC Entertainment motion is scheduled April 13.

I hope they get a retrial. It was close last time. Try again & see what happens. That cherry guy is the pits. Such a creepy little man. And,of course Abc only cares about themselves.They are just as bad as he is. I hope she wins this time if she gets a retrial.
why would any judge grant abc a dismissal when they were one vote short of losing???? The judge in the case should have forced them to make a decision, is that unheard of?
You know, if you’re an mildly talented actress at the tail end of your career who still manages to pull in a six-or-seven figure salary, and the only problme is that your producer “smacks” you in the head, you’re still way ahead of the game. STFU & GBTW.

You are right in one way, Brian. If he had smacked me on the head, I would have hit him back and “gone back to work”.
But, then I still would have been fired. And anyway, it seems guys like him never seem to think it would be okay to “smack” guys like me on the head.

All ABC will get from this is a very angry judge she is going to be pissed at them for trying to circumvent her ruling for a retrial. This shows once more how disgusting and disgraceful they are. They lost 8 to 4 and they think they can get her suit tossed out. It won’t happen but this is good news for Nicolette it means they are desperate to avoid court again and they will now have to pay her to drop lawsuit.
We all know this is going to be retried in a court of law but the new judge needs to make sure this doesn’t escalate into anything more bizarre than it already has become and to shorten it even more and render a decision no matter what. I still say they should reach an out of court settlement and call it a day, as nobody would want to work with her nevertheless after this debacle.
Not true. She’s professional, and many really hate Cherry behind his back. Its not as if she were some unhinged teen making a wild accusation. Hope she settles $$$big$$$.
Are all of you people out of your collective minds?! ABC won. A mistrial is a win. It’s not that difficult to figure out.
All that time, expense and effort and such a low burden of proof in civil course (50.0000001%) and Sheridan’s lawyers still couldn’t deliver a victory. Meanwhile, Sheridan’s legal bills are soaring.
ABC has absolutely no incentive to settle this case, nor should they. If she wants to get smacked around again, then let her keep hemoraghing money to pay for her attorneys.
The rewards for bad acting are already too much. She has had enough.
Enough already. Sheridan lost and should except that. I don’t care about any of them. Not about Sheridan, not about Cherry. They are both idiots. But I don’t want her to win because it will open door. And next time some show will decide to kill off it’s main character and that actor will sue show and say that it was because he was having fight with producer.
And next thing – TV shows will be afraid to kill off main characters because they will be afraid that they will sue them. And we would have boring shows where no one is in danger because we know that no one will die.
ABC claim is fraudulent; which other lead has been written off the show, ever, only sherdian.
She’s been targeted, harassed, exploited, discriminated against, humiliated, and damaged career options. Sheridan deserves at minimum payment for all of the years she had been forced of the show against her will, she also deserves future pay for an equal amount of time as damages.
Settle already! She won over 8 of the jurors. What makes ABC think they’ll fare better in a new trial? Just end this now.
