U.S. District Court Judge Laura Swain apparently wants first crack at deciding whether to take charge of this potentially important case: She issued a temporary restraining order today that requires Fox, CBS, and NBCUniversal to wait at least until she holds a hearing on July 2 before they proceed with their copyright infringement and breach of contract cases against Dish in California. The satellite company beat the broadcasters to the punch last week: It asked the New York court for a declaratory judgement that says the ad-skipping feature in Dish’s Hopper DVR is legal just hours before the broadcasters filed their suits at a U.S. District Court in California. “DISH looks forward to presenting its case and prevailing on the merits,” says Dish General Counsel R. Stanton Dodge. And Fox says that “we look forward to making our case in court against Dish for copyright infringement and breach of contract.” Dish contends that its ad-skipping feature simply automates things that DVR users can already do. The broadcasters say it’s a departure from the norm that could undermine free TV. Swain was appointed to the court by President Clinton in 2000.

Who are they kidding? Comcast and their cronies made TV stop being free a long time ago. Now it’s all about tussling over retrans fees and all the consumer gets is blackout threats and higher cable subscription bills. If I’m paying for your crummy channel, least you can let me do is skip over the ads that I’ve already paid a subscription fee to watch.
Dish let them sue we already skip them now useing our DVR’s if we need to keep pushing forward through them it will be worth it not to have to watch so damn many.
I’m a college student from NC. As a viewer, it sounds like the ad hopper is a good thing. As someone who wants to work in the industry, I think it’s terrible. NBC, CBS, and FOX (and Disney) own the content. It’s made possible because of commercials. I think we can all tolerate fastforwarding our own commercials…
One, they are using the public airwaves. Two, Dish is already paying large sums of money to retransmit what anyone can pick up for free with an antenna. Three, the DVRs from all of the cable/satellite companies can already skip commercials and the broadcast companies have never sued them over it.
I love the new Auto Hop feature on my Hopper! It’s nice to be able to get off of my shift at Dish and go back and watch my primetime recordings in half the time. The Auto Hop feature saves me some time.
I will take this a bit further. If I’m able to read between the lines, in theory, any company that provides a DVR services could be suited next. Majority of the people who watch any programming record their shows, and yes fast forward thru all commercials.
Its about time ABC, CBS, NBC and FOX wake up and realize not only do people hate their commercials but are getting frustrated their shows has been shortened and amount of commercials extended.
Why not provide the general public the ability to watch Prime Time programming commercial free for a small fee, similar to HBO.
