AMC and Cablevision’s breach of contract case against Dish for dropping the long defunct VOOM HD channels has been kicking around for years, but now is due to go to trial in September. And the smart money is starting to bet that Dish will settle to avoid being creamed in a case where the plaintiffs are seeking to split $2.5B in damages. That was one of the main drivers behind this morning’s decision by Susquehanna Financial Group’s Vasily Karasyov to raise his rating on AMC shares to positive from netutral, and his price target to $49 from $42. His company’s litigation analyst, Thomas Claps, says that Dish “is facing significant headwinds” as a result of two pre-trial rulings “which could cripple its liability and damages defenses.” The judge in the case has decided to tell the jury that Dish “destroyed potentially critical evidence in the case” and say they can infer that the evidence “would have been unfavorable to Dish.” In addition, the court will not allow Dish to include testimony or a report from its main damages expert. As a result, Karasyov believes Dish will settle — possibly before the October season premiere of AMC’s popular series Walking Dead — with the satellite company paying far less than $2.5B but resuming its carriage of the programmers’ channels including AMC, IFC, and WE.
Bernstein Research’s Craig Moffett also weighed in on the case this morning as he lowered his stock price target for Dish to $26 from $28. He’s now baking in a pre-tax loss of $1B. Moffett says that Dish will have a harder time than it did in its patent infringement case with TiVo using appeals and other legal maneuvers to delay its day of reckoning. The rules are different for a tort case than for a patent infringement one. And under New York State law, if the plaintiffs win, then Dish would have to escrow cash before it can appeal — and pay interest on it, which could be as high as 9%. He’s also betting on a settlement: “Cases involving spoliation of evidence rarely go to trial because the odds are so skewed against the offending party,” he says.


Direct and amc are up for contract in october
I am so upset about this. I am cancelling Dish and the contract better not be able to stick because when I signed up, AMC was part of the package and that is what I watch. I may miss my favourite show Breaking Bad now and I am so upset. I’ve been waiting for this for a year and this is f*#*#.

I’ve been a Dish Customer for over 12 yrs but after this B/S, I too am looking into Direct TV. My brother, daughter & coworker have Direct TV & I haven’t heard anything negative. I don’t watch Breaking Bad, but am concerned about missing season 2 of Hell On Wheels!
I had Direct TV for about 7 years until moving to a new area and new house. In this area Dish was more popular so I went with them. There really is no difference in price, what is different is Dish offers the dual receivers and Direct TV does not. This saves a little money because I have 2 tvs on each receiver and you can still watch whatever you want in each room. I was going to switch back, but they have dropped 17 channels due to a dispute……te people I know with Direct are complaining too.
I want my fav show Breaking Bad show Shit Network! Bring back AMC!!!!! What a dumbass move to drop AMC and Breaking Bad…Dish! Can’t believe I’m in a 2 yr contract with this company…sucks!

I am very upset with Dish, they informed me that I would be able to see the final episode of “The Killing’. I am die hard Breaking Bad fan and am furious. I noticed they cut our viewing buI they sure didn’t cut my 113.00 bill for not giving me the channels. i was going to switch to Direct TV and they have dropped 17 channels due to a dispute. This is ridiculous…..there is no solution except to go to cable and to be honest i do not like cable.

I have dish network and I love it. I’ve even talked quite a few people over the years to convert, but I haven’t had a show that I have been so much into as “THE WALKING DEAD” in a long long time. (probably not since “STAR TREK TNG”) I really hope they get this worked out soon, because when it comes down to it, I’m a bigger fan of the shows I watch on my t.v. Than I am of the company I pay to get me good service. I’ll write my check out to someone else if I have to!!!

I didn’t notice my bill going down any with less channels
I just signed up for dish network it’s coming tuesday now I’m going to miss 1 of my favorite shows the walking dead I hope dish network comes to terms with amc real soon because it’s not fair to their customers to miss 1 of there favorite shows
Correct me if Im wrong, but when you sign up your DISH, you pick a package that has individual channels listed for a certain price (they are not a la carte, but you pay a certain price depending on what package of channels you choose). My channel package had AMC listed as a channel, now I no longer have that channel but I still pay the same amount of money as if I still have all the channels in my line up. How is that not a breach of contract on DISH network’s part with everyone of their customers that received DISH and grounds for a class action lawsuit? Of course if this court case has taught us anything about DISH is that they’re great at breaching contracts.
I agree that its wrong to be removing these channels. Especially when you require customers to sign a contract and you agree to provide the serivces to them at that time. I am still paying the same amount I was prior to these services being removed. Its corporate BS.
Good luck with that!! No one ever reads their contract. Direct tv has ridiculous prices. Your bill will change 3 times in the first year alone. Oh, and I hope you love the Sunday ticket, because you will pay for it the second year of your commitment… Whether you want to or not. When will people learn; There is no such thing as a free lunch.
Since I signed with Dishnet and made sure AMC was included in my packet back in December, I accused them of breach of contract and am paying them nothing. Don’t know if it’s legal or not but tired of these big businesses stepping on their customers without regards of what we ask for.
I’ve faithfully watched every show and this irks me…. is this a reason to stop our contract with dish?

Just got dish and boy do I feel stupid. I asked when signing up about AMC and IFC and was lied to. If this isn’t resolved by two weeks before the start of walking dead premier I’m doing the switch and never looking back.
I’m not a Breaking Bad fan but SOA and The Walking Dead are another story. If there is no resolution soon I guess I’ll be forced to take DirecTv’s buy out offer and go back to them. When DirecTv had there issue with AMC at least they stayed on air during the dispute.

I am Dish customer at $1475 level per year programming. If Direct TV did not screw up with Viacom at the same time I would have switched to Direct TV. Both satelite idiot companies are so screwed up. I am living in the rural area and I do not have a cable provider as an option.
