UPDATE, 3:38 PM: Hearst Television President David Barrett says that Time Warner Cable’s making “exaggerated and distorted claims” about their dispute. His company wants “a reasonable increase” in line with its programming costs “and the carriage fees now paid to us by Time Warner’s competitors.” It has more than 150 other deals, and that “is the real measure…of the fairness of our proposal.” The cable company “is seeking a significant discount of market-based fees that is neither fair nor reasonable.”
PREVIOUS, 11:32 AM: The breakdown over price affects 13 communities including 2M Time Warner Cable customers, as well as Bright House subscribers in Orlando and Tampa. The stations went dark at midnight; Hearst’s contract expired on June 30, but it agreed to let Time Warner Cable continue to carry its stations through the July 4 holiday. It appears to be a garden variety retransmission consent disagreement: Time Warner Cable says on a web site that “Hearst’s demand for a nearly 300% increase is way out of line. That kind of outrageous increase is unfair to our customers and unsustainable for our business.” There’s no comment yet from Hearst. But it comes at an embarrassing time for Hearst Television President David Barrett: Just two weeks ago he told a congressional committee that blackouts hurt consumers — although he says that broadcasters are not to blame for rising pay TV prices. The impasse could hit ABC especially hard: Hearst provides the network’s programming to Time Warner Cable in cities including Boston; Portland, Maine; Kansas City; Omaha; Pittsburgh; and Honolulu. Hearst also has affiliates for NBC (Cincinnati; Winston-Salem; Orlando; and Burlington, Vt.), CBS (Louisville), and CW (Kansas City and Orlando).
One thing is unusual, though: The cable company says that it’s mitigating the damage by importing signals from other markets. Louisville viewers can see CBS shows from Rochester, NY. Cincinnati viewers see NBC programs from Terre Haute. And those in Moultonborough, NH; Plattsburgh, NY; and Greensboro, NC see NBC from Wilkes Barre. Ordinarily cable operators are not allowed to import distant signals, but that doesn’t apply in markets where stations fail to submit a formal non-duplication notice. Also, the dispute doesn’t affect Hearst’s ABC affiliate in Milwaukee — it’s subject to a side agreement involving Charter Communications.

It would be interesting to see the TW penetration in these markets as a few are also serviced by Comcast which may be used by the vast majority of subscribers.
I thought Time Warner taking over Insight cable to be a good thing but in the past 6 months they have been trying to force the smaller local stations to take a massive cut. Not knowing the area they came in and told WDRB a local acess station that since they werent a big name station like ABC, CBS, or NBC that they had to take a 50% cut. What they didnt know because they didnt actually check was that WDRB carries all of the NCAA Basketball games for U of L and almost everyone in Louisville watches them when they are playing. When they found this out suddenly they changed their tune and backed off, now they are pulling the same stunt on WLKY.
People want to see their local news and local content they dont want to see news from Rochester NY. Get a clue Time Warner.
Cable penetration in Orlando is over 70%, with Bright House serving a vast majority of those viewers. This is nothing short of a catastrophe for WESH/WKCF.
Hearst and time warner need to resolve the issues on broadcasting WXII. This issue does not need to be about money given the economy!!!Get it fixed now!!! No increase to the consumer!!!
Every Time Warner Cable customer should be ashamed of both David J. Barrett and Hearst for this blackout that result in the viewers from being able to watch their favorite shows with Time Warner Cable. I feel that David J. Barrett and Hearst are trying to be like the Neil Bogarts of Casablanca Records fame of the 1970′s disco era, the David Smith (one of the Smith brothers from Sinclair Broadcast Group), the Harry Pappas as part of the Pappas Telecasting Companies, the Bernard Madoff’s, the Enron’s, the Worldcom’s, the Adelphia’s, the Tyco’s, and the Martha Stewart’s, of the 2000′s by letting broadcast greed get out of control so all of the head employees and bosses at Hearst to be able to enjoy carefree lavishly spending to support carefree lavishly lifestyles with luxurious homes, luxurious jets, luxurious cars, join luxurious clubs, and have other luxurious items just to make them very happy then trying and willingness to improve the quality of all the stations they owned and control and making the viewers happy as well. I hope and I wish that David J. Barrett and Hearst get scolded by both by the ACA and the FCC for making the viewers being forced to deal with this blackout because they could not make a deal to get the stations back to it’s customers sooner and with a fair deal with Time Warner Cable. I hope and I wish that David J. Barrett and Hearst is barred from buying and owning anymore TV stations in the future after their final decision to remove the stations from Time Warner Cable. I feel that David J. Barrett and Hearst are trying to bribe like the General Tire/RKO General of the 1960′s and 1970′s by not being very honest of not only the viewers by making them miss the shows on Time Warner Cable and also on themselves. I hope and I wish that the FCC would force David J. Barrett and Hearst to allow Time Warner Cable to carry it’s stations without any interference before the olympics and football season starts, in the event David J. Barrett and Hearst fails to allow Time Warner Cable to carry it’s stations again, then the FCC would force David J. Barrett and Hearst to allow Time Warner Cable to import out of market stations that are very real close to the station being blacked out being affiliated with the same network, in the event David J. Barrett and Hearst fails to allow Time Warner Cable to import out of market stations that are very real close to the station being blacked out being affiliated with the same network, then the FCC would allow Time Warner Cable to carry the out of market station with the same affiliation without any restrictions and also be allowed to continue to carry the out of market station that it’s digital television signal is reachable by a outdoor antenna including both it’s SD and HD feeds on the cable system even after the dispute is over without any interference for 12 whole years to meet FCC rules and regulators. I feel that both David J. Barrett and Hearst are way too busy being the Rebecca Black Friday and Double Take Hot Problems as well as trying be act like the Lyle and Erik Menendez’s as the greedy murderers, the Jeffrey Ireland’s and the Patrick Jones’s as the drunks, the Rodney Dangerfield’s, the John Belushi’s, and the Chris Farley’s as the comedians, the John Robert Ewing’s and the Cliff Barnes’s, the Charles Montgomery Burn’s, the Homer and Bart Simpson’s, the Peter Griffin’s, the Garfield cats, the Cookie Monster’s, the Miss Piggy’s, the Victor Newman’s of the broadcasting industry of not coming to reach a deal with Time Warner Cable to carry it’s stations to the viewers everyday. I feel that both David J. Barrett and Hearst are trying to turn into the 1919 Chicago White Sox’s baseball team and the Southern Methodist University football of the 1980′s to force Time Warner Cable to accept a take it or leave it deal to carry it’s stations. I urge all of the viewers with Time Warner Cable to boycott both David J. Barrett and Hearst right now for making the Time Warner Cable viewers suffer from being able to watch their favorite shows.
In the case of Time Warner Cable Nebraska, Fremont could carry both SD and HD feeds of either KCAU(Sioux City) or KLKN(Lincoln) or both, Columbus, Nebraska City, Auburn, Tecumseh, Table Rock, Pawnee City and Humboldt could carry both SD and HD feeds of KLKN(Lincoln), and Falls City could carry both SD and HD feeds of KLKN(Lincoln) and KQTV(Saint Joseph, Missouri) all from the leading Time Warner Cable headend in Lincoln, Nebraska as a temporary replacement for KETV on those Time Warner Cable systems without any difficulties and any interference from KETV owner and parent.
The simple fact of the matter is that contract negotiations gone awry hit almost every American’s “big red button” as far as triggering a gut response to this. It is because everyone is strapped and just trying to get by. Those with jobs feel stressed and lucky to have them, and those without jobs are anxiously trying to return to work. In comes these “nickel and dimers” (Hearst and TWC), and whoever is wrong or right on the argument doesn’t matter. It comes down to the fact that when everyone is just barely making it in this fragile economy, seeing this kind of business activity is infuriating. Grow up, get your deal done, and move on, allowing us the programming we have paid for.
I think it is ridiculous that ordinary consumers are the ones suffering from this dispute. I pay Time Warner a fortune to watch tv and can’t even get the news for my city. Instead, I am getting local news for PA. I live in NC so I really don’t care what the traffic is like in PA. I hope Hearst loses so many viewers they go broke. WXII is the largest viewed news broadcast in WS, but not anymore. They lost a huge amount of loyal viewers over all of this. I guess Fox 8 will now be my news channel of choice. I hope every advertiser for WXII switches over to other channels as well, which makes sense since their commercials will not be seen with the channel blacked out. Maybe when Hearst sees money leaving the stations, they will be more willing to negotiate. Time Warner puts people under contracts, so we can’t just jump cable providers. Both Hearst and Time Warner are being unfair. They need to think of their customers who are struggling day to day and can’t afford to pay more. We should be able to get our local channels. At least, we do have other local channels that we can switch to. At this point, even if an agreement is reached, I am not sure I would support any station they own.
So tired of corporate greed and this to me is the worst of the worst of corporate greed and we should have a law against blackouts like what we are experiencing here in Maine. Hearst and its President should be ashamed of themselves to make this a money issue and deny the public the ability to tune in to a major networkd like ABC! The FCC should be on top of this now and make the parties come together and come to an agreement for the good of the public. ABC should be screaming that people are not seeing any of their shows such as 20/20 tonight! Shame on all of you!
We have lost ABC in Kansas city& am not happy! Figured it would b worked out by now. Calling around tomorrow to switch from time Warner. I hope time Warner looses a lot if customers! They r loosing us! Hopefully others in Kansas city drop time Warner also!
We are going to switch to direct tv! I can’t believe Time Warner and Hearst allowed Maine to loose the ABC station. It is outrageous.
BOTTOM LINE BIG COMPANIES DONT CARE ABOUT THE CUSTOMER. WISN WENT DARK IN MILWAUKEE. EVERYONE LOSES EXCEPT THE CONSUMER. JUST FIX THE PROBLEM NOW
Its just local TV. We all can and should live with a little less TV. Go outside and enjoy the summer and save your eyes from x-rays all the time.
You can always view local stations with an antenna, no matter what the cable companies do.
The customer is the consumer, they are both the same.
Is Time Warner still trying to make a deal with Hearst. You have
enough money so make a deal. Along with many friends I will be
be dropping Time Warner. To Hearst and Time Warner executives,
SHAME ON YOU BOTH.
TV is for losers without a life. Pull all the local stations. Maybe people will actually do something other than sit around like lazy pigs.
I don’t understand this. Why do people without cable get your stations for free, but cable customers must pay to watch Hearst stations? This seems to be some sort of discrimination, or possibly just another way to make Thea amighty dollar.ABC has been my favorite station. IM sorry to miss the programs, but sorrier that I have to pay to see what others get for free.
Do a web search on “retransmission agreement”. Federal law allows over-the air TV stations the right to require cable/satellite providers to pay a fee to carry their signal.
Providers/carriers contend that it’s wrong in principle for TV stations to require excessive fees be paid for a retransmission consent for a signal available for free over the air. TV station contend that with the heavy investments they make in their stations that the cable/satellite providers should “share in their costs”.
I think the best thing we as consumers could do would be to “fire” our cable/satellite providers, put up an antenna, and sidestep the impasses.
