It isn’t over in the legal battle between CBS and ABC over The Glass House. Despite a number of legal setbacks, CBS is still pursuing its claim that the ABC reality show is a rip-off of its Big Brother. Earlier this week, following a Magistrate Judge’s June 26 denial of a fast discovery process, the network submitted an amended lawsuit (Read it here) in the matter. Similar in many ways to the suit CBS filed on May 10, the 46-page July 30 filing says “consistent with Defendants’ intention to copy Big Brother, Glass House is nearly identical to Big Brother in every way”. Well, not every way. After a judge refused CBS’ request for a temporary restraining order against the new show, The Glass House debuted on June 18 to soft ratings and has continued to stay pretty low ever since. Big Brother, on the other hand, returned for a 14th season on July 12 and, while down from last year, has had strong ratings. This week’s filing comes with several new paragraphs examining Glass House’s mood, tone, dialogue and other elements now that CBS lawyers have been able to watch the show. It also comes with an Appendix of a “Highly Confidential Document” that was “filed under seal pursuant to stipulated protective order”. CBS is pursuing copyright infringement and trade secret misappropriation, as well as breach of contract and fiduciary duty, claims against ABC, the Walt Disney Company as well as the Glass House production company and several former Big Brother producers now working on the ABC show. CBS wants “compensatory damages in an amount to be determined at trial”. The Glass House finishes its first season on August 20. CBS is represented by Scott Edelman, Michael Seitz, Theane Evangelis Kapur and Blaine Evanson of Gibson, Dunn & Crutcher. ABC is represented by Glenn Pomerantz, Jonathan Altman and Carolyn Hoecker Luedtke of Munger, Tolles & Olson.

zzzzzzz… C’mon CBS, stop wasting time & $. Imitation is the sincerest form of television. This knockoff would be quicker forgotten if you stopped giving them exposure by constantly taking them to court.
shame on ABC. Just grow a pair, admit your fault and move on. No one cares about all the lame ABC productions. Duets? Glass House? Major fail!
We do care. The Glass House is pretty good as well as Big Brother. Maybe some similarieties but i like watching both shows and ABC does has good shows as well as CBS. But someone does need to bring back Criminal Minds: Suspect Behavior with Michael Kelly. One of the best shows ever
ABC can show the ratings in court and if Big Brother has not suffered any measurable ratings loss from previous seasons then CBS has zero damages to show at trial. They have not lost any sponsors and their ad rates have not gone down hence no damages. CBS can say their ratings are down from last year but that might be due to the Olympics or other factors. The ratings for Big Brother are still strong so it’s the stronger show. It will be very hard for CBS to convince a jury that CBS has lost money because of Glass House. ABC is still wrong they infringed the copyright and stole trade secrets but what financial loss has CBS suffered from this ripoff?
I’d say it’s more that ABC made money off it, not necessarily that CBS has lost money. As I’m not a lawyer, I don’t know whether they made a profit or not factors into it, but I’d guess that the show bringing in any money at all (either at a profit or a loss) matters since it’s money made on their idea. If they can successfully prove that, of course.
This suit would have some merit if Glass House didnt suck so bad.
I so wanted it to work and you can tell the groundwork is there but in its current form it sucks quite a lot.

News Update to CBS: Why bother with any of this, since ABC’s show is about to get canceled due to dreadful ratings it has demonstrated in the last few weeks time and CBS should worry more about the falling ratings of their own trainwreck, Big Brother, than of a show on a competing network that will get heave-hoed sooner rather than later.
They still made money from it (either at a profit or a loss) which is what I assume is the issue.
The only thing about Glass House that is not identical to Big Brother is that I’m not watching Glass House.
The Glass House is worse than a Chinese knock off of a Rolex.
I can’t stomach this show because it is so poorly done.
Big Brother has nothing o worry about.
