EXCLUSIVE… UPDATE: Sources now tell me that all three female executives
in employments disputes with the Walt Disney Co have settled – including one today. This is many months after the women lost their jobs in a Department Of Consumer Products reorganization set in motion nearly a year ago by Marvel boss Ike Perlmutter who is Disney’s 2nd largest shareholder. Former DCP head of fashion and home products Pam Lifford, former chief financial officer Anne Gates, and former DCP HR exec Susan Cole Hill were all represented by the same attorney with the Pasadena law firm Hadsell, Stormer, Keeny, Richardson and Rennick which has sued Disney in other employee rights cases. According to my sources, the three women, who are all African Americans, referred to themselves as “The Help” – a reference to last summer’s hit DreamWorks movie distributed by Disney and set during the civil rights movement about black maids in Mississippi.
The reorganization took place in September 2011 but the negotiations for the exit settlements dragged on. Some insiders claim the law firm didn’t return Disney’s calls because it first wanted a story damaging to Perlmutter to appear in the media. An article appeared on Thursday, and Disney and Marvel and Perlmutter now are in damage control mode. Financial Times LA-based correspondent Matthew Garrahan broke the news about these three African-American female execs, their respective job status after their boss Andy Mooney was replaced as the head of DCP, and their hiring an attorney. At the time he wrote that only one of the three women had settled with Disney.
But the FT story also reported that, when African-American actor Terrence Howard was replaced by African-American actor Don Cheadle in the role of Colonel Jim Rhodes for Iron Man 2, ”Perlmutter apparently told Mr. Mooney the change cut costs. He allegedly added words to the effect that no one would notice because black people ‘look the same’,” Garrahan wrote. A Marvel spokesperson told the FT in a statement: “Mr. Perlmutter and all of Marvel have a long record of diversity in the workplace and on movie sets around the world as evidenced by both Mr. Perlmutter’s own history and Marvel’s management team.”
There’s also conflicting descriptions of a formal complaint with Disney
Human Resources about Perlmutter filed by former CFO Anne Gates before she left the company. Several sources told me it was a racial complaint but others say it wasn’t race-related.
The last thing Disney wants is bad press about the reclusive (Forbes found this 1985 photo, right), opinionated, parsimonious, and incredibly successful 69-year-old Perlmutter. (The Los Angeles Times, ever obliging to advertisers, didn’t even mention the FT accusations in its clip-job story about Perlmutter appearing later Thursday.) Perlmutter’s influence inside Disney is gigantic ever since his $4B sale of Marvel to Mouse House CEO Bob Iger in 2009. I reported back in April that one of the reasons Rich Ross was summarily fired as chairman of the Walt Disney Studios was because the Marvel Entertainment CEO was a very vocal detractor. The comic book, TV, and film company boss is a notoriously tough customer eager to back-seat manage everything. (As I quoted a source saying in April: “Iger has real problems. Bob thought he could handle him. But Ike is uncharmable.”)

High-ranking Marvel sources today tell me that the FT‘s implication that Perlmutter is racist is ”proposterous”. The insiders also claim, about what Perlmutter allegedly said to Mooney, “he [Mooney] never complained about it at the time and then only 5 months later”. Other insiders acknowledge that “it looks bad” that the African-American trio were reorganized out of their jobs but claim the FT‘s information is coming from “disgruntled employees” who have tried to “peddle accusations against Ike” to other media outlets for many months. Trying to give me some context about Perlmutter, one insider made the point that he was “of a different generation and an Israeli immigrant and owner of a private company” whose blunt style is at odds with a public corporate environment like Disney. But these people who know him all flatly deny that he has demonstrated racism.
It’s not unusual that the budget-obsessed megalomaniac Perlmutter who many consider a merchandising and toy licensing genius was behind the Disney DCP reorganization because of Marvel’s huge importance to Disney’s future fortunes. (Jeffrey Katzenberg did similar when Universal began to distribute DreamWorks SKG product and when Paramount made the deal to distribute DreamWorks Animation toons.) Sources tell me Disney’s DCP needed reorganizing because it was still in ”High School Musical-Hannah Montana” mode. To ramp up for Marvel’s aggressive release schedule, Perlmutter approved the replacement of Mooney with Bob Chapek, Disney’s former home entertainment head who helped secure Hollywood’s adoption of Blu-ray discs, and DCP’s top licensing job to Marvel exec Josh Silverman. Now DCP focuses on its big TV/film franchises rather than individual product categories.

According to the FT, many executives moved on after the reorganization. Gates and Lifford both were offered lateral moves at the same pay. Hill left after her role was eliminated. The attorney they’ve hired and his employee rights law firm are well-known to Disney. Stormer filed a class-action lawsuit last year for employees who worked at its theme park hotel. His firm just this week joined with the American Civil Liberties Union and filed a federal lawsuit against Disney for discrimination on behalf of a Muslim former Disneyland employee for wearing the hijab headscarf at work (read it here).

Perlmutter cares about money. Nothing else. And he is so tight he squeaks. He micromanages everything, right down to Kevin Feige’s Propecia bill. Marvel hotels and pencils are equally counted by Ike. Loyalty? Not when there are dollars to count. His BFF Avi Arad didn’t bring him the Merrill Lynch deal, a stranger David Maisel did. Exit BFF Arad under the very next bus. (Sure, Arad is a laughingstock, but did he deserve summary execution from his close friend?)
It has to suck to have such deep pockets and such deep emptiness. The man hasn’t created anything in his life- he is playing with Stan Lee and Jack Kirby’s toys. But I don’t think he treated the black people badly- he sees only one color and that’s GREEN!
Even behind the green, there is STILL racism. That remark of Perlmutter’s was downright racist.

Sorry, but at least one of those people who settled got everything coming to her. A shame Disney would settle with someone who for so many years took pleasure in firing people herself.
The fact that these people chose to leak this to every media source available before even presenting a case to Disney reeks. I can’t say if their stories are true or not, I am guessing not, but either way, this fails to make them look anything more then money grubbers.
But what if they are telling truth man, than what? Look the other way like it never happened, i don’t think so.
So..long term he may have actually hurt the brand? A story like that has a way of creeping through a community until it is taken as fact. Ask Tommy Hilfiger how it all went down for him.
If it isn’t true, then the libel and slander lawsuits should be coming out of Disney faster than an Oklahoma brush fire.
I wonder if this will have any effect on a 70th year anniversary version of Song of the South.
Well Perlmutter sounds like a real jerk, but it doesn’t hide the fact that DCP was kind of crap and needed an overhaul. And I don’t have sympathy for the trio trying to play on racial sympathies; not only is it cheap and obvious but it’s an insult to people who HAVE actually suffered from discrimination.
Mooney got canned, too; no one writes “WHITE MALE EXECUTIVE FIRED.” And can they even say they were fired when they were offered lateral transfers? The whole thing sounds ridiculous. DCP needed to clean house, and Marvel obviously knows what they’re doing in this field regardless of the fact that Perlmutter is an ass.
Will be forwarding this story and more to Congresswoman Maxine Waters. Just want to make sure she is aware of this outrageous story.
Sounds like all of the comments above hint of Disney robots who drink the Kool-aid. They also have hints of racism, “Black People”, “These People”, “Song of the South”. really? Racism is not just calling someone the “N” word, it comes in many forms and sounds like Disney Execs. have created a new one.
If they cared at all how this would look by firing, excuse me, “Laying-off” 3 African-American Exec. they would have thought about it. They didn’t because they don’t and deep down they do have issues with “Black People”. He could have at least given sometime between the “Lay-offs” but because he is who he is in his core, he didn’t.
So, what do you do when it all comes out? Deny, Deny, Deny until the dots are connected and you are a cat in a corner. Shame on Disney and what it stands for now as a company. This is BAD no matter how you slice it.
Nice to see someone finally talking about the massive cultural struggles with this merger. The already low morale has gotten even lower due to the Marvel takeover and how people are being treated.
I truly wonder if Iger understands that his legacy won’t be one of restoring the glory of the company from the Eisner days, high share prices and smart purchases in Marvel and Pixar. It will be the mass dysfunction and clearly defined battle lines drawn between the clashing cultures of his shiny new toys.
As for Ike’s strong performance at DCP this past quarter, nice to see that single digit sales increases can lead to +35% OI growth. Without firing and demoting personnel, no way will those numbers be seen again.
Well…as a white person,I definitely noticed the difference between Terrance Howard and Don Cheadle. Mainly-Don Cheadle sucked and acted like someone was forcing him at gunpoint to be in the movie.
Although my book, Comic Wars, ends before the Disney takeover – though the new e-book edition does have an epilogue on the 2009 merger – in researching Ike Perlmutter and Avi Arad in depth, and their rescue of Marvel from near-death bankruptcy, I did my best to give a nuanced though colorful portrait of the two men. I strongly doubt that any motives related to race, ethnicity, gender, etc came into play in business decisions aimed at heightening efficiencies and profits.
Dan, your book is one of my favorite behind the scenes stories. I have recommended it to a number of people over the years. I’m glad to hear there is an epliogue in the e-book edition–I need a new copy anyway since my brother-in-law (a Marvel fanatic) refuses to return my copy!
Nikki, you reported that these women were offered comparable jobs but thats not true. Two of the were Executive Vice Presidents and were offered Senior Vice President demotions. One of the women who the FT article says her job was eliminated had to interview for the exact same job and it was given to a white male (Peter Collyer). Spun it however you want, Disney, those are the facts. Something stinks BIG TIME.

Probably to keep stories about Disney-Marvel being racist from being written. If it were three white women in that department that needed reorganizing, there wouldn’t have been as much controversy.
I can tell you that Disney’s merchandise offerings are all predictable and aimed at kids and teens. For the Marvel collectibles market, the audience is mainly adult, and you need some exciting, quality stuff to bring in revenue.
So everyone’s got it in for Ike, hmmm well let’s see…

Could it be that the three people involved were responsible for running a lackluster dept in Disney? Yes
Is it bad that Ike watches the bottom line? No
Is Disney’s stock he highest it has ever been? Yes
Does Bob Igor run a tight ship? Yes
Can you please all he people all he time? No

Not necessarily a race thing, but racism did show its ugly face.

You assume too much there friend without excepting the fact that this is a possibility, and if it is than drastic steps better be taken on this Ike Perlmutter guy period. Either way the truth should come to light and be dealt with.
There has been no factual evidence presented that Ike’s decision was race related. Bottom line is all Ike cares about and so financially initiated yes. People are too quick to paint people in a bad light because they are successful and can sometimes be ruthless. Being ruthless ia a part of business, this doesn’t make you a bad person, a racist, a homophobe, devil worshipper or devil incarnate. If it were three white people fired would we even be having this conversation?
Apples to Oranges comparison on profits as well… The 2010 DCP financials did NOT include Marvel consumer products. The 2011 quarter comparative showing +35% growth includes both Disney AND Marvel, so the “growth” is artificial, folks. Wait a year and watch the numbers slide into double digit declines. Rumors abound that big licensees like Mattel are screaming bloody murder to Iger, too.
don’t forget the big layoffs and demotions — I mean “retitling” that has gone on. That’s a big impact on OI.
And you’re right about Avengers and Spider-Man tentpole releases impacting the sales and pfogitability for 2011. pretty meager when looking at it.

I worked for Disney once. I told the SVP of HR in my division that one of her underlings had made some quite derogatory comments about being gay. She laughed and said, “Oh, they don’t mean anything by that, just deal with it.” So, I’d say the same thing to these people. But they managed to cash out despite their own lousy behavior.

Facts aren’t all accurate. The place is a mess. Disney should fix and clean up. Replacements for the fired employees have quit in this mess after a short tenure on the job. There is no possible way that Consumer Products is up 35% – either accounting tricks or Lahoud tricks.
They weren’t offered the same jobs… They were offered lesser positions. As for why, maybe because they’re black. If they were white, no one would have thought twice.

Thats always been one of Marvel Studios more WTF? decisions…he was paid so much,and cast so early,that most folks thought he was going to be playing Tony Stark. I can only assume his agent did a hell of a job and the folks in charge of Marvel Studios didnt know what the hell they were doing at first. They were also responsible for a lot of micro mismanagement regarding the sequel as well…and that turned out pretty terrible. Hopefully they’ve worked all the kinks out by now,or will at least trust their talent to do what they do.
Why did slave owners, employ slaves? Answer, for the same reason, to generate money, while at the same time, keeping them enslaved. If you hire someone, it doesn’t mean you aren’t a racist, it can simply mean you are playing politics, or thinking of the bottom-line.

Perlmutter was right to fire them. They didn’t generate enough income so they were useless to him. If they didn’t want to get fired, they should have worked harder which has nothing to do with skin color or race, but with the work ethic of three individuals.
