The class action lawsuit against The Bachelor and The Bachelorette was dismissed today. In a 23-page ruling (read it here), Judge Aleta Trauger in a Tennessee district court granted the motion to dismiss the racial discrimination suit requested by defendants ABC, Warner Horizon Television, Next Entertainment, NZK Productions and the show’s executive producer Michael Fleiss. Football players Nathaniel Claybrooks and Christopher Johnson filed the suit in April to protest that the shows never have a winner “who is a person of color.” The two black plaintiffs, who say they auditioned unsuccessfully for The Bachelor, also wanted an injunction to force the shows to have persons of color as finalists — they did not get that either. “The plaintiffs’ goals here are laudable. …Nevertheless, the First Amendment prevents the plaintiffs from effectuating these goals by forcing the defendants to employ race-neutral criteria in their casting decisions in order to ‘showcase’ a more progressive message,” the judge wrote. Said a Warner Bros spokesman: “We felt from the onset this case was completely without merit and we are pleased the Court has found in our favor”.

First Amendment has nothing to do with this. They should not have sued in Tennessee they should have sued here in Los Angeles where the judge and jury would be receptive to their argument. It’s clearly discriminatory for them to exclude all black contestants.
Exclude all Blacks? I thought it was “people of color.” Last I heard/read, other than white, that means many people other than blacks included. Who’s discriminating here?
It really is one of the “whitest” shows on TV. In the early years they had 1 or 2 sistas in the mix and they never made it past the 1st round. It was kinda sad and a real waste of their time.
Face it guys, Hollywood is an extremely racist and sexist environment full of self serving loons, what did you two expect?
Thank goodness for Freedom of Choice. We have enough crap being forced on us, so, when ya gonna create/develop something on ya own, your own ideas, instead of trying to… well, you can grasp the message. Or can you? Guess ya all can’t. Oh well, at least ya support the lawyers; they could use the money. HeeHee.
I say, this. If the show does not and has not consistently been diverse, stop watching it!! Nielson ratings / votes are powerful. The show is very bad tv anyway. Superficial women, airheads all over, macho jerks, scripted drama to bad music, great locations. There is better tv out there to educated and uplift.
What, they’re upset because of the lack of artificially-inflated racial representation on a fake dating show with fake contestants competing in fake events for the chance at a fake romance?
The only thing real in this entire scenario is the humiliation they would have faced had they won their suit, and for that they should be thankful they lost. That judge just did them a greater service than they probably realize.
Thank goodness the court found in their favor. What a frivolous, ridiculous lawsuit. Not that I watch either of those frivolous, ridiculous shows anyway.
I’m a black woman and I agree with the court. Don’t know what’s wrong with these men – this show is crap.
Freedom, obviously no one has ever denied your self-entitled ass to anything because of your color. Hollywood and tennessee need to catch up to the modern world where people are much more color blind… Even the kardashians are hipper than these dumb shows…
Neutral casting sounds like wave of the future unless you’re white. sorry.
