Author Angela Wilder has sued the network, the companies and some head executives alleging that her idea for a talk show based on motherhood was the real inspiration for the CBS daytime series. “It’s one thing to get sued over a project that was pitched to us, but quite a stretch to be sued over a pitch that was made to somebody else. Ms. Wilder’s alleged offering to Sony played absolutely no part in the creation of The Talk. We’ll vigorously defend this case and expect to prevail,” said CBS today. Sara Gilbert, Sharon Osbourne, Sheryl Underwood, Aisha Tyler and Big Brother host Julie Chen co-host the CBS Television Studios and RelativityREAL produced show. CBS has always said that The Talk, which debuted in October 2010, is based on an idea by Gilbert. The Powerful Mate Syndrome author obviously disagrees. However, as made clear from the seven-count suit she filed on October 17, Wilder never actually met with anyone from either CBS or Relativity – though both are named among the defendants.

In her suit, Wilder does say she met with Holly Jacobs, Sony’s Senior Vice-President of Reality and Syndication Programming in December 2008. Wilder says she brought a TV show idea to that meeting The suit states that at the end of their one-hour together, Jacobs turned down Wilder’s The Mothers’ Hood pitch. Wilder says she left two copies of her WGA and U.S. Copyright Office-registered treatment with Jacobs. “Jacobs and Sony had a close working relationship with RelativityREAL, LLC, and its Chief Executive Officer, Tom Forman, such that Forman, his company, and CBS all had direct and easy access to Wilder’s Treatment during the development stage of The Talk,” says Wilder’s suit. Connecting the dots, the suit also states that defendant Forman “was very well-connected with CBS” who “fully funded” his Tom Forman Productions before he joined RelativityREAL. In her request for a jury trial, Wilder seeks punitive, compensatory, consequential, restitution and statutory damages as well as legal fees and “other and further relief as this Court deems just and proper under the circumstances.” Wilder is represented by Peter Toren and Neesa Sethi of Washington DC firm Weisbrod Matteis & Copley.

Only ABC could sue CBS because The Talk is an obvious ripoff of The View. Sara Gilbert was watching The View one day and she realized she could take the basic format and sell it to CBS since they didn’t have a daytime talk show with five women. ABC should sue CBS to get back at them for that lawsuit this past summer Glass House was also an obvious ripoff of Big Brother.
Well, you can say that Glass House was a rip off of Big Brother, but CBS sure had a hard time proving it in court. They eventually just dropped the suit. Talk show rip-offs are even more difficult to prove, which is why you rarely see lawsuits among them. (Should Kelly Ripa sue Anderson Cooper over his similar show?) I don’t think Angela Wilder has a leg to stand on in this instance. If celebrities have a hard time making a talk show work, what chance does the virtually unknown author Wilder have? The suit is a non-starter. She’s probably hoping to get cash through a settlement with CBS.

What about “Coffee Talk with Linda Richman”? That predates all the shows mentioned above.
That is a great idea. Lorne Michaels should sue for the rights to CBS and ABC. That way we get ABCBC. (The first two letters belong to ABC, the middle to CBS, the fourth a combo of CBS and NBC, and the last is pure NBC.
Then FOX should sue the living daylights out of NBC because Saturday Night Live stole the idea of using cartoons in a comedy sketch show. The claim, The Tracey Ulliman Show created the idea of using cartoons to put in between breaks and SNL stole that idea in the form of Saturday TV Funhouse. This will lead to FOX controlling everything. I simply can’t wait to see Joe Buck call the NBA Finals and host the Olympics.
At the end of the day, the lawsuit against CBS, Sony, and Relativity has more of a chance to succeed than the above two proposed lawsuits. Saying that “The Talk” was an idea of Sara Gilbert’s is foolish at best. It is more likely that Sara Gilbert accepted one of the slots because she needed work, and that claim was made to promote the show. It could easily be thrown out because possession is 9/10ths of the law, but CBS is in major trouble regardless.

Barbara Walters has said she got the idea of The View from Live with Regis and Kathie Lee. So who should sue who? Besides this format is nothing new. It’s the typical news round-table discussion show but lighter.
How is this. Rip off of the view is David letterman a rip off of jay Leno is jimmy Fallon a rip off of jimmy kimmel? I don’t think so
