That’s what New York Supreme Court Judge Richard Lowe III and AMC Networks charged in court today according to Susquehanna Financial Group’s Thomas Claps. The judge became “extremely animated” and accused Dish of “blatant misconduct and attempts to delay” AMC’s $2.5B breach of contract suit, Claps reports. It seems that Dish yesterday appealed Lowe’s ruling requiring the satellite company to turn over documents that it considered privileged — but didn’t give the Appellate Division a copy of the documents, preventing it from reaching a quick decision. Claps says that Lowe characterized that as “further evidence of Dish’s ongoing, inappropriate conduct in this case” and accused the company of “attempting to ‘spin its wheels’ and delay the proceedings so that the current trial schedule could be jeopardized — and possibly result in a mistrial.” (Earlier the judge found that Dish inappropriately wiped out emails that might have supported AMC’s case.)
The lawyer representing VOOM also said that Dish wanted to delay so it could “gain further leverage” over AMC Networks, whose channels were dumped from Dish in June. Some members of the jury have said that they can’t serve past the end of October; if there aren’t enough jurors then the case would end in a mistrial. But Lowe “indicated that he won’t let that happen, and won’t let Dish continue to delay the case,” Claps says.
The trial will determine whether Dish had the right in 2008 to terminate its 15-year deal to air the VOOM Networks suite of HD channels. The defunct channels, formerly owned by Cablevision, were packaged with AMC when the cable company spun off the network operation this year.


I don’t care who’s at fault or who wins on this case, I just want to take this opportunity to warn DISH that since I’m a fan of The Walking Dead, they’re on a non-walking deadline of Midnight Saturday night to put AMC back onto its roster of channels or I start looking for other providers. Most likely DirecTV since cable around here in central MO is crap.
Contact Dish customer retention. They will make it right. If you have a smartTV, XBOX, etc, they will credit your account to pay for the season on Amazon. If you don’t have any of those, they will send you a Roku that connects via your wireless router and does the same thing.

hey – there are options to watch walking dead – i’m using amazon instant video through my bluray player. dish is paying for the season pass. and i know many others are doing the same thing.

you’re wrong – dish has done a lot of nice things for me. they paid for my season pass to watch “walking dead”. they gave me a permanent 10 dollar discount to my monthly bill (unless amc/ifc comes back – then my bill returns to normal). they gave me the entire season of NFL redzone for FREE! i got HBO for 8 dollars a month and a free HDdvr with 500 hours of storage space.

I have had Dish Network since 1996 and I am frustrated by this situation. I think that they have gone beyond protecting their business and have entered into “sleaze” category and clearly don’t care about their customers. If this isn’t resolved this week…goodbye Dish…hello DirecTv. Despite Dish’s commercials, my package would be significantly cheaper with DirecTv anyway and Dish won’t give “the hopper” to existing customers. Fail.
If I have to miss the season premiere of “ The Walking Dead “ Sunday night , you better believe first thing Monday morning I will calling DISH and drop them.
I hope DISH has to pay through the nose. They breached a contract, they damn sure don’t let their customers get away with that. What makes DISH above the law? They are not any better than their customers. All the customers that dropped DISH after DISH dropped AMC, had to pay through the nose to get out of their contracts. Some customers are still with DISH just because they can’t afford to get out of their contract. DISH needs to know that they aren’t above the law and their no better than the customers they screw over everyday.
I wouldn’t have minded if chanel nine and twenty were taken away. Do you really want a highere price to pay just for two chanels? If you want to pay more that’s fine!!! I don’t mind dish’s decision.
I agree with everyone, I am also a walking dead fan and would seriously hate to miss season 3 opener. But however put, DISH blatant disregard of their customers is disgusting and enough to have anyone pull out and head to another provider.

I am a long time dish customer, when I asked about amc they said they could not tell me when amc would come back, but stated that if I had to purchase any of the episodes of amc programming from amazon or iTunes they would credit my account for each episode purchased. So they may be feuding but they are trying to compensate as well. For the other poster about the hopper, you can get it as an existing customer, I did, but it took a little work.

I sell am a Dish Salesperson. As for the people who are complaining about AMC, a channel no one but elderly ladies were watching 5 years ago. Now they became popular because of two whole shows they became very greedy, wanted a 300% increase which in turn would be paid by the consumers, you, if we would have just settled. Think before you speak and figure out if you want excellent service at an affordable price or to go to Directv and be treated badly and pay way more, than do it. We at Dish are confident you will be back and we will have ya. Be patient, we will get the channel back soon enough, watch it online. Andrea
You got to kidding, Dish and all the other networks charge out the butt for way too many channels that people do not watch. I paid to watch my channels on the network, not online. Pricing for network TV is already off the charts because of corporate greed. There is no good value for my money since I am forced to watch whatever is provided in my service. And yes, I have had Direct TV and do not like their customer service either. And like Dish, they expect you to honor a contract but when you challenge the contract agreement all you get is crap. Contracts with providers is a lousy value when you got to challenge them. A two year contract with any provider is no more than hostage taking and these contracts should never exceed one year so people that are not happy can look at other options. And treating exhisting customers differently from new customers when it comes to equipment upgrades is unprofessional.

Dish doesn’t seem to care about the inconvenience it created for its customers during this entire ordeal. Charlie Ergen thinks he can speak for his subscribers and dictate what he thinks is of value to them. Well, sorry Charlie! You crossed a fine line… As with many other long-term Dish customers, I’m ready to pull the plug and “hop” quickly to Directv. Charlie, are you listening???…Charlie, do you care??? (Probably not…that’s why I’ll soon be gone!)
I recently switched to Directv after being with Dish since its beginning.. Paid a hefty price to do so and don’t regret it at all.. Evident Dish did not and does not care about its customers.. So looking forward to being able to watch The Walking Dead….

I support Dish in this suit. I actually DID pay for the VOOM HD channels and they almost NEVER updated their programming. The same shows and concerts over and over and over again. They promised Dish they would spend at least $100 million per year on new programming and then tried say that things like upgrading their executive offices counted toward their spending requirements.
They broke the deal….not Dish.
I understand your point of view. However, Dish has decided to use its customers as pawns in its court battles. I don’t pay a monthly fee for this kind of lousy treatment. BTW, I’ve been a Dish customer ($150+ per month) for over 10 years. I’ll take my business to Directv and give them a try since Dish doesn’t care about its subscribers. I’ve grown tired of their extremist CEO at the helm who disguises his greed by using his customers as pawns.

I called and asked for a hopper….they came the next day! A Sunday! I had no problem getting one as an existing customer.
have had dish since ’99. they’re the obvious of corporate bullying. i hafta say i was optimistic of this being solved before the ‘walking dead’ season premiere, so much so i opted to upgrade to their latest receiver and they tacked me on a 2-year contract.
im thinking i can get out of it by reporting them for false advertising. in their dish promotion, in their channel package offer they specificly advertise they have amc. its there in print. just sayin, it might be a way out if you’re as fed up with this as i am…and by all the comments ive read over the past few months…
I did drop dish yesterday. Went with direct.i now have more channels, more hd and at a lower cost now and in 24 months
you may have a lower cost for the first year – then see what happens to your rates. btw – direct doesn’t have more HD nor more channels.

I hope dish network has to pay out the ass for breaking there contract & pay extra fee’s for draging out court case. I’ve personaly have been screwed my dish too. I was charged for six month’s of satilite service’s that i never recieved. My satilite had been turned off. Dish said, that they didn’t recieve my payment. So they turned it off. My husband alway’s check’s our mail. He forgot to save our bank statement when it finaly came to our house. We had moved and our mail was coming to right address for a while. I got our bank statement 6 month’s later. It showed that dish network had received there payment every month. When i called them about it. They never offered to fix their problem. Instead they just lied and blew it off. Now this crap with losing amc is bull****! Im pissed. Iv’e been watching walking dead since day one. I wish i could change service’s- theres no chance i can get cable. Live to far out. Can’t afford direct due to their contracts. We don’t have really any other choice’s. Due to lack of no service. Dish network suck’s! !”!!!
Sorry, but I worked there for 4 years as customer service. You, in sales, know nothing about how any works because you just say whatever you have to get your sale. Then a month later when they get their bill, we have to explain everything to them because lied through your ass to get them hooked. That 300% crap is the same script Dish passes out for EVERY channel drop. I know because I’ve read it to customers 1000 times.
suuuuuuure you worked there. your notion that every customer is told there is a 300% markup is NOT true. i’ve heard of different increases for different channels over the 10 years i’ve been a customer.
Dish should have at least came up with a solution with AMC as to allow their customers continued access to the AMC channel, such as paying a $10 monthly fee per customer for the channel, considering HBO is like $15 a month, and to watch the episodes on VOD would be well over $20. Just doesn’t make sense….
who in the he11 would pay 10 dollars a month for amc channel pack? i enjoy amc and ifc but wouldn’t pay 10 a month for them.
…and another thing, DONT blame Dish….. at first I did, but after watching this go on for months…. AMC actually making web pages to downgrade Dish, then when AMC found out that the Dish Customers would be going to Amazon thro their Roku that Dish sent them, to watch The Walking Dead, they actually uploaded the 1st episode to iTunes 3 hours before they uploaded to Amazon, now AMC is punishing their Fans, NOT Dish!!! The fans wanted to pay $2-3 an episode on Amazon, and still was screwed. Just don’t seem right! Contact AMC and complain!
