Friday Night Lights creator Peter Bergwants the GOP presidential candidate to stop using the expression “Clear Eyes, Full Hearts, Can’t Lose” from his former NBC show. Berg’s letter comes just days after Buzz Bissinger, who wrote the book upon which the series is based, announced that he was going to vote for the Republican ticket. The request also comes just a couple of days after Sesame Street‘s production company asked President Obama’s campaign to take down its Big Bird-themed ad taking Mitt Romney to task for his plan to cut funding to PBS. Here’s Berg’s letter he sent to Romney today:
Governor Romney:
I created the TV show “Friday Night Lights” and came up with the phrase “Clear Eyes, Full Hearts, Can’t Lose.”
I was not thrilled when I saw that you have plagiarized this expression to support your campaign by using it on posters, your Facebook page and as part of your stump speeches. Your politics and campaign are clearly not aligned with the themes we portrayed in our series.
The only relevant comparison that I see between your campaign and “Friday Night Lights” is in the character of Buddy Garrity – who turned his back on American car manufacturers selling imported cars from Japan. Your use of the expression falsely and inappropriately associates “Friday Night Lights” with the Romney/Ryan campaign. Mitt, we all wish you and your family all the best. We are grateful for your support of our beloved show, but we are not in any way affiliated with you or your campaign. Please come up with your own campaign slogan

Unless they trademarked the slogan, Burg can’t do a thank about it.
Um…actually, yes, I think he can, as it’s protected under WGA guidelines. It’s not in public domain. It’s no different than when Springsteen told Reagan told to stop using “Born In The U.S.A.” or any number of different political grabs at taglines. And the courts have always sided with the artist.
And if Burg had actually WRITTEN the line himself, instead of curbing it from a high school football program after thinking it sounded cool, you’d have a point. Considering it’s at the very least 50 years old, I’d say he’s up litigation creek without a paddle on this one.
It is of course IMPOSSIBLE to stop people from using a popular turn of phrase in public. What a silly complaint.

But as it stands, when that slogan is used for marketing, people country-wide immediately associate it with FNL. And that sucks.

Mr. Berg don’t be fooled by the Headline’s of that report, rather read the article and then review Obama’s plan. I know Pete is used to headlines, most of which don’t live up to the final product.
