Two aspiring show creators launched a lawsuit against TruTV today for supposedly lifting their idea for a series about shoplifters. In their suit (read it here) Harry Dunn and Steven Bloch say that in March 2008 they pitched TrueTV a show called Hands Off The Merchandise about identifying and catching shoplifters for retailers. Actually, the duo, who say they came up with the idea for the show, didn’t actually engage with the network. Producers Scott Hallock and Kevin Healey, with whom Dunn and Bloch signed a collaboration agreement, did that for them. In 2009, after various meetings and “enthusiasm,” as the suit puts it, on the network’s part, TruTV told Hallock and Healey that they were going to pass on the idea. The producers passed the bad news onto Bloch and Dunn.
In February 2012, TruTV ran a special called Caught Red Handed. The network plans to air a series of the same title starting on November 6. “Caught Red Handed follows a team of undercover store detectives as they help large stores hunt down the boldest and most cunning shoplifting suspects,” says the TruTV website. “The idea, concept and format of the CRH Special and the CRH Series are identical to and indistinguishable from the HOTM Concept, which was created, developed and is owned in its entirety by Plaintiffs,” says the plaintiff’s complaint. Dunn and Bloch want the court to issue an injunction to stop Caught Red Handed from going to air right away. The suit cites a number of counts including breach of contract and misappropriation of trade secrets. In their desire for a jury trial after an injunction is granted, Dunn and Bloch are seeking a full accounting from TruTV plus unnamed punitive, compensatory, and exemplary damages. They also want any profits the network may have made from the as-yet unaired series and all legal fees and “other and further relief as the Court deems equitable.” Hallock and Healey, whose production company is behind Betty White’s Off Their Rockers and Syfy’s Scare Tactics, are not named as defendants. Bloch and Dunn are represented by Randall Fink of LA’s the Law Offices of Randall Carlyle Fink.

Considering Kevin Healey’s involved in this case it’s not surprising. He’s untalented and unethical– ask ANYONE who worked on OTR, that Betty White train wreck that has further embarrassed NBC’s legacy. The plaintiffs in this case deserve to win, and Kevin Healey will hopefully be forced to return to doing what he does best– unwatchable low budget Canadian crap.
Contrary to the comment made by the wildly untalented Chris Coelen (or one of his lackeys), I’ve worked with Kevin Healey and he’s a stand up guy. Talented, collaborative, even keeled, and selfless with the credit. The fact that he’s NOT named in this suit further reinforces that. I’ve also worked with the egomaniac Chris Coelen and found the development process miserable. But personal gripes aside, the real bad guy here is the network (shocker). They stole an idea they should’ve paid for.
We once pitched a cable network a specific reality concept, complete with arcs, characters, etc. They passed. Two weeks later, they announced they were doing the same idea under a different name. Produced by a love interest of one of the cable execs.
Our lawyers said “welcome to reality TV. You don’t have a script, just an idea, and ideas can’t be protected.”
I wish these two writers the best. Hopefully they have more aggressive attorneys than I do.
I hope these guys win….and win big. The majority of reality execs in this town are generally two-faced, lying, cheating scumbags. Don’t get me wrong, there are some class acts, but they are few and far between. Recently, one of my shows was pitched to a major company, and the first words out of their mouths was, “Oh, we’ve got something similar right now…”. Then when they couldn’t get it off of the ground on their own, they picked up the show a month later. I’m beginning to find that this is standard practice in this town. Say you have something similar after the pitch, keep you on the hook for a bit, and when they can’t make it happen on their own, then they want to work with you. Protect yourself people, and keep a chain of correspondence, and copyright all of your ideas.
C’mon, guys, get in the business. TruTV has built an entire network around that kind of show. “Catching Shoplifters” is NOT a format or a protectable idea AT ALL and this will only lead to more insidious pre-pitch release forms like Scripps requires. These ass-clowns who are suing have probably never produced the opening of an envelope, and now no self-respecting network or production company will every take their pitches again, and no agent will represent them. Idiots. I hope Tru doesn’t settle and sues them for legal fees. The only way to protect reality ideas is to attach a produced format or talent. Everyone who makes these shows regularly knows that. Why? Because that same “Catching Shoplifters” idea has been pitched by numerous producer to numerous companies dozens of times.
You’re a moron and you should read the actual complaint. They have an excellent case and Tru will settle very fast. Tru entered into extensive negotiations with the plaintiffs then when the plaintiffs wanted more than Tru was willing to pay them Tru decided to pass on the project so they could steal the overall concept. They figured they could get away with it and save money by ripping it off. Now they have to spend more money on legal fees and the settlement will cost them more. These guys are going to win if this goes to court that’s why it won’t ever go to court.
I was employed as an actor by the production company which produced the program and had a blast. And I was well paid and treated with respect and appreciation. I hope justice is done however that pans out and most of all, I hope it airs!

Just because Tru entered into negotiations with them doesn’t mean squat. Haven’t you ever heard of Defensive Buying where people buy things simply so other nets dnt get them? Meaning that they buy something they are planning to do or may want to do andndont want another idea thats similar out there. If I were running Tru I would counter sue them for stealing from the highly successful Caught on Tape franchise that has been airing for YEARS And Turner has the legal muscle to flex just to teach a lesson. . How about stop the cry baby shit and come up with a more original idea that isnt derivative of an existing show on the very network your suing. Having been in business with Tru for years these people are smart loyal and above all, honest and anything to the contrary means you don’t actually know the people reallybrunningnthe network and are being sideline haters. What would Les Grossman do?

You guys let the shoplifters go out the door and get away. You need to have someone closed to the door so when shoplifter goes out the door you are right on top of them. You are watching the camera and they are going out the door before you leave the camera. Set someone at the door or better yet put someone outside of the door. Cock block them as they run out.
