Short-lived The X Factor judge Cheryl Cole today sued producers Blue Orbit Productions for more than $2.3 million. Even though she was dumped from the show before it debuted Stateside, Cole claims that she is owed the money under the pay or play contract she had. The British host and singer says in her Breach of Contract suit (read it here) that while she was paid $1.8 million for season one of the U.S. X Factor, it is the money for season two that she is seeking now. Cole served as a judge on the UK version of X Factor and was imported by Simon Cowell to serve as judge for the debut season of the American version of The X Factor. That never really happened. Cole was replaced by Nicole Scherzinger before the show even went to air. “On June 5, 2011, Blue Orbit formally elected to exercise its pay or play right pursuant to the terms of the Agreement, such that Cole was not required to perform any services as a judge on The X Factor series,” says the complaint. Besides her $2 million fee as a judge for season two, Cole is seeking the additional $300,000 for wardrobe, stylist and living expenses she says she is owed. The X Factor is currently in its second season with Scherzinger having herself been replaced by Britney Spears as a judge on the show. When Cheryl finally lost her temper with Simon, she yelled, “My lawyer will call your lawyer!”
And Simon whimpered, “I don’t have a lawyer. Have him call my doctor.”
So now Woody Allen is suing Simon, too.
Normally I would be angry at the person sueing, but the way she was treated by cowell was dreadful. How humiliating must it have been to be fired after a few days of work, in a foreign country, I’m a fellow Geordie and we have to support our own.
From all I have read and seen of her on the UK version, I think she would have been good on the US show. Cheap since she was unknown and I think her good looks and accent and her chemistry with Simon would have endeared her to US viewers. IT was dumb to replace her with Scherzinger who I actually could see as a better co host (definitely better than Khloe and SJones was a disaster too)…And putting Paula was Idol 2.0 and everyone shouldve realized that. Of course Simon didnt fire himself or the obnoxious LA Reid. Simon really doesnt add much to teh show -hes not the same judge as he was on Idol and hes just boring. Its also fishy when hes a judge/mentor with a stake in his acts and the outcome and yet is the creator/producer whos making decisions on ‘fake drama’, editing and major decisions like the whole (mistake) of doing the on air rankings…and now hes already said hes going to sign Emblem 3 regardless – shouldnt comments like those wait until the end of the series? Its obvious if E3 doesnt win, he wants Carly — He doesnt know what the heck to do with a country artist…and Carly – who has already done TV, movies and stints on Broadway – is ready to go. Considering no one from season 1 has broken through, he needs a success or it does seem like Idol is the only show to produce chart topping singers…Now who won the VOice?
The question is – how horrible she was that her friend Simon had to fire her…

The X Factor made a huge mistake letting Cheryl go, and the show has lost its spark ever since.
I hope she gets every penny possible. They really screw her over. The few times she was actually on the American version she was by far the best judge there. Then they replaced her with that disgusting Nicole Schericigiciznzcer who completely ruined the show by kicking off the best contestants just to spite other judges.
Definitely siding with Cheryl on this one. A full contract pay out should have been a given in the first place with the way she was treated.
Cheryl was the reason X factor in the UK was a hit. She relocated to the states only to be humiliated in a hugely public way. If her contract says she should be paid then she should be paid.

Actually, the show was a hit LONG before she was involved with it. That, and the fact that it was (and is) basically “Pop Idol” with a few adjustments – it pretty much replaced “Pop Idol” when the US version “American Idol” supplanted it.
Shes lucky she got paid over $2 million without having to do anything – How many people would DIE for that opportunity. Regardless of the mertis of the lawsuit, she shouldnt be entitled to hair and makeup fees…thats just ridiculous. Salary is one thing but living expenses and perks that she never even had to use is just absurd.
I still want to know the backstory of why she was fired. Nothing makes sense – and it cant be the accent thing…Some say Simon thought there were too many Brits with the addition of Steve Jones too but that doesnt make sense. Cheryl is probably mad cuz this was her big chance to break into the US market, which she probably wouldve done. She couldve become Americas new IT girl..Thats probably why the salary was low as she was a total unknown here…but then so was Simon when Idol premiered.
But this whole suit leaves a bad taste…If her contract was for 2 years then she should be paid but otherwise, just go….Ironically Scherzinger, her replacement, was fired…and yet then turned up back to the UK show to replace Kelly Rowland. THe UK show is much more popular than the US version which really has sucked this yearThe show has never really made the transition to the US.
She should be paid her salary according to her deal, but the extra 300 grand for wardrobe and stuff is not necessary. but any way to stick up Cowell’s ass is always a good thing and happy this show is tanking.
Good for Cheryl! She moved to a new continent for the show and planned months of her life around it after being EXTREMELY successful with the UK format only to be dropped after two rounds of auditions.
The reason she was dropped was because the nearly washed up JLo proved to be likable and had a career resurgence on Idol and then The Voice surprised everyone signing A Listers and being successful so they dropped Cheryl who was a “name” her in favor of C Lister Scherzinger.
How hilarious is that FOX dropped all of their female mentors to twice as much as their salaries COMBINED to sign Britney and return to LOWER ratings! They have done a spectacularly terrible job with the launch of the show.
Cheryl is owed money due to the expenses her contract incurred and I hope she gets every cent because she’s already sweet victory with the show flopping.

It’s always funny to read comments from her fan on sites. Like she is the best in the world and how much everybody lost when she was replaced… She is not! I am not a british person. I don’t know her. Except that hit song Parachute. I saw that she was looking pretty in pictures with ton of makeup on her face. We all thought that she was some smart english Lady. Like Kate Winslet, Helen Mirren and other actresses who speak so cool with their English accents.
But then we watched her two episodes on X Factor US. She opened her mouth… and she was no english lady. She was more resembling Kelly from Misfits
I’m sure that’s why she was fired. This is no UK. This not your “home town”. That is USA, country where no one knows Cheryl Cole. She was just uncomfortable to watch with her funny accent. I understand why they fired her. If she wanted to succeed as US judge – she should have get rid of it. English actors can speak with American accent easy when role requires them too. She can’t speak even English properly!
And no – X Faftor did’t lost anything without her. What do you think she would join and X Factor would miraculously get 15 millions viewers with her? Producers made X Factor US a good and entertaining show. But somehow Americans won’t watch it. Just like they don’t want to watch football (real football that they call soccer). It was publicly embarrassing for The X Factor to have to fire her and disruptive to the show. It would have been a tough decision to let her go and whatever you think of Simon I do think he felt bad for her (after all he gave ‘second chances to Paula Abdul and Nicole Scherzinger. The guy’s a shark but he seems to have a loyalty thing for many of the women he works with – and dates)

HEY Simon you PILLOCK you made one big mistake firing Cheryl from U.S. X Factor. she was great as a judge on the show, Cheryl deserve every penny she get from you, what what you put her through.
Reading these comments is hilarious. First of all, US X Factor is a hit in my eyes. This show is in no way tanking. After all, it got a 3rd season for a reason. Secondly, for whatever reason, Simon had different choices for the US show than bringing someone over from the UK version. It sounds to me she’s crying over spilled milk. If she didn’t go through this, she might already have another job. And now no one going to hire someone that’s going to sue because she got fired. She still got paid $2 million without being on one show for season 1. She didn’t have to do anything. I’d love to get paid that much for not doing one single thing at my job. She needs to get over herself. Simon Cowell felt like he wanted to go a different direction and he did. Nothing wrong with that. If it was in her contract, then they have no choice but to pay her the money and they did that in season 1. But to say she wants makeup expenses, ect is going way too far and she needs to take her $2 million and run with it. I don’t care how good she was in UK but the way she’s acting is ridiculous.
It doesn’t matter if its a ‘hit’ in your eyes because in Simon’s and FOX’s eyes they made mistakes with the judging panel and host and fired almost all of them to turn around, spend tens of millions more and see the ratings drop by close to 40%. I don’t think your eyes would realistically see that as a hit.
Se also not ‘acting’ ridiculous, she REacting to their decision the contract they offered her and signed. Her suing based on the contract is no less ridiculous than them firing her be cause that too was also in the contract. She has rights to pursue this and based on the show is showings no signs of it being the heir apparent to Idol she better get the money while she can because its lucky to last beyond the 3rd season.
First of all, it doesn’t get a 3rd season if it’s not a hit. And the reason they fired the judges and Steve Jones is because it wasn’t working out. The way I see it is she’s crying like a little baby just because she was let go. The X factor is by far better than idol and all they’re doing is trying to find the right fit. So what, she got let go, people get let go in real life all the time and they don’t sue. She got $2 million for not doing anything. People in real life don’t get money at all for getting let go, she did. Stop crying about it, take your $2 million and leave it be. Simon Cowell had a reason, and maybe something happened that he didn’t like. That’s the thing, we don’t hear about everything that goes on. He also made a business decision which is what this is, a business. If she doesn’t understand that, then she doesn’t deserve one dime. Letting people go is not easy and I’m sure Simon felt bad. But he felt like he wanted to go in a different direction and as the boss, that’s his right.
