Fox went back to federal court this week seeking an injunction against Dish Network and its AutoHop DVR. Fox Broadcasting and 20th Century Fox argued in a filing with the 9th Circuit Court of Appeals that because the lower District Court Judge Dolly Gee agreed with Fox‘s contention that Dish was infringing its copyright on TV programming, Gee should have also granted a temporary injunction against Dish. Fox noted “The district court found that Dish infringes Fox’s copyrights when it copies Fox programs every night to enable AutoHop’s ad-skipping functionality, and that such ad-skipping functionality irreparably harms Fox.” Despite this, Fox said “the district court held that this irreparable harm did not count because it stemmed from the ad skipping, not directly from the infringing copies that made the ad skipping possible.” Fox contends the district court erred and should be ordered to grant Fox the preliminary injunction. The main drivers behind rate increases are increasing carriage rates and localized monopolies.
I don’t understand this. Does the autohopper skip commercials during the original broadcast of the shows or does it only do it with DVR recordings? If it’s the former then yes, the autohopper does hurt ad revenue but if the latter, it’s a moot point because most people watching DVR recordings skip the ads anyway.

When I first started selling DVRs and would show customers how you can fast forward ahead, my joke was that you couldn’t go to the horse race channel and pick early winners.
so the networks are whining over the loss of ads on their networks
well then stop some of what you have been doing and maybe me and everyone I know will watch “live” tv again– as for right now everyone I know is at least 1-3 days behind to lose commercials via DVR usage
here is a simple list of what you networks can do
1 put on good shows -enough of the America sings whatever crud its over
2 maybe charge more per commercial minute as back in the day it was about 10-15 min per hour now on some networks its 50/50 TNT- syfy g-4 im looking at you
3 give me back my “full” screen –you guys put ads at the bottom– 1/3 during the show all the time–stop –what is next ads for real products I’d bet!!!!!! you are just trying to get us used to some of our “picture” being taken over–then you will add pepsi adds there soon!!!
