
EXCLUSIVE: Nearly 18 months after Megan Ellison pledged over $20 million for the rights to finish The Terminator‘s humanity vs the Skynet cyborgs storyline with a new series of films, she has finally closed the complicated rights deal with Pacificorp. Other than the fact no progress has been made all this time on a script, the surprise here is Ellison has enlisted her brother, David Ellison, to be her financial and creative partner. There is still no studio attached, but future Terminator films will be done as a co-production between her Annapurna Pictures and his Skydance Productions. The Ellisons will produce, while Dana Goldberg, Paul Schwake and Ted Schipper will be exec producers.

Even though Pacificorp spent $29.5 million several years ago to win the rights after Halcyon turned them over to bankruptcy court, insiders tell me that the big numbers in place 18 months ago have been adjusted downward. That is because of the uncomfortable specter of a ticking clock that has continued to wind down as no forward progress was being made. New copyright laws allow for North American rights to The Terminator to revert back to creator James Cameron in 2019 (that happens after 35 years, and The Terminator was 1984). While that law hasn’t been tested in the courts, no major film company would want to move forward on a project with a potentially catastrophic rights crisis looming. So the original pricey deal — made with the expectations there would be three films — was scaled down because the reality is they might only get to make two installments. Four films have been made so far, the first two directed by Cameron, another by Jonathan Mostow and the last, 2009′s Terminator Salvation, helmed by McG.

Megan and David Ellison are the children of billionaire Oracle founder Larry Ellison and while their professional paths crossed when they were both exec producers on True Grit, they have largely taken different paths in Hollywood. She has focused on eclectic prestige projects like Paul Thomas Anderson’s The Master, John Hillcoat’s Lawless, the Kathryn Bigelow-directed Zero Dark Thirty, the Andrew Dominik-directed Killing Them Softly and the upcoming David O Russell-directed Abscam movie with Christian Bale and Bradley Cooper. David Ellison’s Skydance has been making commercial popcorn pictures at Paramount that recently have included Mission: Impossible — Ghost Protocol, Jack Reacher with Tom Cruise, World War Z, G.I. Joe: Retaliation, Star Trek Into Darkness and Jack Ryan. I would not be surprised to see Skydance take the active hand in development because Terminator is their kind of movie. Skydance makes its movies with Paramount, but I’m told that studio isn’t involved at this time.
The project has been moving in fits and starts, and most likely that has been due to the slow pace of the rights deal. At one point, Arnold Schwarzenegger had been attached, and so was Fast & Furious helmer Justin Lin. Because Ellison expected to put the first of two pictures in production in late 2012, Lin dropped out. Right now, the Ellisons are starting from scratch as they seek out a screenwriter to plot the end.

With Camerons hobby of doing deep sea dives, and his producers habit of crashing on location scouts, I doubt he will be around in 2019 to collect his Terminator rights.

You should look into the WGA reversion. You only have to pay back what you were paid, not any interest or overhead. Contact the WGA about it.
Okay, that much I knew, and I do have a prominent entertainment lawyer who is awesome, but she is also super busy with much more important dealmakers, so I can’t bother her with it right now out of respect.
I will contact the WGA, but they’re often quite unhelpful from what I’ve heard, so my follow-up question is this: I owe 500,000 on the script. But I understand that just like creative accounting, they can say they spent 100,000 developing the script, plus I think my contract does mention interest. So, if they say it would cost 600,000 to get it back, will they accept a lower number if they’re not going to get anything back as it currently stands? I imagine it’s a case-by-case basis, but whether it’s a large studio or mini-major, would someone take $100,000 for the script as opposed to nothing at all? I just want to make the script with some friends, and I’m hoping that they’ll want to recoup $100,000 to $200,000.

You can buy your script back after five years, the WGA will help you do this but you have to reimburse the studio for every dollar they invested in your project. This is a forced turnaround deal and the studio has to give up the rights even if they don’t want to. If no production after five years they must give it back but you have to refund them back all the money they spent on developing it.
As for more Terminator films nothing good will result from this. T3 and T4 were both terrible and the reason Cameron stopped making them is because the complete story was told. T2 was fantastic and nothing will ever top that. Cameron knows when it’s time to stop Terminating.
These sequels are cash grabs and the Ellison kids should spend their billion dollar fortune on better movies. It’s nice that they provide work for people but they don’t deserve to be so wealthy they haven’t earned anything they were born wealthy and they’re spoiled brats. They never had to work a day in their lives and by work I mean earning money to put food on the table and keep a roof over their heads.

Hey, don’t knock T3! While T4 was certainly a letdown, T3 was quite watchable and enjoyable. For the most part he filmmakers found a reasonable way to continue the franchise without violating the premise laid down by Cameron in T1 and T2. (The principal exception was the Terminatrix’s flamethrower.)
Dude go make your script with your friends. You don’t have to get the rights back. Don’t worry the studio won’t come after you provided you do it quietly without any publicity just make it and then give them a chance to buy the completed film from you. If you do a good job on it they will be very happy you did it on spec. Or change it around just enough to make it different from what you sold to them. If it’s a script they have lost all interest in then your going out on your own and filming it won’t be a problem. And if they are stupid enough to sue you for spending your own money to film your own script the publicity from their suit against you will make your career red hot. You will be a hero and if your film is good it will absolutely get released. Stop worrying about the rights and go make your film. Do it quietly and secretly then when it’s done you can make a big splash with it.
I hope they fail and cameron gets it back, or maybe WWE films buys it- they never responded to my tweets to develop an terminator trilogy!
How is this possible when Sophia Stewart owns the copyright and trademark for both Terminator and The Matrix?

So… this isn’t a reboot then; rather, it’s a continuation of the already existing storyline.
Yeah, that’s the way to do it – get all the producers lined up and come up with a deadline that everything has to geared to BEFORE someone starts to think of a creative story.
There is T1, T2 and the film that Cameron and Winston and Digital Domain made for their 3D experience at Universal. The other ones are very lame and cynical attempts to recreate those successes, with virtually none of the inspiration or creativity that birthed them.
Between them, the Ellisons have enlisted a majority of the top talent in Hollywood to admirable effect. I would place my bet on their handling of this franchise over any other financiers out there, except Cameron himself.
Maybe they’ll bring Kagan back? That way Qarlo Clobregnny can say, “Kagan! Dog, dog, dog!”

Time for some new concepts in Hollywood. Enough with the Terminator franchise. It’s been turned out every which way (movies, TV, books, comics). Basta.
The only problem I had with T3, was Ed Furlong wasn’t able to be cast as JC. I didn’t mind the flame thrower,,,
Mcg’s T4 was beyond thunderdome bad! And I’m a big fan of Thunderdome!
There is a T5 and I think it should focus on Connor’s last stand against Skynet (future war) as he and his forces take out the “network” as per Kile Reese’s telling to Sarah in T1.
The 3rd act would be the moment we Terminator fans have all been waiting for, the moment John sends Kile back in time and what really happens to the future after that,,
Shut the hell up a hole! She lost in court with ridiculous claims that were obviously false and now she plans to make a matrix movie with terminators in it. I will laugh when she gets sued if she does so.

I think they need to bring back Christian Bale for a balls to the walls exciting chase to get Kyle to the Time Displacement Equipment to send him back to 1984, as well as Uncle Bob to 1994. Just wrap it up already. Bring in actor Michael Biehn for a digital face implant like how they did with Jeff Bridges for Tron Legacy. What made the Terminator and Terminator 2 so good, was James Cameron’s writing/direction/style AND Arnold, Linda Hamilton and Michael Biehn’s performaces. The four of them together created something really great and really unrepeatable. You will never recreate that same chemistry that everyone had back in 1984/1991.
