Director Nick Cassavetes is being sued by two Canadian singers and their father for more than $500,000 over an alleged loan to the movie Yellow. In their complaint filed today (read it here) plaintiffs John Thomas and TwinSpin Music say that in September
2010, singers Carman and Camille Thomas met with the director in the Yellow production office in Studio City. However, they say the meeting took a wide turn with Cassavetes suggesting not just that the singers have a song on the soundtrack but roles in the movie and a producer credit for their father John. “However, there was one catch to Cassavetes’ pitch – namely, Cassavetes was in need of an immediate short term loan of $300,000 to be used for the development and production of the picture, which would be repaid with interest in the aggregate amount of $345,000 no later than October 15, 2010. Accordingly, Cassavetes represented to “Carmen & Camille” that if TwinSpin would agree to provide the Loan, he would (a) cast “Carmen & Camille” in the speaking roles he had previously identified in the Picture, (b) feature at least one song by “Carmen & Camille” in the soundtrack of the Picture (the “Song”}, (c) provide plaintiff Thomas with a producer credit on the Picture, and (d) repay the Loan and interest in the aggregate amount of $345,000 no later than October 15, 2010,” claims the complaint.
The plaintiffs say they handed over the money but none of the supposed roles or credits ever happened. Yellow does have an another Canadian connection – it debuted at the Toronto Film Festival earlier this year. Now TwinSpin Music and John Thomas want their money back plus interest, legal fees and costs. The singers, who have been nominated for the Canadian equivalent of a Grammy, and their father have requested a jury trial. The plaintiffs are represented by Brian Wolf and David Jonelis of Lavely & Singer.

Well if they got it in writing, seems like a pretty cut and dry case for the singers. If not, it’s a case of they said, he said. But I doubt anyone would be dumb enough to hand over $300K and not have everything in writing… right? Right? Please don’t tell me they trusted someone from Hollywood at their word.
Cassavetes lost the $ in a card game later that evening.
This production has been plagued with gossip and behind-the-scenes financial mischief reported in the trade press, with late & un-paid cast & crew problems. Mr. Cassavetes, when do we finally get to see this “masterpiece” ?
A quick look on imdbpro shows 22-count ‘em-producers of one sort or another. Seems if you’re gonna hand out that many producer credits, what’s one more, esp if the guy wrote a check. Movie sounds bad, too. :-/

Especially a degenerate gambler like Cassavetes…I wouldn’t be surprised if that money ended up as a buy-in.
Maybe Cassavetes should direct the remake of THE GAMBLER… you know, the one they basically stole from James Toback, cutting him out even though it’s based on his life story. …. Seems fitting.
My daughter worked on this movie, and has yet to be paid and apparently none of the actors were paid!! We’re still waiting and yes, there’s a lawsuit over this!
