One of Barack Obama's staunchest supporters and prized campaigners and film biographers from the motion picture and television business has just been accused of union busting, according to a complaint filed Thursday with the National Labor Relations Board. Before the exposé, writer/actor/director/producer/author/playwright Tyler Perry invited the presidential candidate to the grand opening of his entertainment studio on the outskirts of Atlanta, Georgia, this coming Saturday night.
But if Obama attends he will be met by picket lines thrown up by the Writers Guild of America and joined by members of the International Brotherhood of Teamsters, even though the latter union has officially endorsed the Democrat. "This is just the first step. We've got a lot more planned," a WGA insider told me last night, indicating that the Perry picketing may widen to Time Warner's TBS which broadcasts his hugely popular House Of Payne sitcom, and an upcoming TV spinoff of one of Perry's movie's Meet The Browns.
Perry, whose estimated worth is $500 million, is much more than just another Barack Obama supporter. He donated the maximum $4,600 to the campaign. (In fact, he donated $6,900 but then took back $2,300 when it exceeded the limit.) He also has announced plans to make an Obama film. Perry told the press he is already writing, and plans to direct and produce as soon as late this year, a love story inspired by the relationship between Obama and his wife Michelle. (Perry has said he dreams of casting Denzel Washington and Angela Bassett in the lead roles.) It's not known if the Obamas are cooperating with the film, but the idea occurred to Perry after he heard their story when he had dinner with the couple as well as from his close pal, Oprah Winfrey, who is Obama's biggest showbiz supporter but whose own union track record is one of the worst. (Perry this summer traveled with Oprah to Italy. And it was Oprah who recently convinced Perry to write his autobioraphy. In fact Perry credits his entire writing career to the inspiration he received watching the Oprah Winfrey Show.) Perry told reporters about the Obamas, "They just inspired this amazing story. It’s a love story with a little political twist... It’s called For the Love of You and it’s about his love for his woman. It’s going to be amazing."
Also, around the time of the Democratic National Convention this summer, Perry suggested that Obama bring onto the ticket "Madea" -- the recurring character played by Perry in Diary of a Mad Black Woman, Madea’s Family Reunion, and other of his films. "Madea is the running mate -- Obama and Madea, that's it," he joked to reporters. "She's heading up foreign affairs and I think she'll be Chief of Staff so we'll see!"
Perry also has been stumping for Obama, most recently in the battleground state of Florida in front of faith-based groups because of his religious zeal. The entertainment mogul and native Southerner spoke to several hundred people at the New Mount Olive Baptist Church in Fort Lauderdale Friday to encourage them to register and vote for Obama. He said he'd never cast a ballot in his 39 years but recently registered in Georgia because Obama had moved him to do so, "not because Barack Obama is black. That would be a ridiculous reason to vote for somebody. [But because] he is the best candidate and the most qualified to lead this nation." Campaigning in Miami-Dade and Broward counties over the weekend, he gave what he described as "embarrassing testimony" about being one of those people who didn't believe his vote made a difference. "There are a lot of people who think that way. I was wrong," said Perry. But after hearing a speech in which Obama outlined his background, "it became clear to me that finally someone has come along who can relate to hard working people."
Why allegations of union busting against Perry are so embarrassing to Obama is not just because unions are the stronghold of the Democratic Party, but because the candidate had to spend considerable time and effort courting the national unions for their primary and general election support. Most of the union support went to Hillary Clinton and John Edwards in the first stages of the primary, and then began to swing to Obama when Edwards dropped out of the race and threw his support to Obama. That's only when Obama got close to equalizing Hillary's advantage with organized labor. Union support will prove vital to Obama in battleground states with McCain like Ohio, Michigan and Pennsylvania which have hundreds of thousands of manufacturing and blue collar jobs over the past 15 years. Nevada is another battleground state with McCain, and many credit Obama's caucus win there over Hillary to the endorsement he received from the state's influential 60,000-member Culinary Union, which represents Nevada's casino, hotel and restaurant employees, in conjunction with its parent union, Unite Here, which has 460,000 members nationwide. Among other endorsements received by Obama are the steelworkers, mineworkers, and AFL-CIO.
The Writers Guild played a role during the Democratic presidential primary when Obama, Clinton and Edwards all refused to cross picket lines while the Hollywood guild was on strike. (Edwards even visited one huge WGA rally, and Obama was criticized for not attending.) In addition, a CBS televised debate among the Democratic presidential candidates had to be canceled to avoid a potential conflict with striking WGA writers. The decision was made by the Democratic National Committee concerning a December 10th, 2007, debate at CBS Television City in Los Angeles, where pickets gathered every day.
The Perry company's alleged union-busting activities were kept secret until last night when at 4 pm PT the WGA West issued a surprise news release about what had gone on for the past six months inside his production company, House of Payne, LLC. That same day, the guild filed unfair labor practice charges with the NLRB, alleging that House of Payne unlawfully fired four writers in retaliation for their union activity. The charge also accused the company of bargaining in bad faith with the Guild, which had been seeking to negotiate a contract covering the writers on Perry’s cable television series House of Payne and Meet the Browns. The four scribes, Kellie Griffin, Christopher Moore, Teri Brown-Jackson, and Lamont Ferrell, are all African Americans and together have written over 100 episodes, according to the WGA.
According to the WGA, "House of Payne is an incredibly successful program. According to TBS, the second episode was basic cable’s all-time No. 1 sitcom telecast. House of Payne has generated $200 million in license fees from TBS for 126 episodes and recently sold into syndication on ‘MyNetwork’ for a reported additional $100 million. The House of Payne actors are covered under a Screen Actors Guild contract, and Mr. Perry, who has directed every single episode to date, is covered under a Directors Guild contract. However, House of Payne is one of the only scripted shows on TV that isn’t covered under a WGA contract.'
A lawyer for Perry is claiming that the writers' firings had nothing to do with contract negotiations but was related to "the quality of their work". But the timing of the firings is especially suspicious since it comes just as House Of Payne was being syndicated (which is when the big money starts to roll in) and just when the writers were working on the development of Perry's new comedy premiering in January on TBS. Perry's lawyer admited that all the contract issues were pinned down except one -- residuals from repeats shown on broadcast TV stations. Those small residuals are vital to the financial security of showbiz writers. By contrast, Perry signed a $200 million 100-episode deal with TBS for the show. Besides residuals, Perry has refused to agree to a WGA contract that would give the writers health care benefits or pensions. On Tuesday of this week, Perry fired the writers, after warning them some weeks ago that they should “be careful about pushing the WGA deal or you could be replaced,” according to one of the axed scribes.
Although Perry's entertainment content has been criticized for perpetuating African American steroetypes, his production business is one of the most active and profitable around. He owns 100% of his films and TV productions, so, as an indie, he can forgo a guild agreement even though most producers become signatories in order to employ WGA-caliber writers. Today, the WGA reminded guild members that, "under Working Rule 8, members of the Writers Guild of America, West may not accept employment with any non-signatory entity, including Tyler Perry studios and all of its related entities. The guild intends to fully enforce this important policy."
This weekend is the grand opening of his 60,000 square foot production complex on 28 acres situated in Atlanta's outskirts. Tyler Perry Studio is a monument to himself as well as the first independent studio of its size to open in Georgia. It features a 300-seat screening room, three soundstages, and a theater. It will also host a theater company and acting school in the future. But on Saturday and again on Sunday, the WGA, the Teamsters, and other union groups will be picketing the gala. A large crowd of Hollywood actors who've worked with Perry as well as local luminaries were expected to attend. But the WGA unions are asking them to respect the picket line and stay away.
This is not the first alleged union buster to be a big Obama supporter. Most of the Hollywood CEOs (except Paramount's Brad Grey who's a McCain donor) and their wives are big fundraisers and campaigners and supporters of Obama's even if their Big Media bosses tend to be avowed Republicans. But all the studios and networks have been working for the past 18 months to bust two of Hollywood's highest cost talent guilds. The WGA filed charges with the NLRB over Big Media's refusal to negotiate during the writers strike. And now another strike could be looming because the same employers won't negotiate with the Screen Actors Guild which belongs to the AFL-CIO. Stay tuned.

Unless the McCain campaign comes to this website and picks this up as a talking point, I doubt Tyler Perry’s union troubles will have an impact on Obama. Perry’s appeal outside of a very narrow demographic means mainstream America, especially the voters Obama is trying connect with, has no idea who he is, nor would they care.

I have been a huge fan of Tyler Perry and his family-friendly, inspiring movies…but to read that he has never voted and to be asked to believe the reasons he states for voting this year is ridiculous. Even if I believed my vote didn’t count, which we all wonder at one time or another, I have voted in every, single election since I turned 18 years old. It’s my God-given right and I have done it. What a disappointment that Tyler, who professes such faith in God, would not have exercised his right!

As someone who is going to vote for McCain, I can honestly say that this issue has so little to do with Barack Obama and this will have no effect on the election whatsoever. It’s a valuable story for the writers and the unions, but the link to Obama or the election is extremely forced and weak.

Thanks for letting me know he is supporting Obama as strongly as he is. I will never buy or even rent another of his films again. In fact, my husband bought one last week that we had not opened yet, I’ll have him return it, and say why.
Instead of casting an experienced actor like Denzell Washington to play Obama, they cast some unknown actor with little experience from the obscure and talk him up as the next big thing. Then the actor and Obama will have something in comma. All hype, no substance.

Obama cut his losses in Georgia. He quit running TV spots and moved staff to North Carolina.

I think that some of the people leaving comments on this are missing the point. I am a Teamster member and my wife is a U.F.C.W union member and almost everyday we receive mail from our unions praising Mr. Obama, how only Mr. Obama can save us, it is our sacred duty to vote for Mr. Obama, in other words, the unions are spending a lot of time and money on Mr. Obama. The least Mr. Obama can do is show a little thanks and gratitude towards the unions seeing as they are spending part of our union dues in promoting the hypocrite.

I’m sorry but what does this have to do with Barack Obama? Someone treats his employees like sweat shop workers and it’s somehow the Presidential candidate’s fault? This is truly poor journalism!
Regardless I used to work at TPS and can attest that Perry is not a nice person. Once a “starving writer” himself, he knows full well writers depend on residuals to survive between gigs and has refused to go union so he can save money as a producer. The studio has contracts with the Directors Guild, and the Screen Actors Guild which enables Perry to get paid more because he directs every episode AND when he puts on the dress for the Madea role.
He fires people at the drop of a hat and everyone at the studio works in daily fear of losing their jobs. People are woefully underpaid for their work by industry standards but because the studio is in Atl and not LA he gets away with paying people peanuts. Not a cool environment and I’m thankful I am no longer there.
But again this has absolutely nothing to do with Obama and I find it insulting to Americans that the writer of this article is implying otherwise.

I’m always curious when someone is accused of “perpetuating black” stereotypes, but their show is very, very popular, I would assume, among blacks. At least I don’t know any white people who watch his stuff. Perhaps there are a few.
If the audience is mostly black, and the show is very popular, do we conclude that black people really ENJOY depictions that are “stereotypical?” Or maybe the humor is not really that “stereotypical” but more “accurate?”

I’ll be out selling antiques (aka junk) at the melrose swap meet this weekend because of producers like Tyler Perry. Comedy Central, TBS, TNT, BET, Freemantle, etc.. they want to absorb weeks of our lives, sap our creativity, take the credit, than pay us 20% of WGA minimum (1,000 a week after taxes and after my manager’s cut if he got me the gig, is about $650 a week, most p.a.’s and starbucks employees make more than that) . And of course they give us the title of assoc. producers instead of writers. I know exactly what those 4 writers are going through, GOOD LUCK! There’s no lack of work out here right now but i’d rather stay broke for a year and get one moderate feature film sale, it keeps my soul intact.

I watched “House of Payne” regularly until the idiot “guns are evil” episode, and I made a point to see Perry’s movies until his recent email stumping for Obama. Now I’m giving away my copies of “Diary of a Mad Black Woman” and “Why Did I Get Married?”, and I have no intention of enriching Perry further.
That said, I have no problem with “union-busting”, and I wish Perry well in that endeavor. But the Democrat party tends to savage people who don’t toe the party line, so Perry may not be as prominent in Obama’s campaign from now on.

I like Tyler Perry. And Obama is likable, too. But charisma without substance is lethal in a leader. And it is really lethal, when you start believing what others say about you and take all the credit for yourself.
Because he is getting it so fast, Obama is being corrupted by power and his ego. And there is no escape from that. His roots were destroyed by the way he came up through Chicago Politics and those who saw him as a tool for their agendas. Obama’s naivete and ego are the tools that evil exploits. The Liberals will find out too late, that he is their worst enemy, too. Most of them are in love with socialism as a theory, but would not dare live in a socialist country, and would never dream of practicing it in their personal lives. The people that have his real ear and heart, hate America.

1.) He donated the max. (So have many people, to both campaigns. That means nothing. It’s less than five grand, Nikki — peanuts. If you tried to gain influence over a D-Girl with that amount, she’d laugh in your face.)
2.) He’s writing a script based on Obama. (So is everyone in town. There’s already been a movie based on McCain. As a black female writer in Hollywood, I had previously been very happy to hear of Tyler Perry’s success. And since he and many filmmakers and TV writers/producers have been snubbed by the unions for decades, there was no reason not to celebrate the successes of a man who made it outside the industry. Stomping on one’s fellow man who helped get you there with those self-same boots is another, although it’s not as if that sort of thing does not go on all the time in Hollywood. Perry is just a symptom of a disease that infects all of Hollywood. And despite what people think, it is not capitalism.
Capitalism is the system where both sides in any deal get what they want. Employers pay what the market can bear in salary and benefits to attract the best employees, who then use their talent and services to make the employer money. It’s not supposed to be about grabbing a piece of the mythical pie, it’s supposed to be about making new, bigger and fresher pies.
Sadly, that’s not how a lot of people handle it.
The problem with Hollywood is what I call Neo-Feudalism. It is where the people in charge see themselves as divinely placed, and proceed to grab everything they can get their hands on. So instead of making newer, bigger, pies, they get skyrocketing costs, increasingly pissed off unions, and an atmosphere that makes it harder and harder to do business every day, until the whole system just seizes up.
Tyler Perry had the opportunity to introduce a whole new business model to show-biz, but instead took the path that’s been used by everyone else, and he’ll soon start having the exact same problems. His films won’t be so cheap to make for very long, and while he may be able to replace folks on the short term, his inability to retain profitable talent will hurt him in the long run.
The actions of one black person does not have anything to do with other black people. TP is an individual who made a choice. That choice has NOTHING to do with who he is voting for or contributes to. Dear Non-Industry Trolls: I appreciate that you have strong views about unions, but unless you have worked in this industry, you nothing about it. Consider this – I’ve worked in this industry for 10 years or thereabouts and I can tell you first-hand that non-union workers in our industry routinely work 16-22 hour days for less than minimum wage. How many other industries could get away with that? Even union workers work on a freelance basis – they have no job security and are provided with no benefits of any kind by their employers. Let me repeat that for those who are a bit slow on the uptake. No job security. No benefits. Of any kind. You know where we get our medical insurance and 401Ks from? The Unions. And if there were no unions, everyone would be getting paid a pittance to work outrageous hours, like all of the non-union workers do. The only people getting paid would be studio execs, producers, and movie stars. The rest of us would be fucked over ten ways from Sunday. So, maybe you guys don’t feel that non-famous entertainment industry peeps deserve to get benefits or be paid more than minimum wage. But we beg to differ. We kind of enjoy eating and being able to put gas in our cars and pay rent/mortgages. And no amount of screaming about the evils of unions will change that.

Being the wife of a Teamsters Union member, I have to say that just because the “Union” supports a candidate, that doesn’t mean that the actual working members who pay the monthly union dues support that candidate. Most of my husband’s co-workers also do not support Sen. Obama, and they did not support Sen. Kerry. We did not support Kerry, while the Teamsters officials did. The officials in the unions do not represent the working members’ political views. If they did, they would take a vote of the members, and then support who wins the vote. They never have. The officials are always Democratic supporters.
The union has become a political tool, IMHO.
Tyler Perry makes movies with Christian themes, and yes, even calls out the black community in them for their lack of morals (out-of-wedlock birthrate, absent fathers, slow work ethic)…yet he chooses a candidate who not only favors unfettered abortions, but refuses to vote to PROTECT child born alive after botched abortions. (Those ARE infants…when you allow them to die it is, indeed, infanticide). I respected Tyler Perry for what he was able to accomplish with his business and movie production company, but after reading this I see him in a whole new light. How dare he not give his writers simple health benefits ON TOP of not allowing them to receive residuals for THEIR own work? I was watching a little of last nights debate and thought that the Democratic ticket should be reverses, Obama should be the Vice Presidential canidate and Biden should be the Presidential canidate. AND THE SITE IS TAKING THEM DOWN. My comment was up for a few minutes, then gone. I tried another – GONE WITHIN MINUTES. Twenty other emails I read today that were negative of Mr. Perry – ALL GONE! Other writers are confirming the same.

It always amazes me when people (mostly white) claim that black people only vote for black candidates because they’re black. To me and most logical thinking people, that means those people understand black people to a point no other social scientist have. What I find even more ironic, is some of these people while they profess they would never vote for a person based on race when polled say that race does play a factor.
Most qualified candidate? The only area Obama is more qualified than McCain or Palin, for that matter, is in the 7 states of the “57 states” he campaigned in. Also he reads a teleprompter with the best of them in the “lamestream” media. No wonder they like him so much because they have so much in common. To me Obama is a total rookie who should get more seasoning before he becomes president. Perry should not be such a hypocrite and say he doesn’t vote for him because of his color. There are millions who will vote only because he is black.

To My Fellow Members,
Our Guild is engaged in a labor dispute with Tyler Perry’s production company, House of Payne, LLC. Earlier this week, four of the writers on its TBS sitcom House of Payne, who were actively seeking Guild representation, were abruptly fired in violation of federal labor law. A fifth writer has since left the show in solidarity.
The Guild has been negotiating with House of Payne since April. Unfortunately, the company has refused to accept reasonable contract proposals, including payment of residuals. A few weeks ago, the writers, some of them WGAW members, were told by Mr. Perry himself: “Be careful about pushing the WGA deal or you could be replaced.” This warning, the subsequent terminations, and the company’s bad-faith bargaining, are all illegal. Accordingly, we have filed unfair labor practice charges with the NLRB.
House of Payne is an incredibly successful program. According to TBS, the second episode was basic cable’s all-time No. 1 sitcom telecast. House of Payne has generated $200 million in license fees from TBS for 126 episodes and recently sold into syndication on ‘MyNetwork’ for a reported additional $100 million. The House of Payne actors are covered under a Screen Actors Guild contract, and Mr. Perry, who has directed every single episode to date, is covered under a Directors Guild contract. However, House of Payne is one of the only scripted shows on TV that isn’t covered under a WGA contract.
The four terminated House of Payne writers and WGAW staff are right now in Atlanta, preparing to picket the opening of Tyler Perry’s new studio starting tomorrow. They will be joined by Atlanta-area WGAE members, some WGAW members who are leaving L.A. tonight, members of the International Brotherhood of Teamsters, and other supporters. We are asking guests invited to Tyler Perry’s grand opening not to cross our picket line in a show of solidarity with the fired writers.
Many of our fellow members have already responded to media coverage of this injustice with messages of support, asking how they can help. If you would like to show support for these writers, you can send a message to Tyler Perry by clicking here. In the meantime, Guild members are reminded that under Working Rule 8, members of the Writers Guild of America, West may not accept employment with any non-signatory entity, including Tyler Perry studios and all of its related entities. The guild intends to fully enforce this important policy.

I’m not sure which ones I love more – the ones posting under different names using the exact same voice and talking points, or the ones advocating illegal union-busting (i.e. “I own a small business and would fire anyone who attempted to unionize my workforce, of course I live in a right to work state so I can do that” – yes, because that’s exactly what “right to work” means, apparently). Comedy gold. Nikki, if you love us, you’ll cover this.
As for Tyler Perry, it’s well known that he’s out for his own interest and not at all concerned with his staff or their welfare. This isn’t the first time he’s had these kinds of problems, and it won’t be the last. If he wants to play ball with the big leagues, he’s going to have to deal with the unions like everyone else.
As for Senator Obama, he has his fair share of associates and faulting him for what any of them do would be ridiculous. In any event, he’s pledged to sign the Employee Free Choice Act, which would have some major repercussions for Mr. Perry if this WGA ULP has any merit to it.
Tying the Senator to any of this is silly – he’s not showing up at this studio opening on Saturday, and he never said he would. He would be foolish to blow off Mr. Perry’s enthusiasm & support, but even more foolish to cross a Hollywood picket line this close to the election. It’s a non-issue.

Here’s what many of you right-wingers are missing with regard to Tyler Perry firing his writers for trying to unionize — he was cheating them for his own profit and greed.
When you write for television or film, it is like being a composer, songwriter, illustrator, author, etc – you are contributing to creating an intellectual property. Authors, illustrators, composers, etc all get residuals when their work continues to make money. TV writers deserve the same. I’ll make it simple so even you Sarah Palin can understand it. If you are a baker, you create a recipe and bake a cake, it gets sold, you get paid once (or by the hour for as long as it took you to make that one cake). But if that same cake could magically get sold and eaten, again, and again, and again, and you only got paid once, but the owner of the bakery got paid every time the magical cake was sold, would that be fair? Both the bakery owner and the baker deserve to be compensated — the bakery owner for investing in the bakery and the baker for creating the cake. If you are the average worker, you get paid every time something you do makes money (building something, selling something, etc). But if what you do is create intellectual property that continues to make money due to its use over and over again, you are entitled to a portion of those profits. Rush Limbaugh gets paid for every single radio station he is on and every single book he sells. Should he only be paid by his local station and for selling one book? Seriously, give it some thought. Lastly – politics has nothing to do with this. McCain and Obama both have plenty of donors and supporters that do things that are inconsistent with their candidates platform – blaming the candidate is ridiculous. That notwithstanding, considering this story is just breaking now and and is a surprise to most people in the industry, it’s unlikely that Barrack Obama had any knowledge that Perry was not running a WGA production.
Of course this is a labor issue. And from the update above it’s gotten more interesting. Now Tyler Perry I believe everyone likes. I saw one of his films two years ago and I enjoyed it. I love the his grandma charactor he did for he made me laugh. Now this may not explode at all. Tyler and the others have more bigger issues to worry about: a possible SAG strike. Which can effect everyone in the entertainment industry.

Tyler Perry is a union-busting scumbag… this has been well known in Hollywood for some time, especially among writers of color. Perry’s union-busting on the writers is especially egregious considering that the actors and the directors on his shows ARE union-covered. He’s a double scumbag for exploiting his own race, though… this isn’t a corporate giant like Viacom cracking down at random on anonymous writers who dare speak up, this is Perry trying to prevent any other black writer who works for him from becoming as wealthy or successful as he is, and it reeks. Why are people so intent on pinning Perry’s union bust as another blow for Obama? And why bother pinning politics on it for one?
This a matter concerning unions and fair compensation, which Tyler Perry failed to uphold. The WGA and the fired writers have valid reason to complain, moreso considering that Perry isn’t a WGA member himself. And don’t bother with the usual “the writers knew what they were getting into and they shouldn’t complain” excuse — the writers were hoping for fair compensation and after they fulfilled their requirements for WGA membership, they were denied benefits and fired.
Does Perry think offering up fair pay, unionization and benefits for his writers will make him unprofitable and bankrupt? Far from it.

In short, it is shocking to me that hardly anyone questioned the entire frame upon which this article is even written— the insidious racism of trying to make Obama account for every action of every person, especially every Black person, he has ever met, passed on the street, or yes, donated to his campaign. I believe Perry has badly miscalculated here, and will be shown to be operating from a myopic standpoint, both as a business man and as a cultural producer.
